WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if
the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act,
2001.
WHEREAS on October 6th, 2020, Niagara Falls City Council will be holding a Closed
Meeting as permitted under s. 239 (2) (c), (e) and (f) of the Municipal Act:
(2) A meeting or part of a meeting may be closed to the public if the subject matter
being considered is,
(c) a proposed or pending acquisition or disposition of land by the
municipality or local board;
(e) litigation or potential litigation;
(f) advice that is subject to solicitor-client privilege, including communications
necessary for that purpose
THEREFORE BE IT RESOLVED that on October 6th, 2020 Niagara Falls City Council will
go into a closed meeting prior to their scheduled Meeting of Council that is scheduled at
3:00 p.m., to consider matters that fall under section 239 (2) (c) of the Municipal Act for a
proposed or pending acquisition or disposition of land by the municipality as part of 5801
Morrison Street. Council will also consider matters that fall under section 239 (2) (e) of
the Municipal Act to discuss a matter that may result in litigation or potential litigation with
regards to a printed news article from September 3, 2020. Lastly, Council will also
consider a matter that falls under section 239 (2) (f) for advice that is subject to solicitor-
client privilege regarding a potential Ramsar designation.
AND The Seal of the Corporation be hereto affixed. Carried Unanimously
(Councillor loannoni was absent fro vote).
