5. MAYOR'S REPORTS, ANNOUNCEMENTS
a) Mayor Diodati extended condolences on the passing of Doris "Marie"
McAuley, mother of Dave McAuley of Fire Services and to Matthew
Kirkwood, son of Corrine Kirkwood of Transportation Services.
b) Mayor Diodati recognized the following community events:
• Parade of the Unknown Soldier
o Annual service held this year-- physically distanced
o Recognizes Niagara's own Unknown Soldier
o As well as recognizes soldiers around the world who have
paid the ultimate price for our freedom.
• Alex Luey Memorial Tree Donation
o Cherry blossom tree planted at Gale Centre Area.
o Arena was near and dear to Alex's heart.
o Alex's memory lives on here and in the hearts of his friends
and family.
o Dedication also attended by Councillors Pietrangelo and
Strange.
• John Allen Park Tennis Court Opening
o Full-service park with:
• Cricket-pitch
• New playground
o New Amenities include:
• Tennis and pickle-ball courts
• Upgraded basketball and road-hockey courts
• New location for natural outdoor ice rink with
updated drainage and natural seating.
• Landscaping upgrades
c) Mayor Diodati recognized Councillor Mike Strange for attending the
"Falls Illumination Tower Tour for Armenia Independence Day" with the
Ambassador of Armenia to Canada.
d) Mayor Diodati announced the following upcoming event:
• Remembrance Day
o Virtual Live-streamed ceremony will take place.
o Stay tuned for all of the details at niagarafalls.ca.
e) The next Council meeting is scheduled for Tuesday, October 27th, 2020
at 4:00 PM.

The report recommends the following:
1. That the application to amend the Zoning By-law be approved
subject to the modifications detailed in this report;
2. That the Riverfront Plan of Subdivisioin be draft approved subject
to the red line revisions outlined in this report and the conditions
in the attached Appendix A;
3. That the Mayor or designate be authorized to sign the draft plan
as "approved" 20 days after notice of Council's decision has been
given as required by the Planning Act, provided no appeals of the
decision have been lodged;
4. That draft approval be given for three years, after which approval
will lapse unless an extension is requested by the developer and
granted by Council; and
5. That the Mayor and City Clerk be authorized to execute the
Subdivision Agreement and any required documents to allow for
the future registration of the subdivision when all matters are
addressed to the satisfaction of the City Solicitor.
Alex Herlovitch, Director of Planning, Building and Development, gave
an overview of the background report PBD-2020-64.

application.
Jane Pepino, from Aird & Berlis, represented the applicant, GR (Can)
Investments Ltd addressed Council supporting the application.
The Public Meeting was closed.
Councillor Carolynn loannoni requested a recorded vote.
ORDERED on the motion of Councillor Vince Kerrio, Seconded by
Councillor Chris Dabrowski that Council move the recommendations in
the report PBD-2020-64 for the Riverfront Draft Plan of Subdivision and
Zoning By-law Amendment Application.

Double Direct Voting for Regional Representation

The report recommends for the information of Council.
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Lori Lococo that Council request that the Region of Niagara
adopt a resolution to allow the City of Niagara Falls to change its method
of electing City and Regional Councillors to the "Double-Direct Method,"
where three members of Council will serve on both Regional and City
Council, while five members of Council would serve only on City Council;
and to inform the lower tier Council's that have Regional Councillor
representation of Niagara Falls'City Council's actions in hopes of
encouraging other municipalities to consider the double-direct method,
where applicable.

2021 Council Schedule
The report recommends that Council approve the proposed 2021
meeting schedule.

7.3. PBD-2020-65
Proposed Telecommunication Facility
7825 Dorchester Road
Applicant: Landsquared
The report recommends that Innovation, Science and Economic
Development Canada be advised that the City of Niagara Falls does not
object to the construction of a 35m (115') tall monopole design
telecommunication tower and related equipment compound on the lands
known as 7825 Dorchester Road.
ORDERED on the motion of Councillor Vince Kerrio, Seconded by
Councillor Chris Dabrowski that the report be approved as
recommended.

8. CONSENT AGENDA
The consent agenda is a set of reports that could be approved in one motion of
council. The approval endorses all of the recommendations contained in each
of the reports within the set. The single motion will save time.

The report recommends that Council receive the Monthly Tax Receivables

Fee Waiver Application
Niagara Falls Community Outreach Soup Kitchen — Food Drive
The report recommends that Council approve the Fee Waiver Application for:
1. Niagara Falls Community Outreach Soup Kitchen - Food Drive taking
place on Saturday, November 28, 2020 in the amount of$1,175.20 for
the use of a city bus for this community event.

2021 Schedule of Fees for Services
The report recommends that the Schedule of Fees as presented in the
attached schedule, be approved effective January 1, 2021.

Investment Policy
The report recommends the following:
1. That Council adopts a new Investment Policy for the City of Niagara
Falls.
2. That Staff be directed to prepare the necessary by-law to adopt the
policy attached as Appendix 1.

1. That in the event that Council determines it wishes to do so, By-law No.
2002-064 be amended to prohibit the owner or operator of a golf course
or golf driving range from permitting anyone to hit a golf ball from the
golf course or golf driving range onto a City highway.
2. That the Mayor and City Clerk be authorized to sign a by-law amending
By-law No. 2002-064, as set out in Recommendation 1.

Five-Year Loader Lease
The report recommends the following:
1. That Council approve of a five-year lease agreement with Toromont Cat,

The report recommends that Council the alteration and a grant in the amount of
$5,000.00 to assist with the cost of the restoration of the louvres on the steeple
as it will not alter the reasons for designation and assist in the preservation of
the steeple and ensure the continued integrity of the building.

Pettit Avenue, north of Burdette Drive
Parking Review
The report recommends that "No Parking" restriction be established on both
sides of Pettit Avenue, north of Burdette Drive and include the entire turning
basin.

Garner Road between McLeod Road &Warren Woods Avenue
Parking and Traffic By-laws
The report recommends the following:
1. That "no parking" restrictions are posted on both sides of Garner Road
between McLeod Road and Warren Woods Avenue;
2. That "no standing" restrictions are posted at all future transit stop
located on Garner Road between McLeod Road and Warren Woods
Avenue; and, .
3. That the bicycle lanes on both sides of Garner Road between McLeod
Road and Warren Woods Avenue be designated by municipal by-law.

Councillor Lori Lococo requested that Report FS-2020-04 (COVID-19
Update - Planning for a Potential Resurgence) be pulled for further

ORDERED on the motion of Councillor Vince Kerrio, Seconded by Councillor
Wayne Thomson that the recommendations in Report F-2020-43 (Investment
Policy) be approved as recommended and that the Treasurer's investment
statement also be sent to the Auditor as additional information each year as
part of their annual review.

9. COMMUNICATIONS AND COMMENTS OF THE CITY CLERK
9.1. Questions respecting Integrity Commissioner - L-2020-09
Letter to Mr. Matson from Integrity Commissioner Office - October 5,
2020 as well as Final Report dated August 7, 2020 are included for
Council's information.
Motion (from Council Meeting of September 15, 2020)
That Council receive the report, L-2020-09 and to ask the Integrity
Commissioner to release the full report (IC-182-0220) as well as any
other Integrity Commissioner reports publicly, upon the approval of the
applicant and respondents.

9.2. Decriminalization of Drugs -Chief of Police Initiative
This correspondence is the response from Positive Living, relating to the
motion at the August 11, 2020 City Council Meeting.

ORDERED on the motion of Councillor Lori Lococo, Seconded by
Councillor Carolynn loannoni that Council support the Canadian
Association of Chiefs of Police Decriminalization for simple possession
of illicit drugs.
Motion was withdrawn and no vote was taken.
ORDERED on the motion of Councillor Chris Dabrowski, Seconded by
Councillor Vince Kerrio that Council defer any decision for support of the
decriminalization of drugs until questions can be gathered, submitted to
Positive Living and information suppled back to Council and to have staff
reach out to the Provincial Medical Officer of Public Health and to Dr. M.
Mustafa Hirji, Acting Medical Officer of Health for Niagara Region, for
their further comments and opinions.

9.3. Hwy 405 Functionality
Following up with the letters that were sent out to the Ministry of
Transportation and to the Niagara Region in June of 2019.
RECOMMENDATION: For the Information of Council.
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Mike Strange that a resolution be sent to the Regional
Government asking them to endorse an environmental assessment and
to make sure Highway 405 can be fully functional in the future;
furthermore, once that has been endorsed, that it be sent to the Ministry
of Transportation (MTO) and to extend an invite to the Minister of
Transportation to visit the area and to provide the Town of Niagara-on-
the-Lake with a copy of the resolution so that they can provide support.

9.4. NICE (Niagara Integrated Commercial Enterprises)
Frank Salvati, of Niagara Integrated Commercial Enterprises (NICE)
submits the attached correspondence requesting a site-specific zoning
by-law for an undetermined location.
RECOMMENDATION: For the Information of Council.

regarding Cannabis grow-op locations, to gain input from the public and
to get a public meeting in place by November 15, 2020; furthermore, to
bring a report back to Council by December 8, 2020.

9.7. Zoning By-law Amendment Application for 4210 Lyons Creek Rd.
Correspondence from Nancy Smith of Turkstra Mazza Law Firm
regarding Council's decision on the proposed development of one four-
storey, 77 unit apartment building and the subsequent petition.
RECOMMENDATION: For the Information of Council.
Nancy Smith, of Turkstra, Mazza Law Firm addressed Council asking
that Council re-evaluate and support the proposal in hopes of leading to
a settlement hearing.

Councillor Vince Kerrio that Council direct staff to establish a policy or
procedures with regards to submitting petitions or any information to
Council.

9.9. Special Occasion Permit Request -Campark Resort - Haunt Manor
Phil Van Kleef, from Campark Resorts, is requesting that the City of
Niagara Falls declare the annual event to be held on October 10, 16, 17,
23, 24, 25, 30, 31, 2020 as "municipally significant" in order to assist with
obtaining a Special Occasion permit from AGCO.
This is for an outdoor gift shop selling hard cider and beer during the
event.
RECOMMENDATION: For the Approval of Council.
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Lori Lococo that the City of Niagara Falls declare the annual
event, "Haunt Manor"to be held on October 10, 16, 17, 23, 24, 25, 30,
31, 2020 as "municipally significant"in order to assist with obtaining a
Special Occasion permit from AGCO.

9.10. Proclamation Request - Child Care Worker & Early Childhood
Educator Appreciation Day
The Ontario Coalition for Better Child Care is requesting Niagara Falls
City Council to proclaim and participate in "Child Care Worker& Early
Childhood Educator Appreciation Day" on Thursday, October 22nd,
2020.
This day recognizes the commitment, hard work and dedication of Early
Childhood Educators (ECEs) and staff who work with young children.
RECOMMENDATION: That the City of Niagara Falls recognize "Child
Care Worker& Early Childhood Educator Appreciation Day" on
Thursday, October 22nd, 2020.

RECOMMENDATION: That the City of Niagara Falls declare
September of 2021 as "Childhood Cancer Awareness Month" and to
arrange a Flag-raising ceremony for September 2021.

9.12. Proclamation Request - Celebrating 50 years of BIAs in Ontario
Ron Charbonneau, Chairman on behalf of the Board of Management for
the Downtown BIA, is requesting the City of Niagara Falls to declare the
year 2020 as the "50th Anniversary of the creation of the Business
Improvement Areas in the Province of Ontario, and the world." They are
seeking Council to make the proclamation to celebrate the significance
of 2020 for Niagara Falls BIAs, as they have been and continue to be
central hubs for community, festivals and celebrations, full of vibrance
and resilience.
RECOMMENDATION: That the City of Niagara Falls declare the year
2020 as the "50th Anniversary of the creation of the Business
Improvement Areas in the Province of Ontario, and the world."

of October 19-25, 2020 as "Waste Reduction Week in Canada."

On behalf of the Wrongful Conviction Committee, the attached
correspondence is to request that the City of Niagara Falls proclaim
October 2, 2020 as "Wrongful Conviction Day".

Wrongful Conviction Day is designated as an annual International Day
to recognize the tremendous personal, social and legal costs associated
with wrongful criminal convictions. This day recognizes those persons
who have been forced to endure the tremendous consequences brought
by a wrongful criminal conviction. The purpose of this day is to inform
and educate the broader international community on the causes,
consequences and complications associated with wrongful criminal
convictions.
RECOMMENDATION: That the City of Niagara Falls proclaim October
2, 2020 as "Wrongful Conviction Day".

Niagara Falls' Fire Chief, Jim Boutilier, is requesting that the City of
Niagara Falls proclaim the week of October 4 - October 10, 2020 as
"Fire Prevention Week." This year's theme is "Serve Up Fire Safety in
the Kitchen."
RECOMMENDATION: That the City of Niagara Falls proclaim the week
of October 4 - October 10, 2020 as "Fire Prevention Week."

Councillor Wayne Campbell that the City of Niagara Falls proclaim the

10. RATIFICATION OF IN-CAMERA
a) Ratification of In-Camera
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Wayne Thomson that Council determined that the purchase of
part of 5801 Morrison Street is in the best interest of the City and that
the City enter into an Agreement of Purchase and Sale with the Niagara
Falls Curling Club, for the purchase price of$300,000.00 plus HST.

support any Ramsar designation status for the Niagara River."

The City Clerk will advise of any additional by-laws or amendments to the by-
law listed for Council consideration.
2020- A by-law to fees and charges for various services, licences and
97 - publications for the City of Niagara Falls.
2020- A by-law to amend By-law No. 79-200, to permit the construction of two
98 - 10 storey wings onto an existing hotel on a portion of the lands, to
permit a portion of the required parking for the hotel to be provided off-
site on another portion of the lands and to repeal By-law No. 2001-265
(AM-2020-003).
2020- A by-law to amend By-law No. 2002-064, being a by-law to prohibit the
99 - obstructing, encumbering or fouling of highways and to regulate the
crossing of curbings, sidewalks, boulevards and parkland.
2020- A by-law to amend By-law No. 89-2000, being a by-law to regulate
100 - parking and traffic on City Roads. (Parking Meter Zones, Parking
Prohibited)
2020- A by-law to amend By-law No. 89-2000, being a by-law to regulate
101 - parking and traffic on City Roads. (Stopping Prohibited)
2020- A by-law to amend By-law No. 89-2000, being a by-law to regulate
102 - parking and traffic on City Roads. (Stopping Prohibited, Standing
Prohibited, Parking Prohibited, Designated Lanes)
2020- A by-law to amend By-law No. 2002-081, being a by-law to appoint City
103 - employees, agents and third parties for the enforcement of provincial or
municipal by-laws.
2020- A by-law to expand the boundaries of the Victoria Centre Business
104 - Improvement Area and to amend bylaw 1985-059.
2020- A by-law to adopt, ratify and confirm the actions of City Council at its
105 - meeting held on the 6th day of October, 2020.
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Wayne Thomson that the by-laws be read a first, second and
third time and passed.

12. NEW BUSINESS
a) Niagara This Week Article -September 3, 2020
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Mike Strange that staff ask outside Counsel to investigate if
the Code of Conduct was broken in any way with regards to the Niagara

b) Old Casino Parking Lot -Veterans Memorial Highway
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Mike Strange that the Ministry of Transportation (MTO) be
asked to maintain the upkeep of the property at the old casino parking
lot, southwest corner of the Veterans Memorial Highway(Hwy 420) and
Stanley Avenue or that it be transferred to the City for$1.00.

c) Reinstating Tax Penalties
ORDERED on the motion of Councillor Vince Kerrio, Seconded by
Councillor Wayne Thomson that the City change its penalty rate from
1.25% per month to 0.50%per month until the end of 2020 and to come
back with a report for further discussion and review at the December 8th
Council meeting.
Carried Unanimously.
d) Honouring Alex Luey and Julianne Miszk
ORDERED on the motion of Councillor Mike Strange, Seconded by
Councillor Victor Pietrangelo that staff collaborate with the Luey and
Miszk families on ideas of how to pay tribute to these two special
individuals.
Carried Unanimously
e) Flu Clinic at Gale Centre - Free Transit for Seniors
ORDERED on the motion of Councillor Chris Dabrowski, Seconded by
Councillor Wayne Campbell that free transit bus rides for seniors be
provided on route to the Gale Centre during all flu clinic days for all
public health drive thru flu vaccinations.
Carried Unanimously.
f) Spooky Awards - Halloween
ORDERED on the motion of Councillor Wayne Thomson, Seconded by
Councillor Mike Strange to encourage residents in Niagara Falls to
decorate their homes for an annual Niagara Falls Halloween Spooky
Awards Event and to recognize those homes that participate and that the
City budget$5,000.00 towards this city-sponsored event.
