WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if
the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act,
2001.
WHEREAS on October 27th, 2020, Niagara Falls City Council will be holding a Closed
Meeting as permitted under s. 239 (2) (d), (e) and (f) of the Municipal Act:
(2) A meeting or part of a meeting may be closed to the public if the subject matter
being considered is,
(d) labour relations or employee negotiations;
(e) litigation or potential litigation;
(f) advice that is subject to solicitor-client privilege, including communications
necessary for that purpose
THEREFORE BE IT RESOLVED that on October 27th, 2020 Niagara Falls City Council
will go into a closed meeting prior to their scheduled Meeting of Council that is scheduled
at 3:00 p.m., to consider matters that fall under section 239 (2) (d) of the Municipal Act for
a matters dealing with labour relations involving a bargaining update. Council will also
consider matters that fall under section 239 (2) (e) of the Municipal Act to discuss a matters
that may result in litigation or potential litigation with regards to a printed news article from
September 3, 2020 as well as the zoning bylaw amendment application for 4210 Lyons
Creek Road. Lastly, Council will also consider a matter that falls under section 239 (2) (f)
for advice that is subject to solicitor-client privilege regarding Steel Rail Development.
