WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if
the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act.
WHEREAS on January 17, 2023, Niagara Falls City Council will be holding Closed
Meetings as permitted under s. 239 (2) of the Municipal Act, namely;
(c) a proposed or pending acquisition or disposition of land by the municipality or
local board.
(e) litigation or potential litigation, including matters before administrative
tribunals, affecting the municipality or local board.
THEREFORE BE IT RESOLVED that on January 17, 2023 Niagara Falls City Council will
go into a closed meeting to consider matters that fall under section 239 (2) (c) and (e) to
discuss a proposed disposition of land within the Montrose Business Park as well as for
reasons of litigation or potential litigation for matters before the Ontario Land Tribunal.
