a) MW-2005-34 - Forest Glen Drive, Glenoaks Avenue and Oakridge Drive
Parking Review
Several residents from Glenoaks Avenue advised Committee of the curr~nt on-street parking
problems they are encountering since St. Vincent De Paul Elementary School opened. Following
a brief question and answer period the following motion was made;
It was ORDERED on the motion of Mayor Salci and seconded by Alderman Diodati that;
1) Parking be prohibited at all times on the east side of Glenoaks Avenue between Forest
Glen Drive and Thorold Stone Road and parking be prohibited from 8:00 a.m. to 4:30
p.m. on the west side of Glenoaks Avenue,

2) parking be prohibited on the south side of Forest Glen Drive between Glenoaks Avenue
and a point 85 metres east of Glenoaks Avenue from Monday to Friday between 8:00
a.m. and 4:30 p.m., and;
3) a stop sign be installed on Glenoaks Avenue at Forest Glen Drive facing northbound
motorists and staff begin standard procedures for the installation of an all-way stop at
Glenoaks Avenue and Forest Glen Drive.
4) that staff investigate and report back to Committee if the City has a one foot reserve at the
end of Forest Glen Drive at the St Vincent De Paul School property.
5) that staff requests the following details from the City's Planning Department;
What is the parking requirement for schools?
How much parking is currently available at St. Vincent De Paul School?
Has the presence of portables affected the parking?

b) MW-2005-41 - Dorchester Road between Isaac Street and Waterloo Drive
Parking Review
Mr. David Redekop advised Committee that he was not satisfied that the City was not taking
action by providing either curb and gutter or boulevards along Dorchester Road between Isaac
Street and Waterloo Drive. The Director of Municipal Works advised Committee that upon
investigation of various temporary solutions they were deemed unfeasible for all seasons. Once
the Dorchester Road EA is approved this area of Dorchester Road will be reconstructed.
Alderman Campbell requested that staffprovide a copy of the report to the Trails & Bikeway
Committee which meets on May 5, 2005 for their input.
It was ORDERED on the motion of Alderman Diodati and seconded by Alderman Pietrangelo
that the design for the reconstruction of Dorchester Road proceed immediately.

c) MW-2005-42 - Taxi Stand Advisory Committee Recommendations
It was ORDERED on the motion of Mayor Salci and seconded by Alderman Wing that:

1) the criteria established for the placement of on-street taxi stands, outlined in this report,
be approved; and,
2) the locations identified in this report for both new taxi stands and the removal of existing
stands, be approved.

d) MW-200544 - Garner Road Drainage
It was ORDERED on the motion of Alderman Campbell seconded by Alderman Morocco that
City Council approves the proposed drainage scheme to improve the drainage outlet for Garner
Road and surrounding lands as set out in this report including;
1. the preparation and registration of an Easement Agreement with Niagara Falls Golf
Course Ltd. (described as Part 1 and 2 on Plan 59R-12603) to secure rights to construct a
future storm sewer across the subject lands,
2. authorization to enter into negotiations to pumhase the 0.11 acre parcel (described as Part
1 on Plan 59R-3171) from Peter & Angie Aleo to provide for permanent access and
rights for temporary and future drainage works.

e) R-2005-20 - Indoor Soccer Project Update - Kalar Road Sports Park
It was ORDERED on the motion of Mayor Salci and seconded by Alderman Morocco that staff
continue to work with Copperlen provided a satisfactory response is received from Coppeflen
regarding their Business Plan and consensus is reached by July 31, 2005 on the details of a draft
Lease Agreement.

f) R-2005-21 - Grant Request - Village of Chippawa Citizen's Committee
Mr. Don Ede of the Village of Chippawa Citizen's Committee advised Committee that as a non-
profit organization that uses City property for 20 hours a year and can not afford the $799.20 for
the costs of insurance provided through the City.
Following a brief question and answer period the following motion was made;

grant for the Village of Chippawa Citizen's Committee be given.
It was ORDERED on the motion of Alderman Campbell and seconded by Mayor Salci that the
current policy established by the Recreation Committee regarding insurance liablity be reviewed.

NEW BUSINESS
· Alderman Diodati requested that staff provide a summary of report of upcoming
infrastructure projects and estimated times. The Director of Municipal Works indicated
that staff has been working on a report for the Mayor and are complying information both
Municipal and Regional that are taking place in Niagara Falls. This information will be
posted on the web site and will be provided to Council on May 2, 2005.
Alderman Morocco requested that staff advise when works will commence on the Little
Mississippi Drain. The Director of Municipal Works will provide this information for the
Committee.
Alderman Volpatti questioned staff as to when the potholes throughout the City will be
repaired. The Director of Municipal Works advised Committee that crews are out filling
potholes and urged Committee to call staff when repairs are needed.
· Alderman Volpatti requested an update of her previous request for a light at the
intersection of Domhester Road and Mountain Road. The Director of Municipal Works
advised that the Region is using funding from 2004 and putting it toward installing
signals at Domhester Road and Mountain Road intersection.

It was ORDERED on the motion of Alderman Kerdo seconded by Alderman Pietrangelo
that the regular meeting of the Community Services Committee be adjourned at 5:10 p.m.

Classic Bike Parking on Sidewalk
RECOMMENDATION:
It is recommended that permission is granted to allow the parking of a classic motorcycle on the
sidewalk adjacent 5743 Victoria Avenue subject to the owner entering into an a~eement with the
City of Niagara Falls.
BACKGROUND:
A request has been received to park a classic motorcycle on the side~valk adjacent to the "soon to
be" opened Classic Iron Motorcycle Museum, Inc. The property is located on the ~vest side of
Victoria Avenue south of Centre Street (formerly Alien Encounter).
Site investigations reveal that the placement of the motorcycle on the sidewalk should not
interfere with pedestrian or vehicular traffic operations subject to the motorcycle being
positioned to allow a 9' minimum span of unobstructed sidewalk. Council may be aware that the
adjacent property, Criminal Hall of Fame, also parks a nostalgic vehicle on the sidewalk during
the peak tourist season. Correspondence has been received from the Victoria Avenue BIA
supporting the request as it is felt that it will add another element of interest and excitement to
the area.

The request has been circulated internally for staffcomments. Provided that the following
conditions are met by the owner, staff has no objections to the placement of the vehicle on the
sidewalk for the 2005 season:
1) Permission is granted for the period from May 16, 2005 to October 14, 2005, inclusive
(152 days).
2) Total cost of $2,432.00 to be paid in advance (16~hour day, 8:00 a.m.. - 12:00 a.m.)
3) The vehicle must be placed in front of 5743 Victoria Avenue at a location approved by
the Traffic and Parking Services Manager and must be positioned such that there is a 9'
minimum span of unobstructed sidewalk.
4) Mr. Pasco is responsible for any damages caused by the placement of this vehicle on the
sidewalk.
5) The vehicle is removed nightly between the hours of 12 midnight until 8:00 a.m. to allow
sidewalk maintenance.
5) The city reserves the right to revoke this privilege at any time.
6) Mr. Pasco must provide $2 million liability insurance coinsuring the Corporation of the
City of Niagara Falls. Policy endorsement must be completed on the appropriate Liability
Insurance form.

Butler Place Parking Review
RECOMi~ENDATIONS:
It is recommended that parking be restricted at ali times on the north side of Butler Place between
Heritage Drive and a point 105 metres east of Heritage Drive.
BACKGROUND:
In reply to a request, staff has conducted a parking revie~v on Butler Place east of Heritage
Drive. The concern at this location stems from parked vehicles inhibiting access to residents
driveways.
Butler Place is a local type roadway located in a residential area extending in an east/west
direction between Heritage Drive and the eastern limit of Butler Place. In the study area Butler
Place is 7.5 metres in width with a sidewalk on the north side o~'the street only. Currently,
parking is allo~ved on both sides of Butler Place from Heritage Drive to a point 105 metres east
o£ Heritage Drive.
A review of the collision files reveals that there have been no collisions on Butler Place in the
previous three-year period. Observations reveal that due to the narrow roadway width, vehicles
parked on both sides of Butler Place greatly reduce maneuvering space available to motorists, as
well as visibility to both motorists and pedestrians. As a result, the operations of emergency and
maintenance vehicles, such as fire trucks and snow plows are significantly impeded.
Parking questionnaires ~vere delivered to homeowners on Butler Place who may be affected by
any changes to on-street parking in the study area. Through the questionnaires, the residents had
an opportunity to comment on the parking control that would most benefit their parking needs.
Based on the low number of responses returned (39%), a statistical consensus was not achieved.

It is recommended that the existing parking restriction on Butler Place be extended to Heritage
Drive on the north side due to the narrow width of the roadway. Given a 7.5m width, should
vehicles park opposite each other on both sides of the street, access for maintenance and
emergency vehicles would be virtually impossible. The Niagara Falls Fire Department confirms
that the road is too narrow to allo~v parking for their purposes and prefers parking restrictions on
both sides. However, a parking restriction on one side will provide greater accessibility for fire
trucks. Butler Place is a dead end street, and serves as the only access for 31 homeowners.
Observations indicate that homeowners have off site parking available on their properties. The
restriction will also ensure adequate visibility is provided for both motorists and pedestrians.
The Committee's concurrence with the recommendations outlined in this report ~vould be
appreciated.

Q.E.W. Sanitary Sewer Crossing - Sam's Montrose Hotel
Front End Cost Sharing Agreement
RECOMMENDATION:
It is recommended that staff proceed with the preparation of a Front-Ending A~eement under the
authority of the Development Charges Act.
BACKGROUND:
In November 1993, the o~vner of Sam'S Montrose Hotel (8675 Montrose Rd.) petitioned the City
to install a sanitary sewer across the Q.E.W. from Oakwood Dr. to the subject property in order to
address problems associated with a failed septic system ~vhich was ordered to be replaced by the
Regional Niagara Health Unit.
City Council at its meeting held on January l 0, 1994 adopted the recommendations set out in report
MW-94-03 and passed By-Law #94-12 authorizing the construction of the sewer under section 7 of
the Local Improvement Act.
The section of sanitary sewer that was installed has capacity and adequate depth to service those
properties located to the south of the Hotel as shown on the attached plan. The cost of this sewer was
$51,852.12.
The owner has completed his financial obligations for the repayment of the costs and has requested
the City to assist in the recovery of his costs should any other property owner in this area derive
benefit from the future use of this server.
The Development Charges Act, (sections 44 to 57) gives municipalities the authority to enter into
a "Front-Ending A~eement" that provides for persons who, in the future, develop land within the

area defined in the agreement to pay an amount to reimburse some part of the costs of the ~vork.
The process involves input from the affected property owners and the appeal process is through the
Ontario Municipal Board.
Municipal Works staff would like to hold a meeting to discuss possible cost sharing formulae and
alternatives before the Front-Ending Agreement is drafted for Council's consideration.
The purpose of this report is to seek Council's direction to initiate this first part of the process.

RECOMMENDATION:
It is recommended that a full-time Meclnanic, Operations Section - Municipal YVorks Division
position be posted.
BACKGROUND:
The 2005 Operating Budget included the cost of hiring one additional Mechanic. In 2004 over 3,000
hours of overtime was worked by our mechanics. This was due to the increase demand of
maintaining our aging equipment fleet and the addition o fnew equipment for Parks, Recreation and
Culture maintenance crews, Municipal Works Streets tourist area clean up crew and the present
service demands of the Fire, Humane Society and the not for profit organizations that we are
presently servicing. With the present staffing complement we are not capable of preparing off season
equipment while addressing equipment that is in service.
The addition of one mechanic will reduce the overtime honrs while providing us ~vith staffing to
better service the existing equipment fleet and outside agencies. The additional funds of $47,300.00
were included in the 2005 operating budget.
Committee's concurrence with the above recommendation would be appreciated.

RECOMMENDATION:
That Council approve the demolition of the Recreation Commission building (7565 Lundy's Lane)
and convert the entire property for cemetery purposes.
BACKGROUND
The MacBain Community Centre is scheduled to open in the Summer of 2005. At this time, the
Parks, Recreation & Culture staff will relocate from the Recreation Building situated at the comer
of Lundy's Lane and Montrose Road to the new Centre. A study was conducted in 2003 by BMA
Management Consulting [nc. to determine the"highest and best use" of the Recreation Building once
it was vacated.
The attached Study looked into three options for the best use of the property. The options are as
follows:
I. Sale of the property to a third party;
2. Alternate cemetery operational uses for the building;
3. Development of lands for cemetery purposes.
A detailed analysis, including a summary of the advantages, disadvantages, risks and opportunities
for each option was conducted by BMA Consultants. The final analysis recommends that the highest
and best use of the property ~vould be to "demolish the building and use the land for columbaria and
other interment options." This option has the least risk and the greatest revenue potential.
The Lundy's Lane Cemetery is located adjacent to the Recreation property and, therefore, the land
transition to cemetery use would be appropriate. There is a high demand for burial space in this
cemetery however, at present, there are less than ten single lots available for sale and there are
several people on a waiting list requesting double plots.

The 2003 Study recommends that the City should focus the property development on building
Columbaria, with space left over for traditional burials. Staff believes that a better use of the
property is to develop the land for traditional burial plots (double plots and cremation plots) with
an area reserved for Columbaria. The rationale is that the first Columbarium was installed at
Fairview Cemetery in September 2003 and the niche sales are slower than anticipated. Also, in
September 2004, the City took over the management and operation of the Stamford Green Heritage
Columbarium. With the two Columbaria now in operation, it is believed the market is not ready for
additional Columbaria at this time.
The projected costs to demolish the existing building, survey for cemetery plots, landscape and
beautification is $75,000. Over a ten-year period, it is expected that 400 cemetery lots would be sold
bringing in revenue of more than $206,400 and an additional $137,600 in Perpetual Care &
Maintenance Funds. The future installation ofa Columbarium will realize more than $100,000 in
additional revenue and Perpetual Care & Maintenance Funds. Revenues am based on 2005 rates.
A portion of the building is currently used by the Niagara District Art Association and they are in
favour of relocating to the Community Resource Building. The Niagara Falls Concert Band also
uses the building to store its music. Staff will attempt to find the Band an alternative location.
The proposed cemetery expansion was shared with the Park in the City Committee and they
supported the option to expand the existing cemetery. The comer of Lundy's Lane and Montrose
is considered a prominent City comer that would benefit from increased greening and beautification.
The Committee unanimously supported the following motion made by Loretta Burke and seconded
by Paisley Janvary-Pool:
To support the third alternative and to beautify the corner of Montrose Road and Lundy's
Lane and that the funds for development and ongoing maintenance be included in the
cemetery budget.
Conclusion:
Due to the popularity of, and public demand for more burial spaces in the Lundy's Lane Cemetery,
as well as the proximity of the Cemetery to the Recreation Building property, Staff believes that the
highest and best use for the property would be for cemetery purposes.
