Box 1023 Niagara Falls, ON L2E 6X5 Dear Mr. lorfida: I am writing in response to your letter dated March 6, 2007, received on March 14th 2007, inquiring as to the long term health service delivery plans, with particular reference to the Greater Niagara General site of the Niagara Health System. The information contained in this letter has also been shared through several face to face meetings with Niagara Falls Councilors, established upon request of the Greater Niagara General Hospital Foundation. Through the past seven years, significant rebuilding and investment in medical technology and equipment has taken place at the GNG Site totaling more than $35 million. This includes the emergency and ambulatory care centre; a state-of-the-art MRI and 64-slice CT, as well as regional stroke services to benefit all of Niagara. In addition, in the next five years, we plan to build a 15-station dialysis unit at GNG, along with a major overhaul to the operating rooms, with total construction estimated at more than $15 million. We are also planning for further rejuvenation of the Greater Niagara General Site, in the same way investment is currently being made in St. Catharines. However, we cannot promise that all services currently provided at the Niagara Falls site or any other site will continue in the same manner into the future. Based on changing health needs of the population, new technology and new services required, we constantly review how services are provided within our limited resources, which includes the shrinking supply of doctors and nurses as well as operating and capital budgets. Niagara is the second oldest census metropolitan area in Canada! An aging population requires access to different types of services. Cancer, heart disease and chronic kidney disease are three of the leading causes of death in Niagara. That's why we are planning for a new satellite dialysis centre in Niagara Falls in the next five years. We would not be doing our job if we did not respond to these changing needs. Therefore, every clinical service is continually challenged to look for new and better ways to deliver care. There has been much discussion regarding different ways to provide ophthalmology service, hip and knee service, and urology services, along with maternal child, to name only a few. The NHS needs to look at all services and how best to deliver them, making the best use of all of our sites, infrastructure and equipment. Hospitals are continually challenged to look for better and more efficient ways of doing things balanced against appropriate access to consumers. Due to the above, the only constant about healthcare is change itself. As hospitals continually look for new ways of doing things, change eventually occurs and with change comes fear and anxiety around what the change means to each person on an individual level. We understand how the thought of changes in services brings fear to the local community of loss of service but change means new services and new technOlogy as well. At this time, the NHS does not have a master plan of how and where all services might be delivered in the future. Our clinical and administrative leaders across all of our programs are reviewing recommendations from external reports, evidence and best practices to determine how these might be delivered in the future. It is our responsibility to Niagarans. The NHS will develop a master plan for ALL services, in the context of our commitment to all of our sites and consistent with the strategic plans of the LHIN and the Ministry of Health. Within the next year, we expect to have a preliminary master plan to begin further dialogue with our stakeholders, including community members, the LHIN and Ministry of Health. The final master plan would not only require endorsement by the NHS Board of Trustees but also by the LHIN and the Ministry of Health. You can be sure that the Greater Niagara General Site, with the significant capital investments made to date and the significant new construction and new services planned for the future, will continue to provide a vast arrange of necessary services to meet the needs of the local Niagara Falls community. He has been writing, photographing and producing videos on the Canadian military for more than twelve years. This is his first fuIl-length documentary project. The Department of National Defence granted the production full access to the Armoury for one week in April 2005. Here they did advanced camera work, filmed scenes and conducted interviews for the documentary. The film was made with the assistance of the Canadian Independent Film and Video Fund. The City of Niagara Falls took possession of the building in June 2005 from the Department of National Defence. It's prime function will be to commemorate military history. The Niagara FaIls Board of Museums manages the entire building and the Niagara Military Museum will operate on the first floor. The documentary follows the efforts oflocals trying to pre- serve the building and its rich heritage by turning it into a military museum to hon- our generations of Niagarans who began their march to war from the site. The 44- minute long film is a lesson -in historical presR ervations as well as a love let- ter to a local landmark, said O'Connor in a media release. Built in 1911, the armoury was designed by military architect T.W: Fuller. The building was one of 11 drill halls built in Ontario between -1896 and 1918 and originally served the Lincoin Militia as a training and _ recruitment centre during the First World War. From 1914 until 1920, the armoury housed Ukrainian immigrants confined by a Canadian government afraid they were with the enemy. More than 80,000 faced internment; with some forced to report to police as if. they were criminals on parole while others were imprisoned. The federal government apologized to Ukranian~Canadians in 2004; a plaque marking the dark moment in history hangs outside the armoury. The armoury continued to play a role in military actions, including during the Second World War and the Korean War, even after the Lincoln Militia merged with the Welland Regiment in 1935. The building was given a historical designation by the city in 1998, partly because of its architecture and part- 1y because of its historical significance. The building is also recognized by the fed- enil government. The armoury was decom- missioned by the feds in 1999 and sold to the city in 2005. The Niagara Falls Board of Museums now operates and manages it. O'Connor and his crew from Engine One Productions filmed scenes and interviews for the feature film over a week in April 2005 with help from the Lincoln andWelland Regiment, historical consul- tant David Webb from Fort George and the 2835 Royal Canadian Army Cadets. Full access to the armoury was granted by the Department of National Defence. Production was also assisted by the Park Plaza Hotel and the Canadian Independent Film and Video fund. MacKay, Minister of Foreign Affairs, has asked me to reply to your letter of February I, 2007, concerning the Canadian passport. Your comments on the validity period of the Canadian passport have been noted. As a member of various international organizations, Passport Canada is able to closely monitor the passport-issuing policies of other countries, some of which, such as New Zealand, have moved from a lO-year validity period to 5 years for the same reasons that Canada has long done so. A 5-year validity period allows new technologies to be incorporated more quickly, and as a result, ensures that the Canadian passport maintains a high level of security and integrity worldwide. With reference to the cost of the passport, Passport Canada is a Special Operating Agency of Foreign Affairs and International Trade Canada operating under a revolving fund. This means that all expenses are met from fee revenues. Passport Canada does not receive annual funds from the federal budget, and the service is supported by the applicant rather than the taxpayer in general. The fee for an adult passport is $87. You may wish to note that the price of a Canadian passport compares favourably with the price of passports of other industrialized countries when taking into consideration the services which are included. Canada has worked closely with its United States counterparts with a view to improving the efficiency and security of our shared border. Phase I of the Western Hemisphere Travel Initiative (WHTI) was implemented on January 23, 2007. It requires all travellers entering the United States by air to be in possession of a valid passport. Campaign From: Kevin Sack - City of Toronto - Director of Strategic Communications The City of Toronto is in receipt of the letter sent to Minister Flaherty by the Clerk of the Niagara Falls Council supporting the call to dedicate one cent of the current GST to Canadian Cities. I am writing to provide some further information regarding the One Cent NOWi campaign. Since the launch of the campaign on February 26, 2007, the onecentnow.ca website has had over 9.000 visits and more than 13,000 page views. In addition, more than 2000 peopie have signed the online petition and hundreds of people have requested materials (buttons, door/window stickers and cards, etc.). The campaign has generated media coverage and public focus on the need for Canada's cities to have revenues that grow with the economy and has highlighted the fact that the property tax is not the appropriate place from which to fund the major infrastructure required to support growth in our municipalities. The Township of Shuniah has recently passed a resolution which effectively encouraged an application against one of its own councillors under the Municipal Conflict of Interest Act and authorized payment of the costs of that application by the Council. The Councillor made an application to have the resolution quashed and the Superior Court of Justice has granted that application. The Court found that the Municipality did not have the authority by virtue of its grant authority (section 107(1) of the Municipal Act) or by virtue of its right to enforce agreements, etc.( Section 444 of the Municipal Act). This judgment has been appealed by the Township to the Court of Appeal as the Township wishes to have its rights in this regard definitively determined. That appeal is expected to be heard March 28, 2007. 2. This Application also requested that the application under the Municipal Conflict of Interest Act be stayed permanently as being "maintenance" oflitigation and thus in breach of the Champerty Act. The Municipal Conflict of Interest application had been begun by the Reeve of the Township in response (apparently) to the Township resolution offering to pay the costs of the application. The Court quoted Mr. Justice O'Connor to describe the concepts of maintenance and champerty. "Maintenance is directed against those who, for an improper motive, often described as wanton or officious intermeddling, become involved in disputes (litigation) of others in which the maintainer has no interest whatsoever and where the assistance he or she renders to one or the other parties is without justification or excuse." "Champerty is an egregious form of maintenance in which there is the added element that the maintainer shares in the profits ofthe litigation. Importantly, without maintenance there can be no champerty.,," The court did not need to decide if the Township's actions were a form of maintenance as the resolution was struck down on other grounds. If, however, the Court of Appeal should decide that the Township had the authority to pass the resolution under its "grant" authority or its "enforcement of citizen's rights" authority, then the Court of Appeal will likely also decide if such involvement of a municipality was "maintenance" under the Champerty Act. 3. The Reeve's personal actions to commence the application against the councillor did not offend the Champerty Act as the Reeve was a qualified elector and entitled to bring the action and as there was no evidence of bad faith on her part. . 4. The Application also requested that the municipal solicitors be removed as the solicitors for the Reeve in the application under the Municipal Conflict of Interest Act by reason of the solicitor's breach oftheir duty ofloyalty to the councillor by reason of his membership in the Shuniah council. The solicitors are in private practice and were retained by the council as general council for the Township. The solicitors replied that they acted for the quorum of council of the Township and not the individual members of council. The court found that there was a duty beyond the duty not to disclose confidential information and this was "a duty of loyalty". "Loyalty includes the obligation to avoid conflicting interests; commitment to the client's cause; and the necessity to be candid with the client on matters relevant to the retainer." Quoting from the Supreme Court of Canada "the lawyer may not represent one client whose interests are directly adverse to the immediate interests of another current client - even ifthe two mandates are unrelated - unless both clients consent ..." The court accepted as true, in a technical sense, the position that the client of the firm was the "quorum of councillors, not any individual". However, the court found that this position places the firm in an adversarial relationship with one out of five councillors who make up the quorum. That councillor, through the Township's chief administrative officer, had sought (and presumably received) legal advice from Council's solicitors in counection with the allegations of conflict. Subsequently, the solicitors were retained by the Reeve to act against the councillor. While he had not retained them personally, he had done so "as a member of Shuniah Township Council, and was entitled to expect that the Township solicitors would not act against him on Township business." Also, "by accepting her (the Reeve's) retainer to act against a fellow councillor, the solicitor's have preferred the interests of one member of the client group over the interests of another... The lawyer's duty ofloyalty to the client extends to members of the client group..." 5. In a separate application, this one within the Municipal Conflict of Interest proceedings, the councillor sought a permanent stay of the conflict proceedings on the grounds of delay and of prejudice due to the imminent municipal elections. The court found no conduct of the applicant which justified a permanent stay which is tantamount to dismissal, and refused that order. 6. In this second matter, the court was also asked by the Reeve to make an order to make the details of the proceedings confidential ("sealing" the pleadings) to protect against the issues becoming part of the election proceedings (which the councillor appears to have supported). The court refused, finding no justification for such an order. 7. The Reeve did ask for a temporary stay to allow the Court of Appeal to deal with its issues. The court granted this application noting that as the Conflict of Interest application could not be heard prior to the election, "the less people are drawn to these proceedings during the election the better". The general facts of both of these cases are set out below. The Township was in the process of hiring a full time fire chief and the current part time fire chief was a candidate for that position. In addition, the current part time fire chief had certain business dealings with the Township related to the purchase of capital equipment. The Chief Executive Officer ofthe Township, while reviewing materials related to the appointment noted that one of the Councillors of the Township was noted in documentation as part of the "team of professionals" working for the fire chiefs corporation. Further inquiry resulted in reports to council and ultimately to a resolution of council "to seek volunteers from council to make an application to the court pursuant to the Municipal Conflict of Interest Act" and "authorize the Township to cover the costs of such an application". The Township had a general ethics bylaw which mandated the CEO to pursue investigations of breach of ethical standards by the councillors and authorized council to take disciplinary action in the form of "other action the council deems appropriate".
