In response to a communication received from the Regional Municipality of Niagara, the
following resolution was passed at the Council meeting of March 5, 2007, respecting the above
referenced matter:
THAT: The Municipal Council of the Town of Fort Erie hereby supports the resolution of the Regional
Municipality of Niagara supporting Brock University's request to the Province of Ontario for $4.2
million capital funding for expanded research capacity on the basis that such increased capacity
assists in supporting local efforts at creating local economic self.reliance and overall integrated
community sustainability, and further
THAT: The appropriate persons be so notified of this action.
By copy of this letter to the Regional Municipality of Niagara and Area Municipalities they are
being so advised of this action.

resolution:

Province of Ontario for $42.5 million in capital funding for expanded research
capacity on the basis that such increased capacity assists in supporting local efforts

The Municipal Council of the Town of Fort Erie at its meeting of March 5, 2007, passed the
following resolution in response to a request received from Erie-Lincoln MPP, Tim Hudak, a
copy of which is attached:
WHEREAS the Municipal Council of the Town of Fort Erie at its meeting of August 21, 2006 passed a
resolution urging the Minister of the Attorney General to address the then current court deficiencies and -
lack of sufficient Justices of the Peace in the Niagara Region, and further
WHEREAS Attorney General Bryant recently announced the appointment of several new Justices of the
Peace none of which were appointed to the Niagara Region:
NOW THEREFORE be it resolved by the Municipal Council of the Town of Fort Erie that it hereby strongly
urges the Attorney General to address the longstanding and harmful shortage of Justices of the Peace in
the Niagara Region, and
THAT:A copy of this resolution be forwarded to the appropriate persons, including the Area Municipalities.
By copy of this letter to the Regional Municipality of Niagara and Area Municipalities they
are being so advised of this action. "

RE: SHORT AGE OF JUSTICES OF THE PEACE
In response to your communication regarding the above matter, the following resolution
was passed by the Corporation of the Township of Wainfleet at its meeting of
March 13, 2007:
WHEREAS the Region of Niagara is currently facing a longstanding and harmful
shortage of Justices of the Peace;
AND WHEREAS police officers face greater obstacles and lengthy time delays in
obtaining search warrants;
AND WHEREAS front line police officers are taken off the road each time a hearing is
rescheduled;
AND WHEREAS court date cancellations across the province result in charges against
offenders being dismissed altogether;
AND WHEREAS offenders are less likely to pay fines up front;
AND WHEREAS municipalities are forced to increase taxes or cut services because of
reduced revenue from provincial offences such as traffic tickets;
THEREFORE Council for the Township of Wainfleet do hereby call upon the Attorney
General of Ontario to fast track the appointment of additional Justices of the Peace in the
Niagara area courts; and
THAT a copy of Council's resolution be forwarded to the Associate Chief
Justice/Coordinator of Justices of the Peace, Ontario Court of Justice, The Honourable
Justice Donald Ebbs for information;

WHEREAS municipalities across Canada supported the 2003 position of the Federation of
Canadian Municipalities ("FCM") with respect tathe 2003 Federal Budget contribution to rebuild
crumbling municipal infrastructure falling well short of expectations and needs; and .
WHEREAS funding programs should be allocated to provinces and territories on a per capita
basis; and
WHEREAS the 2003 municipal infrastructure deficit was estimated at $57 billion nationally and
the municipal infrastructure deficit has increased to an estimated at $60 billion in 2006; and
WHEREAS current projections by the Association of Municipalities of Ontario ("AMO") indicate
that the deficit across Ontario municipalities will further increase by an estimated $5 billion
annually; and
WHEREAS COMRIF funding is inadequate with applications submitted in the first round totalling
over $1.3 billion, but only $249 million granted to 120 communities leaving 235 municipalities
receiving nothing; and, the second round of applications totalling approximately $1.1 billion, but
only $235.7 million granted to 88 communities leaving 251 communities receiving nothing; and,
the third round of applications totalling approximately $670 million, but only $93 million granted
to 72 communities leaving 226 communities receiving nothing; and
WHEREAS municipalities have not been able to keep up with the capital infrastructure needs
while holding the line on property taxes with'. the result being a massive and growing
infrastructure deficit, limiting the ability to provide safe, clean water; protect the environment,
and provide reliable transit and efficient transportation networks: and
WHEREAS many municipalities continue to express their deep concern with the lack of Federal
and Provincial support for municipal infrastructure maintenance,improvement, and
development; and
WHEREAS municipal infrastructure is the foundation of local, provincial, and national
economies.
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF WELLAND re-
confirms the urgency for Federal and Provincial funding assistance to assist Canadian
municipalities with tackling the crumbling national municipal infrastructure and related deficit of
approximately $60 billion; and further

The following Resolution was adopted by Council of the Corporation of the Township of King at its
meeting of March 19'h, 2007: '
Re: Calling on the Upper Levels of Government to Provide Funding
Assistance for Municipal Infrastructure and To Review Certain Prol!rams
"Municipalities are required to operate and maintain a wide array of services including the provision of safe
clean water and wastewater systems, effective transportation systems with well maintained roads, sustainable
waste management systems, and the cultural and recreation infrastructure that are key elements in a healthy &
competitive municipality;
In rural communities with slower new growth particularly in the commercial and industrial sectors accounting
for a small portion of the total assessment, residential taxpayers carry the weight of the total tax burden;
The Canada Ontario Municipal Rural Infrastructure Fund (COMRIF) provided opportunities for municipalities
to apply for funds to assist with infrastructure; the demand greatly exceeded the availability of funds, resulting
in many municipalities receiving nothing for their efforts and resources spent in applying;
The Province has allocated a permanent 2 cents a litre for municipal transit to municipalities operating public
transit and community transit systems, however, there is no comparable funding in rural municipalities where
roads and bridges are the transit systems and the residents pay the same Gas Tax as those in cities and towns;
Provincial programs such as the "Farmland Tax Program" and the "Managed Forest Tax Incentive Program"
which were designed to meet provincial economic and environmental policy objectives are now funded by the
municipal property tax base - these formerly provincially-funded tax rebate programs were changed in 1997 to
municipally- funded property tax discounts, that is, municipal tax expenditures;
The Development Charges Act which was enacted in 1997 imposed certain restrictions on municipalities which
prevent growth from paying for itself and places the burden of growth on the tax payer;
Municipalities must start reporting infrastructure spending on an accrual basis by 2009, and will incur
significant training, staffing, consultant and software costs; smaller municipalities do not have the resources to
cove these costs;
Municipalities have been assigned the task of ensuring accessibility for all Ontarians through the Ontarians with
Disabilities Act (ODA) and the Accessibility for Ontarians with Disabilities Act (AODA) and are supportive of
the objectives of the legislation, but have concerns given the potential impact of the costs of implementation of
standards which are as yet, unknown;

It is resolved that the Council of the Corporation of the Township of King requests the following:
1. The provincial and federal governments are urged to augment their contributions to municipal
infrastructure by developing a long-term support program for stable, reliable permanent funding to assist
with infrastructure investment.
2. The provincial government is requested to increase the municipal share of provincial gas tax and
expanding eligibility beyond transit.
3. While the Township is acutely aware ofthe importance of a sustainable agriculture industry and of
environment conservation efforts, the provincial government is requested to review programs such as the
"Farmland Tax Program" and the "Managed Forest Tax Incentive Program" to ensure that the programs
are not funded out of the municipal property tax base.
4. The current provincial government committed to ensuring that developers "absorb their fair share of
the costs of new growth", and is requested to begin the review ofthe Development Charges Act, 1997 as
soon as possible to ensure that municipalities do not continue to subsidize development and municipal
property tax payers are not paying for growth.
5. The provincial government is requested to establish one time funding to assist smaller municipalities
move to accounting infrastructure on an accrual basis and meaningful asset management.
6. The provincial government is requested to consider providing financial assistance to offset the costs of
implementing the requirements of the AODA and the related standards.
7. The provincial government is requested to review the basis of apportionment of municipal/regional
funding to ensure that lower tier municipalities are not inequitably requisitioned.
8. This Resolution be forwarded to the Premier of Ontario, the Federal and Provincial Ministers of
Finance, Minister of Public Infrastructure Renewal, and to the MPs and MPPs for the Township of King,
and to all the municipalities in Ontario.
Please present this resolution to your Council for their consideration and endorsement.

This is to advise that Council of the Town of Pelham, at its meeting held on Monday,
February 19, 2007, resolved to enact the following resolution:
"THAT Council of the Town of Pelham endorse and support the resolution
enacted by the City of Thorold at their meeting held January 23, 2007 whereby
they call upon the Government of the Province of Ontario to continue its efforts to
resolve the current problems with the health care system to alleviate the shortage
of physicians and the need to fund physician recruitment programs from the
municipal property tax base;
AND THAT the Province of Ontario reimburse the Town of Pelham for all
physician recruitment expenses incurred by the Town;
AND FURTHER THAT a copy of this resolution be forwarded to the Premier of
Ontario; the Minister of Finance; the Minister of Health & Long-Term Care; local
MPP's; the Association of Municipalities of Ontario; the Regional Municipality of
Niagara and area municipalities."

Re: Community Energy Plan
Please be advised that Thorold City Council, at its March 20, 2007 meeting, adopted the following
resolution:
WHEREAS scientific evidence of humanity's impact on climate change is
indisputable;
AND WHEREAS climate change affects us culturally, socially and economically and
the existence of some cultures and even nations will depend on a global
commitment to significantly reduce our use of fossil fuels;
AND WHEREAS the move to the new reality will only be reached when businesses,
govemments and individuals use vision and courage to take the small and giant
steps necessary to significantly reduce greenhouse gas emissions;
AND WHEREAS the two major contributors to greenhouse gas are transpoltation
and human demand for energy which will continue to rise on a global scale;
AND WHEREAS the development of technology to reduce greenhouse gas
emissions can be an economic engine for the country;
AND WHEREAS the reduction of greenhouse gas emissions can only be achieved
with all levels of govemment developing creative approaches to the demands for
fossil fuels.
NOW THEREFORE BE IT RESOL VED THA T THE CORPORA TION OF THE CITY
OF THOROLD HEREBY ENACTS AS FOLLOWS:
1. THA Tthe City of Thorold develop a comprehensive Community Energy and
Transpoltation Plan for the municipal corporation and citizens of Thorold.

The Council of the Municipality of Powassan, at their regular meeting of March 20, 2007, passed the
following resoiution regarding the Drinking Water Quality Management Standard under the Safe Drinking
Water Act 2002 under the Ministry of the Environment.
WHEREAS in November 2006, the M.O.E. released the final Drinking Water Quality
Management Standard (OWQMS) under the Safe Drinking Water Act 2002; and
WHEREAS under this Act, owners of Municipal drinking water systems will be required to
obtain a Municipal Drinking Water Licence; and
WHEREAS to do so, they will be required to have among other things, an "Accredited
Operating Authority" and an approved "Operational Plan" for each of their systems; and
WHEREAS the implementation of the OWQMS will have costs associated with the ongoing
third-party audits, which may range from $3,000 to $7,000 annually based on system size
and geographic considerations,
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the Municipality of
Powassan calls upon the Honourable Minister of the M.O.E..!!!!l; to approve the
implementation of "third-party audits" considering the clear mandate of an Accredited
Operating Authority including other policies, programs and guidelines already in place or
proposed to insure that health and safety of our water systems remains at the forefront; and
FURTHER that copies of this resolution be circulated to all municipalities across the Province
of Ontario with water systems with the request that they pass similar resolutions of support.
The Municipality of Powassan requests that all letters of support be forwarded directly to the Provincial
and Federal representatives.
