Motion: Carried Action: Recommendation submitted to Council 2007-04-30. REPORTS a) BBS-2007-06 - 5125 Montrose Road Shoppers Drug Mart Sign By-law Variance . Isabella Cerelli from Pride Signs Ltd. addressed Committee and advised that Shoppers Drug Mart would like to offer the following alternatives to no illumination of the north facade sign; I. Timer with illumination from 10:00 a.m. to 9:00 p.m. 2. Dimmer with timer from 10:00 a.m. to 9:00 p.m. reduces the illumination by 60%. It was ORDERED on the motion of Councillor Kerrio and seconded by Mayor Salei that the report be deferred for two week to allow staff time to poll the residents affected by the sign illumination. Motion: Carried Action: Recommendation submitted to Council 2007-04-30. b) MW-2007-33 - Mechanic Street and Keller Street Parking Control Review It was ORDERED on the motion of Mayor Salei and seconded by Alderman Wing that Community Services Committee - 2- April 30, 2007 1 ) That a "no parking, tow away zone" corner restriction be installed on the south side of Mechanic Street from Keller Street to a point 20 metres east of Keller Street. 2) That a "no parking, tow away zone" corner restriction be installed on the south side of Mechanic Street from Macklem Street to a point 20 metres west of Macklem Street. 3) That a "permit parking, tow away zone" restriction be installed on the south side of Mechanic Street between a point 20 metres east of Keller Street and a point 20 metres west of Macklem Street. 4) That a "no parking, tow away zone" restriction be installed on the north side of Mechanic Street between Macklem Street and Keller Street. 5) That a "no parking, tow away zone" corner restriction be installed on the east side of Keller Street from Mechanic Street to a point 20 metres south of Mechanic Street. 6) That a "no parking, tow away zone" corner restriction be installed on the east side of Keller Street from Portage Road to a point 20 metres north of Portage Road. 7) That a "permit parking, tow away zone" restriction be installed on the east side of Keller Street between a point 20 metres south of Mechanic Street and a point 20 metres north of Portage Road. 8) That a "no parking, tow away zone" restriction be installed on the west side of Keller Street between Mechanic Street and Portage Road. 9) That "no parking permit only 8:00 a.m. - 2:00 p.m." restriction be installed on the east side of Keller Street. Motion: Carried Action: Recommendation submitted to Council 2007-04-30. c) MW-2007-44 - Residential Convenience Pass for On-street 2-hour Parking at Parking Meters/Machines. . After Committee discussed the matter thoroughly defeating three previous motion to alter the annual expense to residents of Niagara Falls the following motion was made; It was ORDERED on the motion of Councillor Wing and seconded by Councillor Thomson that the matter be referred back to staff for further information. Motion: Carri ed Action: Recommendation submitted to Council 2007-04-30. Community Services Committee - 3- April 30, 2007 d) MW-2007-38 - Rural Municipal Drain Maintenance Program . Mr. Cliff Ballinger of 5690 Bossert Road submitted a letter to Committee outlining his experience with the process from 2004 to present. Mr. Ballinger's main concern is the unfair assessment under the Drainage Act. The Executive Direct of Community Services advised Committee that either the landowners pay and they can appeal their assessment to the Drainage Tribunal or the City pay for the clearing of the drain at an approximate cost of $500,000.00. The roadside ditches cannot be cleared until they have somewhere to outlet to. It was ORDERED on the motion of Councillor Fisher and seconded by Mayor Salei that, I. City Council reaffirnl the use of The Drainage Act to secure access and resolve drainage issues in the City's rural area, and further that, 2. a public meeting be held with the landowners. Motion: Carried Action: Recommendation submitted to Council 2007-04-30. NEW BUSINESS a) Councillor Thomson advised staff that existing apartment buildings are being converted to condominiums. 4872 Valley Way was renovated and the units sold, a board of directors was to be established and to date has not. The residents are not receiving proper services and a board has not been elected. Councillor Thomson would like the City to send a resolution to the Provincial government asking the Province to look into people who are negligent in transferring the condominium properties over to the Condominium Board in a timely manner. Councillor Thomson would like a report back to Committee to see if the City can assist the residents at 4872 Valley Way. It was ORDERED on the motion of Councillor Thomson and seconded by Councillor Fisher that staff prepare a report on the Condominium Act. BACKGROUND: Staff has recently conducted a parking study on Pin Oak Drive between McLeod Road and Canadian Drive. The concern stemmed from heavy vehicle traffic parking on Pin Oak Drive, and as a result restricts visibility to transit drivers exiting the mall property. in the study area Pin Oak Drive is a collector roadway consisting of two travel lanes, one in each direction. The 650-metre section of Pin Oak Orive serves as a direct access to commercial properties fronting the roadway, including Niagara Square. The roadway is 13.5 metres at its widest section and 10 metres at its narrowest section. Curbs are present on both sides of Pin Oak Drive from McLeod Road to a point just south of the southern mall access, There are no parking restrictions on Pin Oak Drive, Niagara transit utilizes the south driveway on Pin Oak Drive as an egress from the mall. Staff carried out technical studies on Pin Oak Orive to determine whether parking revisions are required on the study roadway. During observations, a heavy vehicle was noted parked on the east side of Pin Oak Drive just south of the southern mall access. The road width adjacent to the developed mall site is sufficient to allow parking on both sides of the road, while permitting unimpeded access for two-way traffic simultaneously, In addition, vehicles parked on both sides of the roadway will not impede maintenance vehicles or emergency vehicles. Through the questionnaire, property owners/managers had an opportunity to comment on the type of parking control that would most benefit their situation. The minimum criterion requires at least 60% of the person petitioned to respond to the questionnaires delivered. A total of six (6) properties were petitioned, of which five (5) questionnaires were returned, representing a 83% response rate. The questionnaire results are as follows: , Maintain the existing parking controls: 2 (33%) , Install "no parking"controls (on both sides): 3 (50%) , Install "no parking"controls from Monday to Friday, 8-4: 0 ( 0%) . Install "no stopping" controls: 0 ( 0%) . Install "no stopping" controls from Monday to Friday, 8-4: 0 ( 0%) . I'Jo response 1 (17%) Niagara Transit staff were also solicited for comments. Their preference was to install a "no parking" restriction on the east side of Pin Oak Drive to prevent trucks from being parked near the southern driveway. Taking this response into account, the majority of respondents are in favour of implementing some kind of parking restriction on Pin Oak Drive. Based on the study results and questionnaire responses from Pin Oak Drive, it is recommended that a "no parking" restriction be implemented on the east side of Pin Oak Drive between a point 310 metres south of McLeod Road and a point 450 metres south of McLeod Road. BACKGROUND: The owners of the new Shoppers Drug Mart store, currently under construction at the south west corner of Montrose Road and Preakness Street, is seeking relief from the requirements of the Sign BY-law to permit oversized wail signs on three sides (north, east and south) of the building, along with an increase in the maximum allowable number cf signs. The By-law permits wall signs equal to 25% of the wall area up to a maximum of 'j 50 sq. ft. and a maximum of six (6) signs. The proposed signs for each wall are 220 sq., ft. and are well below the 25% wai! area. It should be noted that the "draft" Sign By-law has no maximum square foot requirements just the wall area percentage. The owners are aiso proposing a total of nine signs for the building, whereas the By-law permits a maximum of six. The three (3) additional signs will be piaced, one on each of the three walis and are reasonably small, being approximately 39 sq, ft. each. The proposed signage is in keeping with their national advertising program and has little impact on the neighbourhood. Planning Department Comments 1. The request for additional area and number of signs appears to be minor in nature and in keeping with the design of the building. ~ The additional area and number of signs appears to be appropriate for the L. development given the size of the building and the exposure to Montrose Road, However, the use of illumination on the north wall sign is of concern due to the presence of the Townhouses on the opposite side of Preakness Street The signs on this facade should not be illuminated so as to reduce the impacts on the residents. _.,.;: '1~._ . . The request for additional area is in keeping with the provisions ofthe draft Sign By- law. 4. The subject lands are designated Residential in the Official Plan. Neighbourhood Commercial developments are to be designed such that they are compatible with the surrounding residential land uses due to the close proximity of the latter. Because of this, the draft Official Plan policies for signage speak to the need for controls on signs due to potential impacts. As noted above, while the request for additional area and number of signs is reasonable, the illumination of the signs on the north facade may result in negative impacts for the residents living opposite the site on Preakness Street. In summary, the Planning staff has no objections to the request subject to the signs on the north facade of the building not being illuminated.
