Purpose of the Report
The purpose of this report is to inform Council on the Niagara Peninsula Conservation Aathorily's
proposed 2007 Plan Review Fee Schedule and provide a recontinended resolution to the Region of
Niagara.
Analysis
On April 23, 2007 Council directed Planning staff to review the proposed Plan Review Fees set by
the Niagara Peninsula Conservation Authority (NPCA) and provide continent.
The NPCA and Region of Niagara have an existing Memorandum of Agreement in which the NPCA
provides comments and advice on planning applications relating to environmental issues. Included
in the Memorandum is a fee schedule for the NPCA's review of specific applications. Any change
to the fee schedule requires approval from the Region of Niagara. The Region of Niagara has
circulated the proposed fee schedule to all area municipalities for review and continent.
In October 2006 the NPCA proposed a new fee schedule for 2007 in line with the City of Hamilton's
that would represent a 75% cost recovery. Ofnote, the fee schedule for Hamilton was agreed upon
in consultation with area home builders associations and the development community.
This proposed fee schedule attached as Appendix A, appeared to be in line with previous fee
amendments supported by Regional Planning staffand approved byRegional Council. Subsequently,
in January 2007 the NPCA Board of Directors approved a new proposed fee schedule representing
a 100% cost recovery which is attached hereto as Appendix B. Of interest, is the 2004 NPCA Fee
Schedule attached as Appendix C.
Planting staff is generally in support of fees representing a ] 00% cost recovery. The development
community should be subsidizing their own development and application processing fees. Not
recovering full costs associated with staff time and processing results in the absorption and offset
to be paid by the overall tax paying base.
However, one concern is that no data orinfonnatiou has been provided supporting why fees are set
to what they are. Fees for providing only comments on a planting application should represent true
staff time. Setting appropriate fees is a difficult task as some applications are more complex than
others and require more time spent on review. Agencies should be attempting to set fees based on
an overall average ofprocessing time and costs. Certain application fees maynot be fitllyrecovered
and other applicants may be paying more. At the end, an average and balance needs to be targeted,
set and ideally met.

Another concern is that the proposed 2007 fee schedule is set based on City of Hamilton fees.
Overall, the City of Hamilton fees are significanlly higher for each planning application processed.
For comparison, the City of Hamilton charges $7,275 for a Regiatal Plan Amendment whereas the
Region of Niagara charges $3500. Fees set by larger municipalities around the Greater Golden
Horseshoe are higher reflecting higher hourly rates ofpay per employee and the overall devclopnteot
market.
As directed by Council during budget deliberations, Planning staff is currently preparing for a new
planning fee schedule. Fees proposed by the NPCA are currently higher across the hoard based on
Council's approved 2006 planning fee schedule. Time spent to comment on an application by the
NPCA staff should not be higher than the overall processing and approval time spent by City staff
from start to finish. Forexample, the City currently charges $1100 for a Zoning ]3y-law Amendment
and the NPCA is proposing a $2200 fee.

As indicated, Planning staff are generally in support of charging 100% cost recovery of plamting
applicatiot fees. The development conununity should be subsidizing their own development
applications. The intent is that fair application fees are established so that the general taxpayer does
uo[ subsidize developers or private interests seeking planning approvals.
As discussed in the analyzation above, no background data and infonnalion supporting theproposed
Pee schedule has been presented by the NPCA. Without supporting information representing au
attempt to recover 100% ofcosts, Planning staff cannot support the NPCA's proposed Plan Review
Pee.

Peninsula Conservation Authority Fees, be received; and

PURPOSE OF THE R__EPORT
This Report has been prepared to provide background information to Township Council and the
general public regarding the increase in fees for services provided by the Niagara Peninsula
Conservation Authority.
BACKGROUND
In March 2004, Planning staff provided a letter fo the NPCA regarding the proposed fee increases.
As part of this letter, staff indicated they were not supportive of the Conservation Authority moving
#owards 100%. cost recovery and felt that 50% would be more appropriate.
In March of this year a report was released by the Niagara Regional Planning and Development
Department outlining the new fee schedule proposed bythe NPCA. The Region recommended that
the fee schedule be circulated to area municipalities for input. Staff have reviewed the report and
the proposed fee schedule and offer the following
There is little information provided to determine how the new fees were calculated. The fee
structure should be based on the tracking of actual costs incurred by NPCA staff on previous
applications. Staff note that this Township is also working towards a cost recovery scheme to
minimize the cost to the taxpayers. Township staff spent time documenting the time and costs
associated with each application priorto making a recommendation to increase fees. Planning staff
have also committed to reviewing the new fees in West Lincoln after a certain amount of time has
passed to ensure that the fees are appropriate for the work required.
Therefore, in order for staff fo recommend support of the new fee structure, documentation should

be provided to outline how the new fees were calculated. Provided fees reflect actual costs incurred
by NPCA, and provided the Authority is committed to an ongoing review and monitoring of these
fees, then this Department has no objection to the new fee structure as proposed.

t'URPOSE OF THE REPORT
The purpose of this report is to provide information and a staff position to the Committee on the
proposed Regional farm severance policy. Staff note that the Regional letter was included in the April
12, 2007 package with direction for staff to prepare this report.
PLANNING CONSIDE__RATIONS
The Region's Policy Plan currently contains the severance policy as follows:
6.A.9 (e) The consent to convey is for a farm parcel provided that the
resulting parcels are both for agricultural use and the size of
the resulting farm parcels:
(i) is appropriate for the farming activities proposed,
(ii) is suited to the particular location and common in the area, and
(iii) provides some flexibility for changes in the agricultural operation.
The foregoing includes small lot severances for greenhouses and
other intensive forms of agriculture subject to the condition that any
new dwellings on the property are allowed only after the
greenhouse and other farm buildings have been constructed or
substantially completed. It is important that small lot severances for
intensive agricultural uses such as greenhouse operations be of a
sufficient size so that these uses have ample room for future
expansion.

The Region is proposing the following change:

Smaller lot severances for greenhouses can be permitted subject to tf~e
condition that any new dwellings on the property are allowed only after the
greenhouse and other farm build'[ngs have been constructed or substantially
completed. It is important That small lot severances for greenhouse
operations be of a sufficlent size so that these uses have ample room for
future expansion.
The current Regional consent policy for lot creation in Good General Agricultural Areas (Section 6.A.9
(e)) is generally in keeping with Provincial Policy (Section 2.3.4 of PPS). The draft new policy for
Good General Agricultural Areas proposes to impose a restrictive consent approach for agricultural
parcels which is of a higher standard than required by Provincial Policy. This will effectively mean
that the possibility of riew farm parcel consents in the Township of West Lincoln is eliminated. The
Intent of Provincial Policy is to ensure that consents in the rural areas are for legitimate agricultural
purposes. If the Region intends to eliminate consents, then the exception for greenhouses should
also be removed.
This Department is of the opinion that the wording of -the current Regional Policy is generally
consistent with Provincial Policy and should be maintained. Perhaps some minor wordsmithing of the
policy would be appropriate. If a minimum lot size is required, then such a minimum parcel size
should be incorporated within local official plan documents to properly reflect-the type of agriculture
found in each local municipality.
As a result, there are two optional positions that Council could take. These options are:
a) Support the wording of the current Regional Policy Plan (Section 6.A.9.(e)), or
b) Support only the wording of the first paragraph of the proposed new wording.
This Department recommends that the best policy to reflect the agricultural interests of West Lincoln
is option (a) above

WHEREAS over the last five years Canada has suffered aquarter-million manufacturing job
losses across a diverse range of sectors including auto, auto parts, food and beverage, fish
processing, shipbuilding, electronics, electrical, rubber, plastics, steel, wood, paper, metal and
genera! manufacturing, and
- These job fosses are the result of permanent and indefinite layoffs, bankruptcies and plant.
closures, workplace downsizing, work relocation and production off-shoring to countries both
within North America (the United States and Mexico) and internationally,
- The loss of manufacturing jobs has devastated workers, families and communities from coast to
coast and restricts the amount of quality job prospects for future generations,
-The loss of manufacturing jobs has placed an added financial strain on municipal governments
to deliver social services at the local level as a result of increasing demand coupled with an
overall shrinking tax base; and
WHEREAS the lack of Federal and Provincial Govemmenfs' attention to the critical issues of
unbalanced and unfair trade, the persistently high Canadian dollar, the deindustrialization of
Canada's economy and its associated impacts, targeted investment strategies, public
procurement policies and adequate protection for workers, has resulted in a manufacturing sector
in a state of crisis;
THEREFORE, BE lT RESOLVED That the Council of the Town of Pelham, on behalf of the
residents in the Town of Pelham and Regional Municipality of Niagara, capon the Federal and

On April 24~h, 2007, the Township of Smith-Ennismore-Lakefield became the 22nd
Municipality in Ontario and 127" in Canada to adopt a By-law restricting
Cosmetic Use of Pesticides for non-agricultural lands.
By-law 2007 - 037 will come into force March 1, 2008 to allow time for retailers,
commercial applicators, and golf courses to adjust their businesses and for
homeowners to educate themselves concerning the By-law and non-pesticide
techniques for their properties.
Although many municipalities across Canada have now passed By-laws and
many more are considering By-laws, Quebec is the first province to have taken
the lead on this issue by controlling, phasing-in and then banning a whole list of

smoking By-laws, which also dealt with a health issue, municipalities led the way
with local By-laws but the situation became more uniform, fair and easier to
enforce for all residents and businesses when the Province took up the cause
and passed legislation.

At a recent Council meeting of the Cfty of Kawartha Lakes, the following resolution was adopted:
THAT fhe Provincial Government be requested to formulate aprovince-wide integrated goose
management plan of action and any necessary funding to address fhe growing concern fhat
munic/pelhhes w/th public waterfionf green spaces and beaches have wifh respect fo Canada Geese
using such spaces and thereby impacting on fhe wafer quality and recreations! use of these public
spaces;
THAT a copy of this resolution be forwarded to AMO arrd other munfc/palities-in Ontario to seek
support; and
THAT a copy of fhts resolution be also forwarded !o Nature! Resources Canada, Wildl7fe Canada, the
Canadian Food inspection Agency, the Minfsfry of Environment, the Ministry of Hea/fH and Long-
Term Care, the Ministry of Community and Social Services, the M/nlstry of Municipal Affairs and
Housing and the Natiburton Kawartha Pineddge Health Unll; as weU as MP Barry Devolln and MPP
Laurie ScoN.
We would ask that all munidpali8es be Informed and that the Provincial Mfnistrles formulate the requested plan.
