I also appreciate the time that you and members of the community took to meet with me on two occasions since, to discuss the importance of Casino Niagara to the community. Please be assured that the government is aware of the importance of two casinos in Niagara Falls and is committed to the success of both casinos. As we discussed in our recent meetings, I have requested that OLG give significant consideration to the broader economic development opportunities that may exist under along-term two casino strategy in the Niagara Region. For the City of Niagara Falls, we've rounded up the 2006 census number from 82,184 to 83,000. We expect to have all the sign modifications completed by mid-September. PATRICK HENNESSY SECRETARY ONTARIO MUNICIPAL BOARD RULES ON ADJOURNMENT Comments on Adjournments of Proceedings (Rules 61 to 65 below): The Board will not often grant adjournments (later dates) for hearings or other proceedings. Parties and the Board spend time and money in giving notice, preparing and travelling for hearing events, and this is wasted if they are cancelled at the last minute. If the request is presented at the last moment, the Board may refuse the adjournment and proceed with the hearing. If, on the other hand, settlement discussions are reasonably nearing completion, the Board may agree to a delay. The main consideration is whether an adjournment is necessary to permit a fair hearing, versus the cost of any delay for all parties. Hiring a lawyer or planner shortly before a hearing, for example, is not a reason for an adjournment. Parties should prepare for a hearing shortly after the appeal is submitted. They should not wait until notice of hearing is sent. Performance standards required for tribunals mean that the Board is setting hearing dates earlier than in the past. If a matter is adjourned, the Board will pick a new date for it to proceed unless there is a good reason to leave it undecided (e.g. it is dependent upon a decision of a court). 61. Hearing Dates Fixed Hearing events will take place on the date set unless the Board agrees to an adjournment (later date). 62. Requests for Adiournment if All Parties Consent and if all of the parties agree, they may make a written request to postpone a hearing event. The request must include the reasons, a suggested new date and the signed consents of all parties. However, the Board may require that the parties attend in person to argue for an adjournment, even if all of the parties consent. 63. Requests for Adiournment Without Consent If a party consulted objects to an adjournment request, the party requesting the adjournment must bring a motion under Rule 34 at least 10 days before the date set for the hearing event. Adoption of Minutes Minutes of May 24, 2007 IT WAS MOVED BY George Vallo, seconded by Daniel Rodrique, that the minutes of the meeting of May 24, 2007 be approved. Motion Carried 2. Business Arising • Meet & Greet -verbal update from Staff Staff informed the Committee that there are several nights/weekends available in the fall to host this event. Staff suggested that the Committee use this opportunity as a way to do a needs assessment with the arts community to determine what their issues are. In addition, they should consider having someone from the Ministry of Culture and representatives from other granting agencies to inform the groups of the various funding opportunities that are available. IT WAS MOVED BY Daniel Rodrique, seconded by John Harkness that the Arts and Culture Committee holds a networking night at the MacBain Community Centre, date depending on facility availability, with a budget not exceeding $500. Motion Carried • Member Resignations -verbal update from Staff A review of the Committee structures was done by the Clerk in 2004 and it was determined that Committees of Council would have a minimum of 8 and a maximum of 12 members. Recruitment of new members to replace those who have resigned is not yet necessary, as the number of members on the Arts and Culture Committee has yet to fall below the minimum. The Committee felt that they -2- require a full member compliment and would like to meet with the Clerk to review their options for replacing members. Action: Staff will arrange for the Clerk to meet with the Committee. • Community Arts Ontario Conference -verbal update from Staff Staff informed the Committee that the meeting with Community Arts Ontario has yet to take place since the Executive Director has been ill. It is anticipated that the meeting will take place sometime during the summer and Staff will report back to the Committee at the September meeting. 3. Sub-Committee Reports a) Planning - No Planning report was submitted since there were not enough members present to meet quorum. b) Program & Public Relations -see spreadsheet • ArtFest - IT WAS MOVED BY George Vallo, seconded by Daniel Rodrique, that Artfest be held at Niagara Square on November 3, 2007, in conjunction with the Wall of Fame ceremony and that Karen Akalu will coordinate this event. Motion Carried IT WAS MOVED BY John Harkness, seconded by Cheryl Wyllie that ArtFest and the Wall of Fame ceremony each have a budget not to exceed $1,500. AND FURTHER THAT itemized budgets detailing how the money will be spent be presented to the Arts and Culture Committee at the next meeting. Motion Carried IT WAS MOVED BY Cheryl Wyllie, seconded by George Vallo that a letter be sent to Council on behalf of the Arts and Culture Committee requesting that the Council declare the week of October 28-November 3, 07 as Arts & Culture week, to recognize and promote arts and culture in the City, in particular highlighting the Wall of Fame and ArtFest events being held on November 3, 2007. Motion Carried Action: Staff will send the letter to Council. • Community Mailing - The Committee would like to issue a combined conununity mailing, informing the arts community of -3- the upcoming events and opportunities. This mailing should be put out as soon as possible. In addition, the upcoming events, such as the Wall of Fame and ArtFest, should be advertised in the Leisure Guide. Action: Staff to compile the mailing and work with Carol Colishaw on the submission for the Leisure Guide ArtScene. c) Awards -see spreadsheet Philomena McCracken would like to recommend Karen Akalu for the T. Roy Adams Humanitarian of the Year Award. While the Committee supports the recommendation, itwas suggested that a nomination coming from the Committee for which Karen is chair could be seen as a conflict of interest. Instead, the Committee would support a personal nomination from Philomena. IT WAS MOVED BY Philomena McCracken, seconded by Daniel Rodrique that the Arts and Culture Committee supports the nomination of Karen Akalu for the T. Roy Adams Humanitarian Award. Motion Carried d) Finance Staff reminded the Committee that all expenditures must bepre-approved by the Committee prior to any purchases being made. The importance of having itemized budgets was stressed as it ensures that the Committee remains financially accountable. Staff reiterated that the Committee business must be done in an open and transparent way. New Business Water Molecule - Staff updated the Committee on the status of the Water Molecule and requested their support in seeing the artwork returned to the City. IT WAS MOVED BY George Vallo, seconded by John Harkness that the Arts and Culture Committee supports the return of that Water Molecule to the City of Niagara Falls and that it be permanently installed at the new arena. Motion Carried • Volunteer Recognition - Staffinformedthe Committee that the responsibilities oforganizing the Volunteer Recognition Evening has been delegated to Jason MacLean and Roz Llewellyn. Members from both the Arts and Culture and the Recreation Committees are being requested to sit on asub-committee to assist in organizing the event. Motion Carried -4- • Website Request -Gallery Players of Niagara Staff received a request from the Gallery Players of Niagara to have their information listed on www.artscenenigara.com. Theyare aperforming arts group based out of St. Catharines. The Committee is currently without a promotion policy. IT WAS MOVED BY Brain Smylski, seconded by Daniel Rodrique that a criteria be developed to outline how the Arts and Culture Committee can assist in promoting arts organizations, both within and outside of the City of Niagara Falls. Motion Carried • Quilt at MacBain Community Centre Brian Smylski reported that the quilt hanging in the stairwell at the Community Centre is showing some initial signs of damage. Given the height at which it is hung, it is evident that patrons of the facility have been touching the artwork, causing the edges of the piece to curl. Action: Staff will investigate options to preserve the quilt. • National Historic Designation Information Karen presented information from the Historic Sites and Monuments Board of Canada and inquired whether the Committee could nominate someone under the Historic Persons category. Staff indicated that the criteria was extremely specific and that there are no applicable categories that meet this Committee's purpose. Our previous lighting system was no longer adequate, as it created shadows and detracted from members' enjoyment of the game.
