WHEREAS the Warren Woods Draft Plan of Subdivision 267-96001 (Revised) and 267-11-
2006-02 (Revised) was approved by Council on October 15, 2007; and
WHEREAS the requirements of the Planning Act to hold one statutory public meeting and
associated notice provisions have been satisfied; and
WHEREAS an objector (Cytec Canada) has filed an Ontario Municipal Board appeal because of
concerns over one of the conditions (Condition #10) of draft plan approval; and
WHEREAS Section 51(44) of the Planning Act provides Council with the authority to change
conditions of a draft plan approval; and
WHEREAS the applicant's solicitor and the objector's solicitor have been working on a resolution
to the matter; and
WHEREAS the deletion of Condition # 10 and the inclusion of the additional condition outlined in
report PD-2007-103 can be supported by staff; and
WHEREAS the changes outlined in PD-2007-103 will resolve an appeal to the Ontario Municipal
Board; and
WHEREAS the changes outlined in PD-2007-103 are minor in nature and do not significantly
change Council's approval of October 15, 2007.
THEREFORE BE IT RESOLVED that the Council ofthe Corporation of the City ofNiagara Falls
hereby determines, in accordance with Section 51(47) of the Planning Act, R.S.O. 1990, that the
change to the conditions for approval for the Warren Woods Draft Plan of Subdivision do not require
any further notice.
