This morning in eMmail you noted the V1Jater & Sewer Rate Structure Review and resulting public meetings had been advertised in the Niagara Falls Review. once again, we are disappointed the. City of Niagara Falis has undertaken only the minimum required notification. The first public engagement on the Water and Sewer Rate review took place in January. Attached you will find a copy of an advertisement that ran on a couple of occasions in the Niagara Falls Review (see attached). Afternoon and evening public forums took place. Other than the general public, we had representation from the Horticultural Society, an ad hoc group of landlords, the Fallsview BIA and Mr. Hofer, from Marineland. It is disappointing that more of the business community did not take an interest in this. The consultant hired made his presentation at the Council's Corporate Services meeting of April 14th. Attached you will find the report from staff. You should note from the report that staff recommended the following: ...public input is necessary in order to appreciate what the range of impacts may be for various sectors in the community. Staff is requesting that Committee recommend to Council the formation of a Public Consultation Committee, made up of staff and public representatives. Members of the public should be selected to provide representation from residential, institutional, commercial and industrial interests. At the meeting on April 14th, Council discounted staff s recommendations for a public consultation committee. They asked that the consultant come back with definitive recommendations (see attached minutes). They did not defer the matter to ask for input from the business community. In fact, at the committee meeting, staff stated that there should be consultation with the business community. Although some Councillors voiced concern, the general comment from Council was that an advertisement in the paper was sufficient. The meeting from April 14th did not go unnoticed, Attached please find the article from the Review, two days later. From the article: The downside of decreasing the burden on homeowners is that it would be shifted to commercial customers. If consumption rates rise everyone pays more for the water they use but it would hit large volume users more. Despite the newspaper article, staff did not hear from any of the business community expressing concerns. No motion was made to engage the business community. It has been staff that have felt that the business community needs to inform themselves of the possible ramifications of changes to the system. Hence, our efforts to notify the BIA's and the Chamber. I fully appreciate that there is a lot of information to absorb in one week. Nonetheless, as you have done in the past, the Chamber could request at tonight's meeting that it be provided more time to review the information. You are correct that the a-mail I sent was only a week ago. Staff was waiting to get all of the pertinent information consolidated on one page on our web site. Regardless, our Council and Committee agendas are file://C:~Documents and Settings\di202~I.oca1 Settings\TemplXPgrpwise\481EE342Domain... 5/5/2008 Page 2 of 4 fully accessible on our web site usually by the Wednesday before the meeting; therefore, the full water and sewer rate review has been available since mid-April. Attached please find some simple instructions on how to access our agendas. Also, until a week ago, staff was not even sure that today's proposed meeting was necessarily going to happen. On most issues of civic importance, staff tries to provide information or notice to the general public, even when we are not statutorily required to do so. It is a two-way street, however, and there is some responsibility on the part of the electorate to keep themselves informed. I would hope that an organization like the Chamber of Commerce would be pro-active, monitoring the media and the Council agendas on items that directly affect their membership, Perhaps the Chamber should reconsider having a member of Council on their board to, minimally, provide a communication link. In conclusion, I appreciate the complexity of this issue necessitates more study but I think it is apparent that staff has attempted to alert the business community. You are encouraged to attend this evening's meeting to voice your concerns. On a couple of unrelated items, I have been meaning to respond to you on the letter sent regarding the Expression of Interest on the Police Headquarters. Council considered your request to limit our submission to public property only. Council felt that having the Central Police Headquarters located in Niagara Falls is paramount, regardless if located on public or private lands. Also, City staff's role is to facilitate the development of all business in Niagara Falls. As a result, it passed the following motions: That Council approve the submission of the City owned lands, known as the Montrose Business Park and the North Side of Mewburn Road, for the Expression of Interest for a site suitable for the development of a new Niagara Regional Police Service (NRPS) Central Headquarters; and That the Niagara Falls submission also recognizes private property locations, whose owners have expressed interest in being part of the City's Expression of Interest. I will keep you posted on any feedback we receive. Finally, the Chamber has expressed an interest in the People Mover issue. Staff is anticipating bringing a report forward in our Community Services Committee on Monday, May 12th. I will a-mail you the specific time and report by Wednesday or Thursday. In 2001, the City of Niagara Falls began to implement use-based billing structure (water meters). A water and sewer billing was implemented that comprised of fixed and volumetric charges. Each charge is designed to collect sufficient revenues to offset the relevant direct costs. The fixed monthly charge is not related to the direct costs of consumption. The fixed charges are intended to offset the fixed costs of maintaining the water and sanitary sewer systems. The City has the responsibility to provide safe potable water in sufficient supply for all users including fire suppression. The City is responsible for providing the collection of sanitary sewage. The direct operating costs of labour and materials, and the direct construction costs of repairs and maintenance are incurred regardless of the users' consumption. The fixed monthly charges are not dependent upon or related to the amount of consumption incurred. The review took place immediately as outlined in the repor# of April 2, 2008, a copy which has already been dis#ributed to Council. Staff worked with Michael Loudon and with 111Ir. Ed Bieiawski, who provided several documents of information for Mr. London's review. The report does not give a recommendation for a particular rate structure but identifies several principles that could be the criteria for considering a different rate structure. The Principles are as follows: • Revenue Adequacy & Revenue Security • Legality • Practicality • Fairness & User Pay • Affordability Simplicity . • Conservation & Water Use Efficiency • Encourage Development Mr. Loudon has suggested t at~fihe`~Principle ofi Fairness and Equity is the most important principle related to the~w,~te~ and sewer rates, as identified at the public consultation sessions. To explain the impact of changing the rate structure, Mr. Loudon chose a sample rate structure for comparison. The repork shows the impact cif changing the current method. Staff cautions that although this is a good example of a change and what the impact would be, it should not be considered to be the specific recommendation of the consultant. Mr. London's review includes a variety of rate structure alternatives. The review covers the basic components and several volumetric rate formats. Other issues discussed include Volume CJniy Rates, Revenue Security, and Metering of Condominium/Townhouse Developments. Further study can be performed by City staff, however, public input is necessary in order to appreciate what the range of impacts may be far various sectors in the community. Staff is requesting that Committee recommend to Gauncil the formation of a Public Consultation Committee, made up of staffand public representatives. Members of the public should be selected to provide representation from residential, institutional, commercial and industrial Interests. The Public Consultation Committeewauld be directed to prepare recommendations on the appropriate rate structure and its compliance with the adopted principles approved by Council. CONCLUSION: In summary, Staff suggests that the Vllater and Sewer Rate Structure Report from R.M.Loudon Ltd, be received for information, that the report's Principles be adopted by Council and a Public Consultation Committee, made up of representatives from a variety of sectors In the Community, be formed to make recommendations on a rate structure to Council. While I am not able to attend due to work I would like to express my opinion. think that it was a big mistake installing water meters. When there was a fiat rate the public understood that they would be a slight increase every year but at least you were not limited as to how much water you could use. Now that there are meters everyone is asked to conserve which we are doing which causes the problem of less revenue for the City so the water rates have increased considerably to make up the shortfall. We are now being penalized for conserving by having the rates increased every year not a little but a lot. I don't understand why the sewage portion of the cost has to be double the cost of the water we use. In my household there are two adults who try to use as little water as possible but yet I am paying the same as when there were four including two teenagers because the rate has gone up so much. I should be paying less now not more. We should not have to be penalized with higher rates because we are conserving as we have been asked to do. If you were to take a door to door poll and asked the residents if they would prefer a flat rate or metered you would find that the flat rate would win hands down. Having said that it is my strong belief that the sewer rate is extremely unfair for summer users... with the cost of food going up more and more families are going to start a small garden for help ease this pain... that portion of water doesn`t hit the sewer. Also those of us that don't use fertilizer need to water their grass so it doesn't die as dead grass effects the beauty of the house and affects the sale of a home if the home needs to be re-soded, not to mention the beauty of our famous city, this water also doesn't make its way down the sewer. Here is my recommendation that can easily be achieved if the city has the will. I recommend that the sewer rate remain the same and untouched from Sept 1 until May 31. From June 1st until Aug 31 the sewer rate be averaged based on the the individual homeowner's sewer rate charged from Sept 1 until May 31. This will truly reflect the true usage of the sewers. Not implementing a change that will provide relief for the summer months isn't fair at all to the homeowner. We are all encouraged to plant trees because it is the green thing to do yet have to pay large for a sewer usage that we don't use. If hydro can give people a break in the winter months so they can afford to stay warm, then T can't see why the city can`t do the same in the summer for sew rate charges. I hope that this makes sense to all of you. ******~x I would also like to comment on how the homeowner subsidizes local businesses. I think they should take more of that burden as it doesn't seem to me to do anything to keep business here anyways. Business have a "what ,~ have you done for me lately attitude and seem to forget what the city has allowed in the past as favors not to mention all the royalties given to them by other levels of governments. The breaks we give businesses like Chef Boy R Dee and grants for new equipment from the provincial government did nothing to keep the shop open. It just seemed to delay the inevitability of them closing. There is no guarantee that after receiving help on the backs of the tax payer that they will remain in Niagara Falls in the future. Ever hear the saying "you can't buy someone's love", this is true here. These companies are leaving regardless of the perks which means that they are leaving for other reasons that were not disclosed initially, leaving tax payers and the city wondering what happened to our investment (perks) that the company received. They don't don't even call and the city ends up chasing them for answers to figure out what else to give them to get them to stay open. Some people blame the Mayor but that is plain ignorance as it has not the Mayor's fault. The problem is that when the city gives perks it does so on the "premise of good faith" and no guarantees. It's all one sided... The city needs to reinvent itself and move away from tourism, "by not putting all the eggs in one basket". This to me is the key to keeping companies in Niagara Falls. I hope that this makes sense to all of you.
