2001 resolutionsThe City of Niagara Falls, Ontario Council Chambers No. 02 Moved by Alderman PIETRANGELO Seconded by Alderman FEREN January 15, 2001 WHEREAS the Regional Municipality of Niagara has established a Steering Committee to oversee the development and implementation of a comprehensive transportation strategy for the Niagara Region; AND WHEREAS the Steering Committee is mandated to investigate various transportation modes and systems including: auto, truck, transit, rail, air, marine, pedestrian and bicycle; AND WHEREAS most of the media attention surrounding the transportation strategy and discussion during the public forums has have focused exclusively on the issue of vehicular traffic; AND WHEREAS there is a significant opportunity to capitalize on the Region's existing air links especially with the presence of the Niagara District Airport located in Niagara-on-the-Lake; AND WHEREAS the Niagara District Airport has potential to expand its facilities; -2- WHEREAS the Niagara District Airport would not compete with commercial air traffic so close to Toronto, Hamilton and Buffalo, it could be better utilized by bringing in more tourist charter services to the Niagara Region and expanding its current cargo services; AND WHEREAS an increase in traffic at the Niagara District Airport would create economic benefits throughout the entire Niagara Region; WHEREAS any expansion of the Niagara District Airport Services would require the financial support of the private and public sectors; THEREFORE BE IT RESOLVED that the Regional Municipality of Niagara conduct a study to look at better utilizing air links available in the Region and the feasibility of increased services at the Niagara District Airport; AND the Seal of the Corporation be hereto affmed. Carried Unanimously CITY CLERK WAYNE THOMSON MAYOR The City of Niagara Falls, Ontario Council Chambers No. 03 Moved by Alderman PIETRANGELO January 15, 2001 Seconded by Alderman IOANNONI WHEREAS the Council of the Corporation of the City of Niagara Falls (the "Municipality") has received and considered the Government of Ontario SuperBuild Corporation Sports, Culture and Tourism Partnership ("SCTP") initiative Round 1 Application Guidebook (the "Guidebook"); AND WItEREAS Council has assessed its capital priorities against the SCTP initiative Round 1 application requirements as set out in the Guidebook and intends to submit a letter of intent for qualifying the "Community Centre" project (the "Project") for funding under Round 1 of the SCTP initiative; AND WHEREAS Council confim~s that the Municipality is compliant or in the process of gaining compliance with the new Ministry of Environment Drinking Water Protection Regulation, Ontario Regulation 459/00 made August 9, 2000 ("DWPR"); AND WHEREAS Council considers the Project to be its highest sport, recreational, cultural or tourism infrastructure priority for the Municipality; AND -2- WltEREAS Council confirms that the Municipality does not have any outstanding public health and safety issues or projects affecting its existing sport, recreational, cultural and tourism facilities; AND WHEREAS Council has made this resolution on the understanding that the recitals set out herein will be relied upon by the Ontario SuperBuild Corporation in considering the Project application for funding under Round 1 of the SCTP initiative; NOW THEREFORE the Council of the Corporation of the City of Niagara Falls hereby resolves that the Clerk is directed to submit a letter of intent to the Ontario SuperBuild Corporation respecting the qualification of the Project for funding under Round 1 of the SCTP initiative. Carried Unanimously CITY CLERK WAYNE THOMSON MAYOR The City of Niagara Falls, Ontario Council Chambers No. 04 Moved by Alderman PUTTICK Seconded by Alderman FEREN January 22, 2001 WHEREAS by enactment of By-law No. 2000-217, Council provided for a committee to conduct hearings in respect of two applications for body-rub parlour owner's licences being Henry DiCienzo, 8700 Lundy's Lane and Carolyn Fraser, 5834 Buchanan Avenue; AND WHEREAS the committee has now submitted its report to Council regarding Carolyn Fraser, 5834 Buchanan Avenue. BE IT THEREFORE RESOLVED THAT the report of the committee is received and the recommendations contained in the report are hereby adopted; AND FURTHER THAT the applicant is disentitled to proceed further with her application for a body-rub parlour owner's licence because of non-compliance with paragraph 52b (1) (d), furnishing false, misleading or incomplete information to the Clerk, for the reasons set out in the report, which are hereby confirmed. WAGG CITY CLERK WAYNE THOMSON MAYOR -- The City of Niagara Falls, Ontario Council Chambers No. 06 Moved by Alderman HENDERSHOT February5, 2001 Seconded by Alderman VOLPATTI WHEREAS the Provincial Government has encouraged local municipalities to improve their efficiency by amalgamation; AND WHEREAS the Provincial Government has provided specific objectives for amalgamation which would include: Fewer municipal politicians while maintaining accessible, effective, accountable representation, taking into consideration population and community identity; Lower taxes by reducing overall municipal spending, delivering high quality services at the lowest possible cost, preserving voluntarism, and promoting job creation, investment and economic growth; - Better, more efficient service delivery while maintaining taxpayer accessibility; Less bureaucracy by simplifying and streamlining government, reducing duplication and overlap, and reducing barriers and red tape for business; Clear lines of responsibility and better accountability at the local level by reducing duplication and overlap; AND WHEREAS the City of Niagara Falls participated with the Region, local municipalities and the Berkeley Group to create a "Made in Niagara" Governance Model; AND WHEREAS the Berkeley Report did not support a tmiCity for Niagara, but did encourage an action plan to modify the status quo based on the Provincial Government guidelines; AND -2- WltEREAS the Ad Hoc Committee on Governance is committed to reporting its preferred governance model to the Provincial Government by the end of 2001; NOW THEREFORE the Council of the Corporation of the City of Niagara Falls hereby resolves that the Council of the City of Niagara Falls set an example by investigating a reduction in the size of the current municipal council in time for the next municipal election in 2003; and further that b) the Region and local municipalities be encouraged to take similar action by investigating a reduction in the number of members on their current councils; and further that c) the Region and other local municipalities be encouraged to continue to work cooperatively to form joint ventures to provide coordinated services; and further that municipalities be encouraged to initiate voluntary amalgamations with neighbouring municipalities where in their opinion services to local residents would be enhanced. NOW THEREFORE BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Regional Municipality of Niagara, the individual municipalities within the Niagara Region, and to the Minister of Municipal Affairs and Housing. Moved by Alderman PIETRANGELO Seconded by Alderman CAMPBELL WHEREAS the Ontario Labour Relations Board has ruled that water meters must be installed, tested or changed by licenced plumbers or plumber's apprentices; and WHEREAS the use of licenced plumbers or plumber's apprentices will substantially increase the cost of installing and maintaining water meters; m~d WHEREAS the increased cost will be passed on to the ratepayers without an increase in service; THEREFORE BE IT RESOLVED THAT the Council for the Corporation of the City of Niagara Falls requests the Province of Ontario to revise the Trades and Qualifications Act to permit the installation of water meters by trained installers/technicians; AND FURTHER; that this resolution be circulated to all Municipalities and AMO for their support. AND WHEREAS biker gangs are a clear and present danger to peaceful and law-abiding Ontario communities; AND NOW THEREFORE BE IT RESOLVED THAT: The Provincial Government be requested to forthwith draft legislation so as to give Ontario municipalities the powers and tools to combat biker gangs at the local level including, but not limited to, amending the Building Code Act, 1992 and regulations thereto so as to prohibit the fortification of buildings of any kind, including clubhouses and further to amend the Planning Act to give municipalities the power to prohibit land uses associated with criminal elements. WAGG CITY CLERK WAYNE THOMSON MAYOR The City of Niagara Falls, Ontario Council Chambers No. 12 Moved by Alderman PIETRANGELO Seconded by Alderman WING May 14, 2001 WHEREAS the Fair Municipal Finance Act provides that the Minister of Finance may, by regulation, add to the Classes of property established for tax purposes; WHEREAS it is desirable to have heritage properties designated under the Ontario Heritage Act included and as sub-classes contained in the Classes of property under the Assessment Act; and WHEREAS the Honourable Marcel Beaubien, MPP Lambton-Kent-Middlesex, has recommended immediate implementation to amend the Assessment Act to create heritage as sub- clauses; NOW TltlgREFORE BE IT RESOLVED THAT the Council of the Corporation of the City of Niagara Falls dues hereby; REQUEST the Minister of Finance to prescribe, by regulation, "heritage" as a sub-class of properties under the Assessment Act and Ontario Regulation 282/98. Carded Unanimously CITY CLERK WAYNE TItO~.M~ SO_N MAYOR The City of Niagara Falls, Ontario Council Chambers No. 13 Moved by Alderman CAMPBELL Seconded by Alderman VOLPATTI May 14, 2001 WHEREAS over the last few years, and especially in the last number of months, there have been complaints and concerns about cutbacks, lack of staffing and insufficient coverage, at the Greater Niagara General Hospital (hereinafter referred to as GNGH); and WHEREAS most of these complaints are articulated to City Hall and the members of Council; and WHEREAS up until March 8, 2000 Niagara Falls City Council appointed 2 Aldermen to sit on GNGH's board; and WHEREAS these Aldermen appointed kept Council up to date on hospital issues; and WHEREAS the Niagara Health System was recently created amalgamating the operation and administration of hospitals in the Niagara Region; and WHEREAS political representation was eliminated from the "Transition Board" and the existing Niagara Health System's Board; and WHEREAS to prevent major decisions on GNGH from being made without local public input, a liaison committee be formed that would provide a flow of communications between the Niagara Health System and the City Council. THEREFORE BE IT RESOLVED that a liaison conunittee be formed that the Niagara Health System recognize this committee FURTHER BE IT RESOLVED that the Niagara Health System provide information to the liaison committee prior to making any major decisions with respect to GNGH; and -2- FINALLY BE IT RESOLVED that this resolution be sent to the Provincial Minister of Health and Long-Term Care Tony Clement, the local membar of Provincial Parliament Bart Maves and the C.E.O of Niagara Health Services Larry Tokarchuk.
