Motion: Carried Action: Recommendation submitted to Council 2001 06 11 DEPUTATION Alderman Hendershot advised Council and Mr. Elia that he sympathized with the Elia family and found the fence to be attractive and well constructed. If the City were to remove the fence the City would replace it with a chain link fence which would not be as aesthetically pleasing as the current fence. In this case Alderman Hendershot could justify the encroachment and believes that this case should be handled on a individual basis. Mayor Thomson advised Council that this property has a long history going back to 1969, the Elia family has maintained City property for years by cutting the grass, cleaning up garbage and dealing with a garbage heap beside their home. Mayor Thomson motioned that an encroachment agreement be entered into instead of having the fence removed and paying for a new chain link fence to be installed. The fence adds atmosphere to the entrance of the park and with the long history this family has with the City Mayor Thomson believes this case should be handled on an individual basis. Alderman Craltor advised Council that after reviewing the report from April 23, 2001 he had an opportunity to determine the cost of a chain link fence to be approximately $3,000. To tear down a fence that is so well constructed and replace with a chain link fence at such a cost would not seem fair to anyone. Alderman Craitor believes this is a unique situation and is in favour of the motion. Alderman Volpatti advised Council that in the past she was against the encroachment and did not want to set a precedence. After hearing the comments made tonight Alderman Volpatti is in favour of the motion. Aldermma Ioannoni advised Council that she is in agreement with Alderman Craitor m~d does understand the concerns raised from the April 23, 2001 meeting. Alderman Ioannoni is in favour of the motion made. Alderman Puttick questioned staff as to what would happen if we enter into this agreement and the owners of the property sell their home, will we be back in this situation again? Ray Kallio informed Alderman Puttick and members of Council that the home owners will bear all cost involved with an encroachment agreement and this agreement may be passed from one homeowner to the next. Alderman Volpatti questioned if future Council members could revoke the agreement. Ray Kallio informed Council that this could not be done. It was moved by Mayor Thomson, seconded by Aldem~an Hendershot that an encroachment agreement be entered into with Mr. Elia for the fence in question. Motion: Action; Carried Recommendation submitted to Council 2001 06 11 PREFENT,~TION Mike Watt -Walker Industries made a presentation to Council regarding the closure of Beechwood Road and the rebuilding of Mountain Road. This presentation was for the information of Council. It was moved by Alderman Hendershot, seconded by Alderman Fisher that the presentation by Mike Watt of Walker Industries be received and filed. Motion: Action: Carried Recommendation submitted to Council 2001 06 11 3) REPORTS a) MW-2001-74 - Roberts Street Property Purchase It was moved by Mayor Thomson, seconded by Alderman Craitor that the City be authorized to borrow one million dollars for the City's share of property purchases on Roberts Street. Motion: Action: Carried Recommendation submitted to Council 2001 06 11 b) M-W-2001-77 - Bus Loading Zones - No Stopping Restrictions Temporary Measures for Dunn Street & Fallsview Boulevard It was moved by Alderman Federow, seconded by Alderman Craitor that temporary measures for Dram Street and Fallsview Boulevard for bus loading zones and no stopping restrictions be approved. Motion: Action: Carried Recommendation submitted to Council 2001 06 11 c) lVI~V-2001-82 - Sewer Surcharge Relief Program Alderman Craitor addressed staff questioning the fairness of the charges to residential homes. Alderman Craitor has recieved numerous phone calls on this issue. Ed Dujlovic advised Council that the system in place is fair and the Municipality has no other options at this point but to charge residence for water useage coming into and exiting the home. Alderman Puttick questioned staff; (1) Is the City trying to save jobs? (2) Industries are having taxes capped, why sewer surcharge relief as well? (3) How many businesses are we looking at exempting? Ed Dujlovic advised Council that some industries that use water in the production of their product, meaning the water does not exit the building, will be looking for sewer surcharge relief. This report was brought forward to establish a fair policy due to the number of request for relief, this number being approximately 20 - 30 businesses. It was moved by Mayor Thomson, seconded by by Alderman Puttick the meeting be moved to In-Camera for two minutes. Motion: Carried After Committee reconvened, it was moved by Alderman Volpatti, seconded by Mayor Thomson that the sewer surcharge relief program be approved. Motion: Carried Action: Recommendation submitted to Council 2001 06 11 d) R-2001-24 - Capital Campaign Feasibility Study for Community Centre · Aldermart Campbell questioned staff as to the validity and methods used in study. · Bob Bolibruck advised Council that this study is to get us campaign ready, this study will give us realistic goals to campaign the residents of the City. Government funding is also available to us. It was moved by Alderman Fisher, seconded by Alderman Feren that the consulting firm Ketchum Ix: retained to complete the Capital Campaign Feasibility Study for the new Community Centre. Motion: Action: Carried Recommendation submitted to Council 2001 06 11 f) R-2001-27 - Purchase a Kubota Tractor & Mower Alderman Puttick questioned staff as to why the City did not tender. Bob Bolibruck advised Council that it would be advantageous to the City to sole source, as the Kubota Company has provided quality equipment and service in the past. Alderman Pietrangelo questioned staff if they had tendered out in the past and not been happy with the tender. Bob Bolibruck was unsure of past experiences. It was moved by Alderman Puttick, seconded by Alderman Orr to defer the report and have staff investigate and report back with a tender. Motion was defeated with an 8 - 5 vote It was therefore moved by Mayor Thomson, seconded by Alderman Hendershot that City Council authorize the purchase of a 2001 Kubota Tractor & Mower Motiom Action: Carried Recommendation submitted to Council 2001 06 11 g) FS-2001-02 - Repair of Fire Apparatus It was moved by' Alderman Fisher, seconded by Alderman Feren that Council approve the low bid of $22,776.00 plus taxes from Drakar Engineering limited to repair unit 41, aerial apparatus. UINE~$: Alderman Puttick advised Council that large cul-de-sacs such as Fatima Court are not having the grass cut in the island. Alderman Puttick would like to know when a by-law came into effect that stated the City does not cut grass in cul-de- sacs. · Ed Dujlovic advised Council due to budget restrictions the City eliminated grass cutting in cul-de-sacs. It was moved by Alderman Puttick, seconded by Alderman Feren that staff prepare a report on the cutting of grass in the island for cul-de-sacs. Motion: Action: Carried Recommendation submitted to Council 2001 06 11 Alderman Feren questioned staff on the frequency of leaf & yard waste pickups. Alderman Campbell further questioned staff as to why when grass clippings are clearly identified either in clear/orange bags or in open containers they are still being missed or left for days until picked up. Ed Dujlovic advised Council that the City's contract with the Region is to have leaf & yard waste pickup every two weeks, if we go to a weekly pickup the cost will increase. We would have to contact the Region to obtain the cost difference. The Region has been made aware of the lack of leaf & yard waste service the City of Niagara Falls has been receiving and the Region is ready to invoke the penalty clause on. the carrier. Alderman Craitor advised staff that the residents are getting fed up with the waste collection system and are just dumping it, he was recently made aware of a dumping site in the Oakwood Drive area. Director MW-2001-67 July 16, 2001 Alderman Victor Pietrangelo, Chairperson and Members of the Community Services Committee City of Niagara Fall:s, Ontario Re: MW-2001-67 - Site Servicing Agreement between the City of Niagara Falls and Canadian Niagara Hotels Inc. - Mewburn Road ~ Mountain Road RECOMMENDATION: It is recommended that the City enter into an agreement with Canadian Niagara Hotels Inc. concerning the futm'e improvements to Mewburn Road across the frontage oftbe proponent's lands and to receive a dedication of land on which the Mewburn Road Sanitary Pumping Station is currently located. BACKGROUND: The Niagara Falls Committee of Adjustment, at their meeting of April 10, 2001 considered and approved an application (file No. B21/2001/NF) from Canadian Niagara Hotels Inc. to sever a 0.836 ha, parcel of land fronting on Mewburn Road for the purposes of a future 24-unit townhouse development (See attachment "A"). The approval was granted subject to six conditions, two of which are the focus of this report. Condition number one requires the applicant to enter into the site servicing agreement with the City regarding improvements to Mewburn Road. While it is likely that the townhouse portion of this project will proceed in the near future there are still some outstanding access and traffic issues that need to be resolved for the commercial block. In addition, a number of residents living in this area expressed concerns about how Mewbum Road will function after this development occurs. For this reason staff has proposed that the physical improvements to Mewburn Road be deferred until these answers are available but that we obtain securities from this developer now to guarantee payment for their share of the needed capital works. The developer has requested that there be two agreements, one for the townhouse block and a second for the commercial[ block. The amount of security for each agreement has been estimated to be $121,400 and $166,100 respectively. IVorking Together to Serve Our Community Municipal Works Fire Services Parks, Recreation & Culture Business Development Building and By-Laws 2001-07-16 -2 - MW-2001-67 Condition number three requires the applicant to dedicate a 356 m2 parcel of land on the southwest comer of Mountain Road and Mewburn Road which currently has a City-owned sewage pumping station located on it (See attachment "B"). This matter is basically a housekeeping item that can now be formally addressed in the site servicing agreement. This facility was constructed on private lands with the understanding that a formal transfer of ownership was imminent with the developer of the day. Since then ownership has changed at least twice and prospective development proposals have not come to fruition. The developer has requested that, as a condition of this transfer, the City agree to contribute to the cost of aesthetic improvements (ie. landscaping) of this property up to a maximum of $10,000. Upon execution of these two site servicing agreements, Municipal Works staff will clear these two conditions of approval. BACKGROUND: As a result of budget constraints in the early 1990's the cutting of grass in cul-de-sacs was eliminated in 1993. The cost in 1992 to provide the biweekly cutting was approximately $48,000 of which 50% was covered by The Ministry of Transportation Subsidy. It should be noted that the City no longer receives any funding from The Ministry of Transportation. Staff has determined that of the approximately 181 cul-de-sacs, 138 have islands that require the cutting of grass. In order to achieve a biweekly cutting of the grass over the twenty-four-week grass cutting season the cost would range from $43,000 - $57,000. When this service was first eliminated in 1993 there were a number of calls made to the City requesting that the grass be cut. When the residents were informed that this service had been cut as part of cost cutting measures, they began to take on the task of cutting the grass themselves. Since that time the City has received very few calls as the neighbours have taken it upon themselves to maintain the islands. In the event that the cul-de-sac is not being maintained the City will carry out grass cutting, however, it will only be done three to four times during the grass cutting season due to limited resources. Should Committee wish to consider this service for 2002, it is recommended that it be brought forward during the 2002 budget deliberations. BACKGROUND: Council at its June 11,2001 meeting referred a Victoria Centre BIA request (attached) to remove the parking meters along Victoria Avenue between Centre Street and Walnut Street, to staff for comment. The basis of this request is to improve both pedestrian and vehicular safety along the street and adjacent to the sidewalk area. In addition, they are also suggesting that the sidewalk be widened. No permit will be issued unless an application has been submitted to Parks, Recreation & Culture. Every permit issued is subject to the Rules & Regulations for the Use of City Parks and Athletic Fields Policy. When a major special event or tournament requires the use of previously permitted facilities, a minimum of two (2) weeks written notice must be given to permit holders by the Parks, Recreation & Culture. If two (2) weeks notice cannot be given, the approval of City Council to cancel a pemfit must be obtained. Special events requiring parks or athletic fields which have previously been allocated are to obtain written permission to use these facilities from the organization which holds the existing permit. Any changes in permits must be brought to the attention of the Parks, Recreation & Culture prior to the issuance of a Special Event Permit. All weekends are available for special event use. The dates that are on a statutory holiday are subject to payment by the event organizer for 100% of the cost associated with having staff, (rates as determined by the Union Agreement). Applications received after the application deadline date will be allocated facilities following those organizations who applied prior to the specified date. Priorities fur scheduling special events will be as follows: b) c) Special events from which the profits are used to finance a local summer sports league or service club, i.e. Girls' Minor Softball Tournament, Niagara Fastball Tournament, Optimist Slo-Pitch Tournament; Special events from which the profits assist local teams; Special evems from which the profits assist other types of organizations. 10. 2 Any event considered to be a commercial venture will negotiate rental rates with the Parks, Recreation & Culture. Prior to the issuance of a Special Event Permit which allows alcohol to be served, an L.C.B.O. permit must be obtained and a copy given to Parks, Recreation & Culture. Permits must be posted and roles adhered to in accordance with the City's Alcohol Risk Managemem Policy and provincial regulations. Programs operating in park facilities without lights will be completed at dusk. Facilities with lights will have the lighting turned on at dusk (lA hour before sunset) and off at the completion (normally no later than 11:00 P.M.) of all approved league, playoff, tournament or exhibition games or at the request of a league representative who then must sign the authorization form. The Groundskeeper or Parks Supervisor will record and monitor field lighting usage and will invoice all permit holders in accordance with the usage at the completion of their season, or special event. The lighting rate charged will be outlined in the City's Schedule of Fees for Services. Electrical rooms and panels are to be handled by the designated Parks Staff only. No changes, modifications or additions are to be made to electrical equipment or wiring including field lighting, pitching machine outlets, irrigation controllers, score clocks, public address systems and concessions without the written permission of the Superintendent of Parks or his/her designate. Food or refreshments will not be sold by any group using City parks unless permission to do so is received in writing from Parks, Recreation & Culture. Alcoholic beverages are not permitted on City parks or athletic fields unless authorized by City Council and in accordance with the City's Alcohol Risk Management Policy and the L.C.B.O. regulations. 6. Where there are additional labour or equipment costs involved for the use of parks or athletic 10. 11. 12. 13. 14. 2 fields, such costs are to be borne by the user. The rate of the additional labour costs will be in accordance with the City's Collective Agreement. Charges for all City owned equipment will be in accordance with Internal City Vehicle Rental Rates or the actual cost of the equipment rented if outside equipment is necessary. All groups charging an admission or registration fee for a special event are to submit a complete f'mancial statement at the completion of the season or special event to Parks, Recreation & Culture. These financial statements should include all details fo the event, including proceeds from the sale of food, beverages and souvenirs. Failure to submit a financial statement may jeopardize the granting of future special event permits. During inclement weather, poor field conditions or if facility damage occurs, the facilities may be closed without notice, at the discretion of the Parks Superintendent or his/her designate for the safety oftbe participants and the facility. The decision to commence, delay or cease facility maintenance/use is at the sole discretion of the Parks Staff. Once games or matches have commenced, umpires/referees, in consultation with conveners and coaches, are responsible for calling games. The Parks, Recreation & Culture reserves the right to withhold parks or athletic facilities or cancel permits for reasons such as: Use of closed facilities by permit holders, municipal strike, special events, non-payment of required fees, abuse of facilities, when facilities are deemed unsafe by the Parks, Recreation & Culture or in accordance with the rainout policy as detailed in section 8 above. The user is responsible for any taxes imposed on the sale of tickets and all arrangements in regard to taxes are to be made directly to the appropriate Government body. Garbage and wastepaper containers will be supplied and each group using parks or athletic fields is expected to leave the area as clean as possible. Major clean-up during or after special events may be charged to the user. Special events and tournaments are to be arranged prior to the season opening and may not take precedence over a regularly scheduled game if inadequate notice is given for the change of such scheduled activities. All game requests and reseheduling are to be through the Parks, Recreation & Culture Office and not through individual parks grounds keepers. Precedence for use of parks and athletic fields will be given to Regional, Provincial, and National level play-off games. Arrangements for these events are to be made through the Parks, Recreation & Culture 72 hours prior to the game. No schedules will be given by the City for rained out games. The adjusted schedules will be the responsibility of the organization to reassign within time allocated in their permit. The organization is responsible for advising the City of the rain out schedule. Any additional 3 game dates requested outside of the group's permit will require approval of the Parks, Recreation & Culture. 15. 16. 17. 18. 19. 20. Commemial and/or promotional activities will not be permitted at municipal parks or athletic fields without: written approval from Parks, Recreation & Culture. League games and play-offs are generally to be completed prior to the following dates each year unless otherwise arranged with the Parks, Recreation & Culture. a) Ba~seball, Softball, Slo Pitch b) Soccer c) Football - September 15 - September 15 - November 15 No special events may be scheduled for any City park or athletic field that wilt require alterations to the fields which could cause a hazardous condition. League and Special Event Convenors are to submit game, playoff, tournament and special event schedules to the Parks, Recreation & Culture Department with a minimum of seventy two (72) hours notice to ensure the facilities are properly prepared. Permit holders are expected to provide supervision for all participants during the dates and times specified on their pemaits. Participants include all athletes, coaches and other team personnel, officials, and spectators. Permit holders are responsible for providing a sufficient number of adults on site at all times during their event, to ensure participant safety and appropriate behavior are maintained. If problems occur, future permits may be restricted, or additional City staffassigned to monitor the use of the facilities and the cost for additional staffwill be invoiced to the permit holder. The City Staff lock the gates at designated fields to control access and to ensure the quality of the facilities. When gates are locked, the field is considered closed and no entry is allowed. It is expected that participants will comply with this condition; however, if this rule is not adhered to, Park StalTmay clear the field with assistance of the Police, if necessary. If violation of this role occurs, it may jeopardize the issuance of permits for the team or organization. 21. The City is responsible but requires the assistance of umpires, referees, coaches and players in inspecting playing surfaces and associated amenities to ensure they are hazard free and suitable for play prior to use. Sports fields found to contain a baTardous condition should not be played on. All problems should be reported to the Parks Section as soon as possible at 356-7521 extension 4320 or extension 4321 (Monday to Friday) 8:00 am to 4:00 p.m. or 356-1355 after hours, weekends and holidays. 22. League Play, Tournaments and Special Events are to be scheduled to begin generally at a time not earlier than 9:00 a.m. to allow the Maintenance Crew an opportunity to prepare the fields. League Play and Special Events are only to be scheduled within the approved weekly schedule and the stated opening and closing dates of the Park. In addition, facilities will be used as rated for field type, class and play rating (copy available from Parks, Recreation & Culture). In order to maintain the quality of the fields, no practices are to be scheduled on fields designated for games only. Exceptions only with written permission from Parks, Recreation & Culture. In order to maintain the condition of the Soccer Pitches at Oakes Park, Mitchelson Park # 1 & Kef Park #1, a use restriction will be in effect. The average use of the listed pitches is 9 games per week with a maximum use of twelve (12) games per pitch per week. BACKGROUND: The City approached Casino Niagara in the Spring of 2000 to financially assist with the beautification of the Victoria Avenue and Bender Street comer which is one of the main vehicular and pedestrian accesses to Casino Niagara. Casino Niagara agreed to finance this development which would include a decorative fountain and associated landscaping for a total of $ t 10,000.00. This Spring, the City sent out a 'Request for Proposal' to selected landscape contractors and landscape architects to submit proposals for design and construction of this streetscape amenity. A newspaper ad was also printed in the Niagara Falls Review. On June 28th, 2001 the City received two proposals, one from Touchstone Site Contractors and another from David Crown Landscaping Limited. A design review committee was set up with City Staff and Casino Niagara. After careful review of each design and consideration of all landscape design components, it was unanimously agreed that the design by Touchstone Site Contractors was the best design. That Casino Niagara will pay to the City of Niagara Falls a total sum orS110,000.00 for the design and construction of the Victoria Avenue Decorative Fountain. That the City of Niagara Falls will approve all design drawings, supervise construction and be responsible for the on going maintenance. That Touchstone Site Contractors will be responsible for the cost of the design and construction of this facility for a total cost of $100,000.00 including all applicable taxes and expenses based on the approved design submission. That Touchstone Site Contractors will be responsible to obtain all necessary approvals from the City, the Region of'Niagara and all other agencies associated with this development.
