To: Mayor Salci and Members of Council From: David Fotheringham & Steven Bailey, owners of the Oswald House Date: November 13, 2009 Subject: PD-2009-91 Oswald House Stone Wall with Fence 2922 St. Paul Avenue Thanks We would like to thank city staff for preparing such a comprehensive report. City staff now has, with the exception of one issue, a good understanding of the facts and our position. We are writing to comment on the staff report. Ownership The staff report includes the following statement "The letter in essence acknowledges that the fence is the property of the Oswald House and removes any previous debate as to who is the actual owner." Our memo is silent as to the issue of ownership. This issue is not relevant to our willingness to contribute $16,000 plus to the restoration and we did not raise it. We still believe that ownership of any improvement, such as the stone wall and fence, transfers with the ownership of the land on which it is situated when that land is expropriated. Option 1 On the surface, option 1 appears to be the first option mentioned in our memo of November 3. It is not because option 1 includes giving us a licence to encroach which indicates that we own the stone wall and fence. Our first option did not contemplate us agreeing that the stone wall and fence belongs to the Oswald property rather than to the city. Perhaps we were naive on this issue. Option 1 is the second most desirable option for us. We are, however, uncomfortable separating ownership of the wall and fence from the land on which it is situated. We will have to seek advice on this issue. Option 2 Option 2 is our preferred option. It keeps ownership of the land and wall and fence together. This situation is simpler to understand. We suggest an agreement between us and the city to set the purchase price in a re-expropriation of the thirteen feet at one dollar. We assume that this agreement could be registered on title so that it would be binding on future owners. This agreement would eliminate the risk of the future cost to the city of purchasing land in the event that the road needs to be widened. With this fencecomservice091116B agreement in place, there is no significant difference in the "cons" for the city between Option 1 and Option 2. We realize that some of you may think that a disproportionate amount of your time has been spent on this issue. I am a Board member of the Ontario Heritage Trust and had been informed about the (then) situation vis-a-vis the heritage designation of the property and the fence. It appears that the Planning Departments recommendations -Option 1 or Option 2 set out in the Report -achieve the goals and purposes of heritage preservation laws and policies. The Ontario Heritage Trust and the Ontario Ministry of Culture depend on the municipalities to. ensure compliance with legislation. It is also recognized -accepted in all parts of the country and province and in all municipalities -that the preservation, conservation and protection of heritage property is good public policy and is much desired. The decision of the Ciry was to reject the approval of this location due to its lack of operation in the previous years and not being licensed by the Regional Police. We appealed this decision hoping to have obtained approval; however we have now reconsidered this matter and would like to withdraw the appeal. Our decision was made due to the historic changes in the area being made by the City, the Niagara Falls Historic Museum and the Main and Ferry Business District. We support the positive changes for redevelopment in the area and look forward to revitalization. We also xecenfly became aware of a decision of City Council to reduce the number of Adult Entertainment Licenses from 4 to 3, whieh we support as a result of our business plan. We will continue with our application fox a Liquor License for this location and -hope this demonstrates a positive support for the city and the Main and Ferry BIA. The application would rezone the property from the Open Space (OS) zone to a Tourist Commercial (TC-844) zone that would permit a range of tourist commercial uses along with offices on the subject property. The property is located at the northeast corner of Lundy's Lane and Montrose Road both of which are arterial Regional roadways with significant volumes of traffic and turning movements. Regional staff has had previous discussions with City staff regarding this property. In an email to the City, dated June 10, 2008, Regional staff expressed concern regarding the anticipated traffic impacts a commercial use would have on the Regional Road(s). Regional staff advised City staff that a change to a commercial zone could not be supported by the Region. In September 2009, zoning bylaw amendment application, AM-2009-014, was circulated by the City to the Region for comment. In a letter dated October 1ti, 2009, Regional-staff raised concerns with any use on the property that could result in additional traffic on the Regional road(s) and accesslegress to the property. Therefore, Regional staff requested that a Traffic Impact Study be undertaken prior to the rezoning of the property to determine what uses are appropriate for the site, the levels of traffic that will be generated as a result of those uses, and to make recommendations for intersection and access improvements. At its October 19, 2009 Council meeting, the Council of the City of Niagara Falls approved the zoning bylaw without the benefit of a Traffic Impact Study to determine the appropriateness of the uses permitted in the TC-844 zone. The Development Services Division is hereby appealing the decision of the Council of the City of Niagara Falls. Regional staff has had previous discussions with City staff regarding this property. In an email to the City, dated June 10, 2008, Regional staff expressed concern regarding the anticipated traffic impacts. a commercial use would have on the Regional Road(s). In September 2009, zoning bylaw amendment application, AM-2009-014, was circulated by the City to the Region for comment Regional staff provided comments on the zoning bylaw amendment application, in a letter dated October 16, 2009, and again raised concerns with any use on the property that could result in additional traffic on the Regional road(s) and access/egress to the property. Regional staff requested that a Traffic Impact Study be undertaken, prior to the rezoning of the property, to determine what uses are appropriate for the site, the levels of traffic that will be generated as a result of those uses, and to make recommendations for intersection and access improvements. In coming to this request/recommendation, Regional staff considered the protection of public health and safety, which is an underlying principle of the Planning Act, Provincial and Regional documents, and good planning. Under Section 2 of the Planning Act, the Council of a municipality, in carrying out their responsibilities under this Act, shall have regard to matters of provincial interest including (o) the protection of public health and safety. lJnder Section 3.2.2 of the Places to Grow Growth Plan, the transportation system within the Greater Golden Horseshoe will be planned and managed to (e) provide for the safety of system users. .Similarly, under Section 1.6.5.1 of the Provincial Policy Statements, transportation systems should be provided which are safe, energy efficient, facilitate the movement of people and goods, and are appropriate to address projected needs. One of the objectives of the Transportation section of the Regional.Pol(cy Plan is to promote and support safe, convenient, efficient, aesthetic, and economical transportation systems for all modes of transport for the movement of people and goods. Further, the configuration of the intersection and the access point to the subject property raises additional safety concern with an increase in ingress/egress to and from the property. Regional staff are of the opinion that to address the matter of public safety, a Traffic Impact Study must tie undertaken to determine what uses are appropriate for the site, the levels of traffic that will be generated as a result of those uses, and to make recommendations for intersection and access improvements.
