WHEREAS Draft Plan of Subdivision and Zoning By -Law Amendment Application 26T-11-2009-01/
AM- 30/2009 (Fernwood Phase III), proposes the creation of ninety -six (96) single detached lots, two
(2) townhouse blocks and the implementation of appropriate zone categories; and
WHEREAS the applicant has revised the depth of lots and blocks along the north lot line and adjusted
the width and depth of certain lots elsewhere in the project; and
WHEREAS there is no change in the number of lots or blocks to be created or any change in the zone
requirements of the amending by -law; and
WHEREAS the December 13, 2010 meeting complied with the requirements of the Planning Act to
hold one statutory public meeting and associated notice provisions; and
THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the City of Niagara
Falls hereby determines in accordance with Section 34(17) of the Planning Act, R. S.O., that the changes
to the Draft Plan of Subdivision are minor in nature and do not require any further notice.
