WHEREAS the road authority for Lundy's Lane from Montrose Road to Kalar Road is the Regional
Municipality of Niagara (the Region); and
WHEREAS this section of Lundy's Lane is populated with commercial properties and the occasional
remaining residence; and
WHEREAS Niagara Peninsula Energy (NPEI) are installing new Electrical Distribution Poles as part
of their 2011 Capital Works program; and
WHEREAS the Capital Works program will see the installation of concrete poles that will improve
service reliability to NPEI's Lundy's Lane customers; and
WHEREAS the Capital Works program may see the removal of some mature trees along Lundy's
Lane; and
WHEREAS the Lundy's Lane Business Improvement Association (BIA) has indicated in the past to
the Region that they would like to be consulted on any future installations to ensure such installations
are in keeping with the BIA's streetscape; and
WHEREAS although NPEI has provided Notice of Construction letters, as of September 8th, to the
Lundy's Lane properties, the letters do not provide enough detail on the scope of the project; and
WHEREAS a petition of approximately one hundred Lundy's Lane property owners has been
compiled.
THEREFORE BE IT RESOLVED that the installation of the new Electrical Distribution Poles be
temporarily put on hold so the Regional Municipality of Niagara and Niagara Peninsula Energy can
convene a public information meeting with the Lundy's Lane property owners to outline the scope of
the project, the tree preservation plan and allay any concerns of the property owners; and
FURTHER BE IT RESOLVED that the Region and NPEI be respectfully requested to make every
effort to ensure that the installation plan mitigates impacts on the Lundy's Lane property owners and
preserves as many mature trees as possible.
