Diodati and Members of the Municipal Council City of Niagara Falls, Ontario SUBMITTED BY: Municipal Works SUBJECT: MW-2014-03 Thorold Stone Road Extension Update RECOMMENDATION That Council receive this report for information purposes. EXECUTIVE SUMMARY The City of Niagara Falls is working in cooperation with the Niagara Region to achieve a new access to the Gale Centre through three possible options. Each of these options will be included in a public tender that will be part of the Stanley Avenue (Thorold Stone Road to Valley Way) reconstruction project scheduled to commence construction this Spring. A fourth option could include a proposal from Falls Community Developments(FCD)which is to be submitted to the Region by January 31, 2014. A decision regarding the merits of this proposal will be considered by the Region prior to tendering. There are a number of minor issues that need to be addressed prior to the issuance of a public tender in late March/early April including the transfer of land ownership or leasehold rights of the road corridor into public ownership. The purpose of this report is to update Council on the recent developments in the advancement of the Thorold Stone Road Extension project and to re-affirm Council's commitment to establish a new access road into the Gale Centre during this calendar year. BACKGROUND Niagara Region and City staff have met with the development group representing FCD who submitted a proposal on December 9, 2013 which included a fixed price contract construct the extension of Thorold Stone Road complete with servicing extensions and soil remediation along the road allowance to the standards prescribed in the recently acquired Certificate of Property Use. This proposal was rejected by staff on the basis of price (primarily) but also concerns regarding procurement of public assets, surplus soil removal/relocation and the timing of the project delivery. The reconstruction of Stanley Avenue between Thorold Stone Road and Valley Way is on track for construction commencing this Spring and it is possible that there are economies of scale to be achieved by including the new access to the Gale Centre in the project scope. January 28, 2014 -2 - MW-2014-03 The project would be tendered as follows; Stanley Avenue - Thorold Stone Road to Valley Way This project includes the reconstruction of the roadway, sidewalks,watermain and sanitary sewer replacement. The EA for this project was completed in August 2013 and the preferred alternative is designed and confirmed for construction by the Region this Spring. Option A - Thorold Stone Road Extension - Arterial Road Design This option includes the construction of a 4-lane roadway and services identified as the preferred alternative in the Municipal Class Environmental Assessment (February 2008). Option B - Thorold Stone Road Extension - Access Road This option includes the construction of a 2-lane access road along the Thorold Stone Road Extension corridor. It does not include servicing but does provide access to the Gale Centre in the interim. It provides a short term option until the developer can prepare a more fulsome Brownfield development scheme for the entire area. Option C - Former NS&T Line - Access Road Extension This option includes the construction of a 2-lane access road along the former rail line (recently acquired by the City) extending to Fourth Avenue (or some modifications as determined through the ongoing Environmental Assessment process. The three options are more accurately depicted in the attached schedules. ANALYSIS/RATIONALE The Stanley Avenue Reconstruction project is of critical importance to both the City and the Region due to the condition and age of the existing infrastructure. The Municipal Class EA completed in August of last year identified a preferred design alternative that addresses the problem statement. "In its current condition and configuration, Stanley Avenue has a number of operational, geometric and structural deficiencies that can be addressed by concurrently improving connectivity, operations and safety including the provision of dedicated cyclist and transit facilities." Preliminary estimates for this project, including the construction of a new signalized intersection at Thorold Stone Road is estimated to be approximately $5.4 million. The City's estimated share is about 35% or $1.9 million. The three options range in value from roughly $1.5 to 2.5 million. At this point it is uncertain as to the cost sharing to be considered in the developer's new proposal (Option D). It is important that the City obtain tendered pricing to properly assess the true cost of construction. January 28, 2014 -3 - MW-2014-03 FINANCIAL/STAFFING/LEGAL IMPLICATIONS The City of Niagara Falls has committed funding in the amount of $3.9 million in prior budgets for this purpose. Some adjustment may be required depending on the option selected and /or tendered values. This matter can be considered in a future report. CITY'S STRATEGIC COMMITMENT The recommendation is consistent with Council's Strategic Priority for a Well-Planned City, Convenient, Accessible and Sustainable Transportation and Infrastructure Sustainability. If I understand what I am reading correctly, a stopping prohibition is proposed to ensure there is sufficient clearance. The situation described above is one I encounter with very regular frequency on my own street section. It is particularly bad in the winter,when snow storage further narrows the travel-able portion of the roadway. The situation is especially bad in front of the apartment buildings at 6136-6146 Barker, where vehicles often park illegally throughout the day. Between these and the legally parked vehicles on the opposite side of the road, it is sometimes exceedingly difficult for other vehicles to squeeze through in the winter. A No Stopping prohibition might help in this case too. It would be ignored by many, I am sure (just as is the current parking prohibition), but it would provide at least some relief. St.James and the original section of Barker are just two examples of legacy roadways in our city. Another that comes immediately to mind as being particularly challenged is Peer Lane, but I am sure other legacy thoroughfares in the former villages of Stamford, Niagara Falls (Main & Ferry), Clifton and Chippawa have similar issues. This has reminded me that I've been meaning to bring to your attention a Hamilton discussion paper on the inadequacies of, and issues with,the road classification hierarchy( http://www.hamilton.ca/NR/roadonlyres/8B22B9EC- 8D68-4421-8D4E-AEC25997E8530/14Road Classification 1815109.pdf)which reads in part: "... Many variations on the basic hierarchy have been developed or proposed from time o time to provide more options to account for local circumstances ...The traditional hierarchy may work well in newer urban areas, but [not in one which] contains older mature communities with a legacy roadway system ... substantial development occurred before setbacks were required under a zoning by-law,and in some of the older areas, structures encroach on the road allowance." (Such, by way of example, is the Barker street segment between Main and Drummond, which began as a lane through the Barker orchard prior to the War of 1812 before becoming a road later in the horse and buggy days. A number of structures encroach along this segment on the road allowance of this legacy roadway.) The Hamilton writer notes: "Many jurisdictions have found that one elements of the national guidelines are not flexible enough or detailed enough to account for their own roadway characteristics, especially in older and larger urban areas,and that augmentation is required... 1 The national guidelines produced by TAC is an excellent source to use as a foundation ... However, experience in three mature municipalities in Ontario ... suggests there must be recognition of the special character of roadways in certain areas. Given the complexities of[mature municipalities] large and old built form, and the need to recognize the special characteristics of roadways that do not neatly fit into one this standardized approach will not suffice." Many jurisdictions have used the TAC guidelines as the basis for their own road classification systems, but have augmented or modifies them to meet their own needs. There may be a need to vary the default values ... to account for legacy situations, particularly where the available rights-of-way are limited and setbacks of buildings are limited or absent. In addition to the core classification elements, there are several other roadway features that could apply to particular road sections including special character roads [and] heritage roads." Various approaches to special status street segments, to reflect site constraints, existing physical development or encroachment, placement of buildings, heritage structures, etc. are examined, including alternative criteria for street types, "Streetscape Characteristics as determined by Adjacent Land Use Characteristics," and assigning roads to the lowest road classification matching a number of their features. It is suggested that a street section that meets the criteria for a Special Character Road "could be considered as a Local Road, because many of the road's characteristics are reflective of the Local Road classification rather than a Collector Road classification, notwithstanding that it fulfills a Collector Road function." I am writing this letter in response to the letter that was sent to me by Mr. Paul Brown, manager of parking operations, advising me that the Parking Commission has decided that it will take away two `reserved' parking spots located in the parking lot off of Park Ave. at the rear of my building. My full time pharmacist and I are currently using those two spots. I would like to start by saying how disappointed I was to receive such a letter from Mr. Brown. Queen Street Pharmacy has been a fixture of the downtown core for since 1986. Ten years ago an addition was made to the pharmacy to include a medical building. Currently we have more than seventy staff members working in the building and pharmacy. The Niagara Medical Group Family Health Team located inside the Queen Street Building has more than 10,000 patients registered on their list and a couple more thousand on a wait list. Needless to say, there are a countless number of people who visit the building and pharmacy on any given day and subsequently the parking lot located at the rear of the building. I have been purchasing parking permits for the pharmacy staff as well as for all the doctors in the building, totaling 16 to 20 permits, annually since my acquisition in 2007. The permits cost me approximately $8000 - $10000 annually. Taking that into account as well as the number of clients that park in that parking lot on an average day, and you will find that my building and I are responsible for much of the revenue that is earned for parking in the entire core of downtown Niagara Falls. ti ; QueenStreet r:/.)?P H A R M A C Y Home Health Care Centre Lastly, I would like to highlight that the two `reserved' spots that are currently saved for myself, have been negotiated by the previous owner and have been used by us for 30 years or more. The resolution is outlined below. "NOW THEREFORE BE IT RESOLVED, that the City of St. Catharines, in order to protect the Great Lakes and its tributaries, urges that neither this proposed nuclear waste repository at the Bruce Nuclear Generating Station nor any other underground nuclear waste repository be constructed in the Great Lakes Basin, in Canada, the United States or any First Nation property.
