Diodati and Members of Municipal Council SUBMITTED BY: Finance SUBJECT: F-2015-20 Stamford Centre Volunteer Firefighters Association (SCVFA) - Guarantee of Letter of Credit and Site Works RECOMMENDATION That the City of Niagara Falls provide a guarantee for a letter of credit related to the SCVFA building construction and approval of associated site works as outlined in the report. BACKGROUND At the Council meeting on February 25, 2014 Council acquired 105 acres of parkland from the Stamford Centre Volunteer Firefighter Association. As part of the purchase agreement the land would then be leased back to the SCVFA for nominal consideration. The SCVFA will retain ownership of the "Clubhouse" building on the site, however, should the SCVFA cease to exist in the future, the building would automatically transfer to the City. The SCVFA are now entering the final construction phase on their clubhouse building. Although the SCVFA have sufficient funds to complete the majority of the project, they are looking for assistance with the following: • Completion of exterior site works (grading, concrete sidewalks, finish asphalt) estimated $80,000 - $90,000. • Assisting with the guarantee on a line of credit that will cover any contingencies that arise during the construction phase ($200,000 upset limit) The SCVFA currently have enough financing to complete the building. The SCVFA does not have sufficient funds to cover any unforeseen issues that may occur during the construction phase and therefore require a letter of credit. The financial institution requires that the letter of credit have a guarantor. The letter of credit will allow the club some flexibility should any contingencies occur. Staff are agreeable to finishing the exterior works due to the fact that these are located on city owned lands that surround the building. 2 F-2015-20 April 28, 2015 FINANCIAL/STAFFING/LEGAL IMPLICATIONS SCVFA has requested that the City of Niagara Falls commit to guaranteeing the group's line of credit available for contingencies should these arise with their project. Similar requests have been made in prior years for other community groups, without impact on other residents. Likewise, since the City is the owner of the park, the site works will be included within the City's contracts for these works. Diodati And Members of Municipal Council SUBMITTED BY: Recreation & Culture SUBJECT: R&C-2015-04 Gale Centre Energy Project RECOMMENDATION 1. The contract be awarded to E.S. Fox at the tendered price of $275,454.45 including HST; 2. That the Mayor and City Clerk be authorized to execute the necessary contract documents. EXECUTIVE SUMMARY Crossley Engineering Ltd completed a Gale Centre Energy Efficiency Review in 2013. The document identified two capital projects to improve the facility's energy consumption: (1) Retrofit of the Lighting systems to reduce utility costs and to improve the overall lighting and controls. (2) Enhance the mechanical systems, to separate the heat loop and to install variable speed pumps. The energy saving modifications to the mechanical systems, recommendation two is an approved 2015 capital budget project. BACKGROUND The Gale Centre opened June 2010. Following the first year of operation staff identified higher than expected utility costs. Crossey Engineering Ltd. was contracted to analyse the Gale Centre operations to recommend future projects to reduce the overall energy consumption. ANALYSIS/RATIONALE The Tender Opening Committee, in the presence of the City Clerk, Dean lorfida, and the Director of Recreation & Culture, Kathy Moldenhauer opened tenders on Thursday, April 23, 2015. 2 R&C-2015-004 April 28, 2015 Contractor City Tender Price E.S. Hamilton, ON $326,570 Combined Air Mechanical Mississauga, ON $394,370 Services FINANCIAL/STAFFING/LEGAL IMPLICATIONS The Gale Centre Energy project has been approved in the 2015 Capital Budget at an amount of $257,000. The approved budget will be adequate to fund the tender price net of HST rebate. The project will be implemented during the scheduled maintenance shut down week June 22- 26 with some work being competed throughout July. CITY'S STRATEGIC COMMITMENT The implementation of the Gale Centre Energy Project fits the Strategic Priority of Infrastructure Sustainability, to Operate, maintain and upgrade the City's infrastructure and other assets in an affordable, reliable, environmentally sustainable and integrated way.
