Council met on Monday, September 25, 2000 at 7:15 p.m. for the purpose of
considering Regular Business matters. All members of Council, with the exception of
Alderman Puttick, who was away on vacation, and Alderman Volpatti, who was away,
were present. Alderman Paisley Janvary-Pool offered the Opening Prayer.
ADOPTION OF MINUTES
Alderman Wing requested that the Minutes of September 11, 2000 be amended to
reflect that Aldermen Craitor, Ioannoni, Pietrangelo and Wing voted contrary to the motion
to By-law No. 2000-199 and with all others voting in favour; and Alderman Craitor
requested that the Minutes under Ratification of Community Services Committee actions
be amended to reflect that staff inVestigate parking on Murray Street and Drummond Road
Alderman Orr indicated a pecuniary interest on the matters dealing with the
permanent casino, because she is employed by the Casino.
ORDERED on the motion of Alderman Michalczyk, seconded by Alderman Pietrangelo,
that the Minutes of the Planning/Regular Council Meeting of September 11, 2000 be
adopted as amended. ~
DISCLOSURES OF PECUNIARY INTEREST
Alderman Pietrangelo indicated a pecuniary interest on Communication No. 258,
the Ontario Teachers' Federation because he is employed by the Catholic School Board.
Alderman Campbell indicated a pecuniary interest on Communication No. 258, the
Ontario Teachers' Federation because he is employed by the District School Board of
Niagara.
Alderman Craitor indicated a pecuniary interest on Report F-2000-57, Cheque Nos.
253957;54086; 254080 and 253890 because a member of his family is employed by the
Region.
Alderman Michalczyk indicated a pecuniary interest on Report F-2000~57, on
Cheque Nos. 254019 and 253965 because of his ongoing investigation and lawsuit.
Alderman Wing indicated a pecuniary interest on Report F-2000-57, on Cheque
Nos. 253930 and 254068 because she is an officer of the organization.

His Worship Mayor Thomson and Ms. Joanne Flack presented tokens of
appreciation to Kaitlyn Cadeddu, for her outstanding achievements at the Miss All
Canadian finals for three consecutive years in a row.
2000 Summer Trillium Awards
His Worship Mayor Thomson introduced Mrs. Eloise Schumacher and Mr. Basil
Schumacher, who were in attendance on behalf of the Niagara Falls Horticultural Society;
Alderman Shidey Fisher and Alderman Paisley Janvary-Pool, Chair of the Environmental
Planning an Greening Committee and Mayor Thomson presented the 2000 Summer

Community_ Access Proo_ram
Ms. Heather Barfoot, Project Coordinator, Niagara College, Ventures provided
Background information on the Urban Community Access Program and the Services
Available; she referred to the Four Community CAP Sites in Niagara Falls; advised that this
program represented a prime opportunity to increase computer literacy in Niagara Falls
and requested Council's endorsement of the program.
Following the presentation, it was ORDERED on the motion of Alderman Craitor,
seconded by Alderman Campbell, that Council endorse the Community Access Program.

Local Architectural Conservation Advisory Committee
Mrs. Margaret Mingle, a member of the Local Architectural Conservation
Advisory Committee, provided an update on the various activities of LACAC, reviewed
properties of historical and/or of architectural interest, through the use of slides; referred
to the creation of a Web Page featuring historically-interesting properties which are
available for sale and to the designation of properties through the dedication of plaques;
referred to the administration of a Provincial Grant program, whereby owners of designated
hedtage properties could receive a rebate on their Provincial Sales Tax.

Activities. The report recommends that the Council receive the presentation by LACAC
for information purposes.

MAYOR'S REPORTS. ANNOUNCEMENTS. REMARKR
Sian Policy
His Worship Mayor Thomson referred to billboards situated at the comer of Garner
Road and Lundy's Lane and of billboards situated at Stanley Ave., past Robinson and
requested that staff prepare a report regarding the City's sign policies.
ORDERED on the motion of Alderman Janvary-Pool, seconded by Alderman Pietrangelo,
that staff provide an intedm report with respect to the City's Billboard & Sign Policies. The
motion Carded, with Alderman Feren abstaining from the vote on a conflict of interest and
with all others voting in favour.
Shortaoe of Doctors and Suroeons in the Niaqara area
His Worship Mayor Thomson discussed the issue of the shortage of doctors and
surgeons in the Niagara area and advised that Dr. David Dek, among others, has been
actively trying to bdng General Practitioners to our community to fill the doctor vacancy and
requested that Council and staff become actively involved and committed to this situation.
Following the discussion, it was ORDERED on the motion of Alderman Janvary-
Pool, seconded by Alderman Feran, that a resolution be forwarded to our Provincial and
Federal members advising them that the situation is unacceptable and that the City will
actively pursue acquiring new doctors into the area. ~
COMMUNICATIONS
Communication No. 258. Ontario Teachers' Federation - Re: Proclamation -
requesting that Council declare October 5, 2000 as "World Teachers' Day" in Niagara
Region.
ORDERED on the motion of Alderman Fisher, seconded by Alderman Ioannoni, that the
request be approved. The motion Carried with Aldermen Campbell and Pietrangelo
abstaining from the vote on conflicts of interest previously noted and with all others voting

RATIFICATION OF CORPORATE SERVICES COMMITTEE ACTIONS
ORDERED on the motion of Alderman Pietrangelo, seconded by Alderman Feren, that the
actions taken in Corporate Services Committee, earlier this evening be approved:
Adoption of the Minutes of September 11, 2000 Corporate Services Committee
Meeting;
Report F-2000-57 - Municipal Accounts - that Council approve the municipal
accounts totalling $1,113,062.17 for the period ending September 25, 2000;
Report F-2000-58 - Amendmer~t to Water By-law to Secure Revenues - that the
report be deferred for further staff investigation;
Report F-2000-59 - City of Niagara Falls Banking Services - that the agreement for
banking services between theI City and the Bank of Nova Scotia be extended in
accordance with our option for t. he period of November 1, 2000 to October 31,2003;

Report HR-2000-06, WSIB Ac~ Jarial Liabilities - the report recommends that the
following recommendations s..~bmitted by Nexus Actuarial Consultants Ltd. be
approved by Council: - establish a workplace injury reserve fund to finance the
actuarial liabilities for workplac~ injury claims; establish a target of fully funding the
actuarial liabilities for workpla;:e injury claims by a specific year such as 2010 or
2015; continue to pay for 2000 and earlier claims as the City has in the past on a
pay-as-you-go basis (Currently in the range of $250,000 to $300,000 per year);
make additional annual contnbutions of between $150,000 and $250,000 to the
reserve fund beginning no latar than 2001; and purchase excess loss insurance
annually (at a cost of about 7;12,000 per year) to cover the costs of injuries in
excess of $250,000 until such time as the reserve fund reaches $2,000,000;
Communication - Youth Chailenge International - that the thank you letter be
received and filed;
7. New Business:
-that the City participate in the "Dreams Take Flight" event on September 30th in the
amount of $130.00;

is recommended that 1) parking be restricted at all times on the north side of Murray
Street from Main Street to Finlay Avenue; 2) that a comer parking restriction be

metres west of Main Street; and 3) that the Niagara Regional Police provide stdct
and frequent enforcement of the heavy vehicle restriction on Murray Street;

1) a) two hour parking be implemented on the west side of Dorchester Road
from a point 10 metres south of Leeming Street to Lundy's Lane; b) residents
on the west side of Dorchester be permitted to obtain a residential parking
permit provided that they meet the necessary cdteda;

a) a comer parking restriction be implemented on the both sides of High
Street from Dorchester Road to a point 10 metres west of Dorchester Road;

Site to The Regional Municipality of Niagara. The report recommends that land known
as the Mountain Road Landfill Site be conveyed to The Regional Municipality of Niagara.

NO. 23 - CAMPBELL - FEREN - WHEREAS By-law No. 91-232 provides that Letter of
Credits will be only accepted by the banks listed on Schedule "A" attached thereto; AND
WHEREAS Kraft Canada Inc. is requesting that the City accept a Letter of Credit in the
amount of $193,000.00 CDN as security for its Niagara Buffer Warehouse Construction
Project from Citibank which is a bank not listed on Schedule "A" of By-Law No. 91-232;
AND WHEREAS the City is prepared to make an exception on certain terms and
conditions.
THEREFORE BE IT RESOLVED that the City of Niagara Falls accepts an Irrevocable
Letter of Credit in the amount of $193,000.00 CDN from Citibank in a form satisfactory to
the City Solicitor; FURTHER BE IT RESOLVED that this acceptance be an exception to
By-law No. 91-232; AND the Seal of the Corporation be hereto affixed.
NO. 24 - WING . FEREN - WHEREAS the Council of the City of Niagara Falls has
supported AMO advocating on behalf of Ontado municipalities for the Model Gas Franchise
Agreement review process; AND WHEREAS Enbddge Consumers' Gas has applied to the
Ontado Energy Board for a substantial rate increase in the year 2000 resulting in an
average household increase of $225 per year; AND WHEREAS the City of Niagara Falls
does not support this increase and requests AMO to represent Ontado municipalities at the
Hearing in opposition to the proposed rate increases; NOW THEREFORE BE IT
RESOLVED by the Municipal Council of the City of Niagara Falls that AMO be requested
to represent Ontario municipalities at the Energy Board Headng in opposition to the
application by Enbddge Consumers' Gas rate increases.AND the Seal of the Corporation
be hereto affixed.

Overhead Helicopters in
Alderman Shirley Fisher provided information as to the reason that helicopters were
flying overhead in the area of the new golf course construction in Chippawa. She advised
that Niagara College was video chronolodging the Niagara Parks Commission's golf course
construction from the air and was using Niagara Helicopters for this endeavour.

ORDERED on the motion of Alderman Orr, seconded by Alderman Feren, that a letter of

Traffic Congestion at Portage Road and Marineland
Alderman Shidey Fisher expressed concerns with respect to the traffic congestion
and local traffic in the Portage Road and Marinela ~d area and requested that the matter
be referred to staff and that a traffic study be cond.lcted in the area.

resolution expressing Council's opposition to the proposed residential gas rate increase

Molson SIo-Pitch Tournamen~
Alderman Carolynn Ioannoni discussed the concems expressed by the Cherrywood
Acres School parents regarding slo-pitch tournaments being held dudng school hours on
Fddays. She requested that no games take place on all elementary school diamonds
dudng school hours on ,Fddays and that a report be Prepared (post mortem) regarding the
events.
Following some discussion, it was ORDERED on the motion of Alderman Ioannoni,
seconded by alderman Wing, that no games take place on all elementary school diamonds
during school hours on Fridays, and that a report be prepared (post mortem) with respect
to the events. The motion .~ with Aldermen Campbell and Pietrangelo abstaining
from the vote on conflicts of interest and with all others voting in favour.

L-2000-79 - Millennium Gateway Proiect (Archie Thompson) City-Owned Land near

ORDERED on the motion of Alderman Campbell, seconded by Alderman Feren, that
should the purchaser not submit the necessary documentation to complete its planning
applications on or before September 26, 2000, that the City Solicitor be authorized to
advise the purchaser in writing, that, pursuant to Paragraph 6.2 of the Agreement, the
Agreement is terminated due to the failure of the purchaser to submit the necessary
documentation 'and' the d~posit and all accrued 'interest thereon be forfeited to the City.
