this national event is to raise awareness about rail safety, and to highlight the ongoing

RESOLUTION IN SUPPORT OF PUBLIC - RAIL SAFETY WEEK
Whereas Public - Rail Safety Week is to be held across Canada from April 24 to 30,
2017
Whereas it is in the public's interest to raise citizens' awareness on reducing
avoidable accidents, injuries and damage caused by collisions at level crossings or
incidents involving trains and citizens;
Whereas Operation Lifesaver is a public/private partnership whose aim is to work with
the rail industry, governments, police services, the media and other agencies and the
public to raise rail safety awareness;
Whereas Operation Lifesaver has requested City Council adopt this resolution in

Re: Proposed Car Wash-land between 7081 &7149 McLeod Road
Dear Mr. Herlovitch:
Thank you to you and your staff for being patient with us in considering this
application.The negative nature of your report has caused us a great deal of
concern.We feel that our application has merit. I have reviewed your planning
report PBD-2016-36 and have the following comments:
• The Executive Summary states the proposed use would be "an intrusion of a
commercial use in the middle of a Residentially designated area':This
statement is mis-leading since to the east of the subject property is a church,
to the south is a commercial plaza and a cogeco office building,to the west
are four single detached dwellings and to the north is a residential area.The
four single detached dwellings are probably amoung the oldest buildings
fronting onto McLeod Road and as such the properties fronting along McLeod
Road in this area should be described as an area in transition from
residential to commercial
• The second point in the Executive Summary states that: "the lands are
insufficiently sized to accommodate the use as reflected in the number of
departures necessary to the City's Zoning standards".The City s Zoning By-law
79-200 was passed in or about 1979 and has been amended hundreds of
times.The provisions of a Zoning By-law that is over 37 years old cannot be
considered relevant in todays planning context.So the statement in your
report is again mis-leading.We hired a professional designer and a traffic
engineer to develop a site plan that works.Your statement appears to ignore
those efforts.
• The final point in your executive summary states that: "The lands would be
more appropriately developed with a multiple unit dwelling".This is
impossible.The property has insufficient lot area to accommodate any
meaningful multiple unit dwelling building.Such a building would likely be

two storeys or more in height and there would be overlook on the abutting
properties. Parking would be an issue and underground parking is cost
prohibitive at$30000 as space.The deed to the land describes the property
as lot 79 and 80 Plan 193.As such it would be possible if the right zoning was
in place to construct two single detached dwellings. However this would
totally ignore the noise generated by McLeod Road. The property owner and
myself met initially on site and we had to yell at each other to exceed the
noise generated by the traffic noise from McLeod Road. Given this noise issue
and the close proximity of McLeod Road residential development is not
appropriate.
• The application was circulated to a variety of other agencies and City
Departments.There was no objection to the use.A number of design issues
were raised that can be best addressed through the site plan agreement
process.
• The report notes three letters from area residents and the results of the
Neighbourhood Open House. However we provided a detailed response to
the area residents concerns and that response is not included in the Planning
Report
In summary the subject property fronts onto McLeod Road,which is a major arterial
road in the City of Niagara Falls.The traffic noise generated from McLeod Road is
significant and will have a very negative impact on any proposed residential use.
The current zoning is institutional. However any permitted institutional use or
commercial use is impossible to develop given the size of the property and the need
to provide sufficient parking, setbacks and a viable building size._The proposed car
wash is the most appropriate use for the property and will act as a buffer from the
noise along McLeod Road to the residential homes to the north of the subject
property.

Dear Niagara Falls City Council members,
I was born and raised in Niagara Falls and I am the Founder and President of a local not-for-profit charitable organization
called Dreams to Beams,which was founded in 2014. Dreams to Beams does local and international projects. Locally we
do community gardens to help supply local meal programs, clothing drives to support local affordable clothing stores
and we sponsor families in need at Christmas. Internationally we have done food security and poverty reduction work in
Peru,sponsored numerous single mothers of disabled children to be job trained and become economically self-
sufficient in Nicaragua and presently we are in the middle of a food security and poverty reduction project in Namibia.
On May 4th we are holding a fundraiser at Boston Pizza at the Americana Hotel on Lundys Lane. A$20 ticket wil get a
person a 2 item individual pizza and beverage or a salad,selected pasta dish and beverage. All beverages are non-
alcoholic.
I am humbly asking members of City Council to support our evening with the purchase of tickets. Any donation would be
greatly appreciated. Funds raised will go to support all Dreams to Beams projects.
