WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if
the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act,
2001.
WHEREAS s. 239(7) of the Act mandates that the municipality or local board or a
committee of either of them shall record without note or comment all resolutions,
decisions, and other proceedings at a meeting of the body whether it is closed to the
public or not; and
WHEREAS s. 239(8) of the Act requires that the record required by subsection 239(7)
shall be made by the Clerk of the Corporation in the case of a meeting of council; and
WHEREAS on April 25, 2017 Niagara Falls City Council will be holding a Closed
Meeting as permitted under s. 239(2)(b) and s. 239(2)(e) of the Act, for matters that
pertain to personal matters and for litigation or potential litigation; and
WHEREAS due to the nature of the discussion of the in the Closed Meeting, it is not
appropriate for City staff to be in attendance, save the Director of Human Resources
("HR") and the Chief Administrative Officer (CAO); and
WHEREAS s.228(4)of the Act permits the Clerk the discretionary authority to delegate
in writing to any person, other than a member of council, any of the clerks powers and
duties under the Act; and
THEREFORE BE IT RESOLVED that on April 25, 2017 at 4:30 p.m., Niagara Falls City
Council will go into a closed meeting, prior to their regularly scheduled meeting at 5:00
p.m., to consider matters that fall under s. 239(2)(e), litigation or potential litigation
related to assessment at 6380 Fallsview Boulevard, and s. 239(2)(b) personal matters.
FURTHER BE IT RESOLVED THAT on April 25, 2017 the Acting City Clerk, Bill
Matson, delegates his authority for the purpose of the Closed Meeting to the Director of
HR, Trent Dark; and
FURTHER BE IT RESOLVED THAT the Director of HR will record without note or
comment all recommendations to Council emanating from the Closed Meeting; and
FURTHER BE IT RESOLVED THAT the Acting Clerk will resume his duties upon
conclusion of the Closed Meeting agenda.

Investment in Communities

— $361,000 to help make Niagara Specialized Transit more affordable by bringing fares into parity for
traditional transit

I was given your name and email address from Heather, who was a great assistance to me last year in
successfully getting Niagara Falls to proclaim the month of May as North American Brain Tumour Awareness
Month. I am kindly asking for the same considerations for 2017.
Every day 27 Canadians hear the words"you have a brain tumour." Brain tumours cause changes in mobility,

vision, cognition and personality, and profoundly alter the lives of patients, their families and their
communities.
I have been personally affected by a brain tumour which is how I became involved with Brain Tumour
Foundation of Canada.
May 20th is important to me, it is the day the doctors discovered my brain tumour in 2014, which turns out is an
oligodendroglioma. Although it is benign (thankfully), because my awake craniotomy was unsuccessful in
removing it, I had radiation in October 2014, and 114 days of oral chemo ending in December 2015, to see if
they can sterilize it. I have had many set backs along the way to recovery, including a major staph infection in
the bone that was removed from my craniotomy. I had a picc line for 10 weeks after the bone was removed. In
Sept 2014, a fake bone plate was put back in, but because the incision had been reopened 3 times, it did not
fully heal, leaving me with exposed bone plate until September 4, 2015, where I had to have a complete scalp
rotation and skin graft, which I am still recovering from. It has been quite the ride because of this tumour. We
originally named him Kevin, but when my neurosurgeon was only able to remove about 10% of it, we dropped
the k and call it Evin now. I call it 'my tumour humour'. But at the end of the day, it has still been a very long
road, and am now dealing with the trauma of it all with a bit of depression and anxiety. I look forward to the
day when this journey is behind me, and I have faith in my team that our ultimate goal of returning me to my
full life is absolutely going to happen.
Last year, i was interviewed by Cheryl Clock from the St. Catharines Standard for an educational article and
advocacy for brain tumour awareness. Although I am now a resident of Thorold, I lived in Niagara Falls for 15
years, and both my children were born at GNGH.
The most common tumours are incurable, although patients undergo extensive treatment aimed at controlling
the disease. Brain tumours are the most common cause of cancer—related death in children under 20. In adults,
glioblastoma is the most common type of brain tumour; life expectancy with treatment is around 12-18months.
There is no known cause of brain turnours,therefore, there are no prevention strategies.
For several years the month of October was recognized as Brain Tumour Awareness Month. This year, for the
second time,the Brain Tumour Foundation of Canada are highlighting the month of May as Brain Tumour
Awareness Month in order to align with efforts in the United States to create a North American Brain Tumour
Awareness Month. They hope that the increased awareness from this cooperative coalition will bring greater
support for the cause.
Please help raise awareness about this terrible disease and support our efforts to advocate for research leading to
better treatments and improved access to care for patients and their families.

and treatment is vital to prolonged and improved survival;
WHEREAS, current information indicates that 27 Canadians are diagnosed with a brain
tumour every day;

all economic, social and ethnic boundaries;

Event Organizers: Celebrate Old Downtown Community Corp
Event: Cruising on the Q
Dear Members:
Celebrate Old Downtown Community Corp. (COD) is a not-profit organization with a
mandate to promote the downtown core through events. The COD is planning a number
of street events throughout the 2017 year in co-operation with other event organizers. Our
first event will start on May 2nd " Cruising on the Q" in which we will be inviting all car
enthusiast to bring their rides to the downtown core.
Street Closure: We would kindly request permission to close Queen Street from St.
Lawrence to St Clair. Please keep both St Lawrence and St Clair open for vehicle traffic.
This section of Queen Street will become a pedestrian only area. We would like the
closure to happen every Tuesday from 6pm to 9pm starting on May 3th and ending on
October 3rd.We respectfully request that Council waive the costs of these street closures.
A complete layout of the event will be submitted to Parking Operations and
Transportations Services in the near future.

A by-law to prohibit certain uses of land in the area of the City of Niagara Falls regulated
by Zoning By-law Nos. 79-200, as amended; 1538, 1958, as amended; 395, 1966 as
amended; and 70-69 as amended.
WHEREAS section 38 of the Planning Act provides that where a council of a local
municipality has directed, by by-law or resolution, that a review or study be undertaken,
the council may pass a by-law (referred to as an interim control by-law) to be in effect
for a period of time specified in the by-law, prohibiting the use of land, buildings or
structures within the municipality or within the defined area or areas thereof for, or
except for, such purposes as are set out in the by-law;
AND WHEREAS the Council of the Corporation of the City of Niagara Falls has, by
resolution adopted on the 28th day of March, 2017, directed that a review or study be
undertaken in respect of the land use planning policies and zoning regulations
respecting the use of properties that are zoned as or used as a boarding or rooming
house.
AND WHEREAS the land uses described are within the area for which such review or
study is to be undertaken.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. No person shall use any land, building or structure within the City of Niagara
Falls as a boarding or rooming house.
2. This by-law shall be in effect for a period of one year from April 25, 2017 to April
26, 2017.

5 KEY GOALS
To make our mission a reality, by 2020 we will achieve the following key goals:
1. ADVOCACY& BUILDING PARTNERSHIPS: Political advocacy for our BIA will ensure our
members can thrive, succeed and grow. To support Tourism by supporting investments
with the Scotiabank Convention Centre, Winter Festival of Lights,the new Falls
Illuminations, New Year's Eve Concert and other major tourism sponsored events.
2. STREETSCAPING I BEAUTY: continue to work with the City of Niagara Falls to ensure
that the entire BIA is streetscaped to the new design standards as set in the first phase
of the streetscaping project that started in 2016.
3. BRANDING & MARKETING: To create and maintain 'sense of place' beautification
treatments to our designated geographical territory through, banners, hanging baskets
and other decorative features. Support a strong website and social media presence
whose main function is to ensure it has a growing presence with the search engines,
with a primary function of referring business to stakeholders.
4. ENGAGEMENT of the pedestrian traffic by investing in animated assets and or lighting
techniques will entice traffic down the full length of the street
5. PUBLIC PERCEPTION I CLEANLINESS:To hold the City accountable to uphold all by-laws
that support the Victoria Centre BIA in its pursuit of presenting itself as a safe, clean and
vibrant tourism destination and to ensure those by-laws are executed effectively and a
timely manner.
