08/14/2018 - B&BThe City of Niagara Falls, Ontario Resolution August 14, 2018 Moved by: Councillor Thomson Seconded by: Councillor Pietrangelo WHEREAS the City initiated Official Plan and Zoning By-law Amendment Application AM -2017-005, establishing policies and zoning regulations for Bed and Breakfasts and Vacation Rental Units, was approved by City Council on April 10, 2018; and WHEREAS the April 10, 2018 meeting complied with the requirements of the Planning Act to hold one statutory public meeting to provide notice of such meeting; and WHEREAS at its April 10, 2018 meeting, Council directed staff to report back on various matters, including permitting a Bed and Breakfast in an owner occupied dwelling versus a manager occupied dwelling; and WHEREAS at its July 10, 2018 meeting, Council directed that a Bed and Breakfast is to be restricted to an owner occupied dwelling; and WHEREAS a detached dwelling is not a permitted use in the Tourist Commercial (TC), General Commercial (GC) and Central Business Commercial (CB) zones; and WHEREAS the proposed Zoning By-law for Vacation Rental Units has been refined to clarify only an existing detached dwelling may be used for a Vacation Rental Unit; and WHEREAS the modifications do not change Council's approval, as summarized in report PBD -2018-63. THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of Niagara Falls hereby determines, in accordance with Section 34(17) of the Planning Act, R.S.O. 1990, that the change to the proposed Zoning By-laws for application number AM -2017-005 regarding a City initiated amendment for Bed and Breakfasts and Vacation Rental Units is minor in nature and does not require any further notice.
