04/30/2019 - DRAFT APPROVED PLAN OF VACANT LAND CONDOMINIUM - 8196 MCLEOD RD - NO. 2The City of Niagara Falls, Ontario Resolution No. 2 Moved by: Councillor Pietrangelo Seconded by: Councillor Campbell April 30, 2019 WHEREAS subsection 51(45) of the Planning Act, 1990 R.S.O requires a written notice of a change made to the conditions of approval of a draft plan of vacant land condominium by the approval authority; and WHEREAS notwithstanding the requirement for the written notice for a change to the conditions of approval of a draft plan of vacant land condominium, subsection 51(47) of the Planning Act , 1990 R.S.O allows a municipality to deem such requested changes minor by passing a resolution; and WHEREAS Bruno Galante requested Council to consider passing a resolution that would deem the change to the conditions of approval of the Draft Plan of Vacant Land Condominium for 8196 McLeod Road (26CD-11-2018-010) as minor and not require circulation of a written notice; and WHEREAS Council determined that it was unnecessary to require Bruno Galante to install automatic fire sprinklers in the proposed townhouse units in the Draft Approved Plan of Vacant Land Condominium for 8196 McLeod Road and as such that Condition No. 18 previously applied was also unnecessary. THEREFORE BE IT RESOLVED that subject to subsection 51(47) of the Planning Act, 1990 R.S.O Council deems the change to the conditions of approval for the Draft Plan of Vacant Land Condominium for 8196 McLeod Road as minor and exempts the requirement for circulating a written notice.
