06/04/2019 - In CameraThe City of Niagara calls, Ontario Resolution June 4, 2019 Moved by: Councillor Mike Strange Seconded by: Councillor Chris Dabrowski WHEREAS all meetings of Council are to be open to the public; and WHEREAS the only time a meeting or part of a meeting may be closed to the public is if the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act, 2001. WHEREAS s. 239(7) of the Act mandates that the municipality or local board or a committee of either of them shall record without note or comment all resolutions, decisions, and other proceedings at a meeting of the body whether it is closed to the public or not; and WHEREAS s. 239(8) of the Act requires that the record required by subsection 239(7) shU ll be made by the Clerk of the Corporation in the case of a meeting of council; and WHEREAS on June 4, 2019 Niagara Falls City Council will be holding a Closed Meeting as permitted under s. 239(2)(b) for matters that pertain to personal matters about an identifiable individual, s. 239(2)(e) of the Act for litigation or potential litigation, including matters before administrative tribunals, s. 239(2)(f) for advice that is subject to solicitor - client privilege, including communications necessary for that purpose, s. 239(2)(d) for labour relations or employee negotiations, and s. 239(3.1) for the purpose of educating or training the members of council. WHEREAS due to the nature of some of the discussion of the Closed Meeting, it is not appropriate for City staff to be in attendance when the personal matter is discussed, save the Director of Human Resources ("HR"), the Solicitor and/or the CAO, if required; and WHEREAS s.228(4)of the Act permits the Clerk the discretionary authority to delegate in writing to any person, other than a member of council, any of the clerks powers and duties under the Act; and THEREFORE BE IT RESOLVED that on June 4, 2019 at 3:30 p.m., Niagara Falls City Council will go into a closed meeting, prior to their regularly scheduled meeting at 5:00 p.m., to consider matters that fall under s. 239 of the Act. FURTHER BE IT RESOLVED THAT on June 4, 2019 the City Clerk, William Matson, delegates his authority for the purpose of a portion of the Closed Meeting to the Director of HR, Trent Dark; and FURTHER BE IT RESOLVED THAT the Director of HR will record without note or comment all recommendations to Council emanating from the Closed Meeting; and FURTHER BE IT RESOLVED THAT the City Clerk will resume his duties upon conclusion of the Closed Meeting agenda.
