Diodati and Members of Municipal Council SUBMITTED BY: Chief Administrative Officer SUBJECT: Niagara Region Transit Service Delivery and Governance Strategy Report (Dillon Report) RECOMMENDATIONS 1. Niagara Falls City Council endorses in principle the creation of a consolidated transit system in partnership with the City of Niagara Falls, St. Catharines Transit Commission, the City of Welland, and the Region of Niagara to develop a regionally integrated transit system. 2. Staff be directed to develop a Memorandum of Understanding (MOU) between Niagara Falls, St. Catharines, Welland and Niagara Region to develop a governance framework and specify how key issues are to be addressed by all parties along with next steps and timelines. 3. Niagara Falls City Council hereby requests that Niagara Region become formally involved in and supportive of the consolidated transit model as recommended in the January 2017 Niagara Transit Service Delivery and Governance Strategy Report (Dillon Report) and endorsed by the Inter-Municipal Transit working group. 4. Council supports the formation of the Transit Working Group, with representatives from the 12 Municipalities and the Region of Niagara, to work towards the implementation of the operational improvements outlined in the Dillon report. 5. Council supports the transition of the current Inter Municipal Working group to a Transit Steering Committee until a new governance framework is established in the pending Memorandum of Understanding. BACKGROUND In 2010, the City of Niagara Falls, St. Catharines, and Welland made a proposal to Regional Council to create a tri-city transit service which the three cities would operate, to be funded by the Region and called Niagara Region Transit. The NRT was to operate for 3 years with the intent that if successful, transit would be uploaded to the Region through a Triple Majority process. Regional Council approved the proposal by a solid majority and in September 2011 Niagara Region, the City of Niagara Falls, the St. Catharines Transit Commission and the City of Welland entered into a pilot project agreement to formalize the provision of inter-municipal transit services. 2 CAO-2017-002 February 28, 2017 Funded by the Niagara Region and jointly operated by Niagara Falls Transit, St. Catharines Transit and Welland Transit ("transit operators") the Niagara Regional Transit pilot provides transit connections to the communities of St. Catharines, Thorold, Niagara Falls, Welland, Niagara-on-the-Lake, Port Colborne and Fort Erie. In May 2015, prior to formalizing the NRT as a permanent inter-municipal transit service and securing triple majority support from local municipalities, Regional Council agreed to ask the cities of Niagara Falls, St. Catharines and Welland, as transit operators, to work together to present a new model to the whole region. At its meeting on June 23, 2015, City Council passed the following motion: "That Council support the transits of St. Catharines, Niagara Falls and Welland working together on how to best provide inter-municipal transit." Since January 2016, an Inter-Municipal working group of mayors, CAOs and staff from the local municipalities and Niagara Region have been working together to identify alternative service delivery and governance options for inter-municipal transit services. With support from staff and transit managers, the working group hired Dillon Consulting to develop potential options for the future delivery of inter-municipal transit services for consideration. The working group identified key guiding principles in their work: • Customer driven: continuously improve, respect established local service • Unconventional solutions: investigate leading-edge technologies, explore partnerships • Integrated: be seamless with other modes of transportation, integrated with daily GO train service, connect at hubs • Economically responsible: balance costs, investments, explore alternative modes of delivery • Fair: respect existing investments of communities, collective agreements and respect for taxpayers Between February and December 2016 the consulting team met with transit managers, stakeholders, transit union representatives, employers and transit users as well as representatives of each of Niagara's 12 municipalities to discuss the region's transit needs and challenges. In fall 2016 Dillon presented interim findings and recommendations to local councils and the public to seek feedback. In January 2017, the team presented the final recommendations in the report "Niagara Transit Service Delivery and Governance Strategy." The Strategy outlines a recommendation for a consolidated transit system for the region and identifies service and technology enhancements including fare integration, trip planning, smart card technologies and dynamic transit options. Also, in January, 2017, Regional Council extended the IMT Pilot Project to allow time for decisions to be made regarding the future of transit in the Niagara Region. 3 CAO-2017-002 February 28, 2017 Throughout this work, the working group and transit managers have found cooperative ways to make the existing NRT pilot transit services the best they can be, to continue to grow ridership and improve the service. This includes a number of improved route changes to fulfill post-secondary student needs and service the new outlet mall which started in September 2016. Also, a trip planner is now in place using the Transit App. ANALYSIS/RATIONALE City Council has identified the importance of public transit to enhance economic development. This was identified in Council's 2015-2018 Strategic Priorities. Council also supported that the transits from Niagara Falls, St. Catharines, Welland and the Region work toward providing improved Inter-Municipal Transit. Combining local and inter-municipal transit offers a number of benefits: • Providing cross-boundary mobility to education and post-secondary institutions (Brock University, Niagara College), employment opportunities, medical and social services • Supports transit ridership to future GO train service, reducing local congestion and creating transportation options • Facilitates economic development by businesses seeking a connected and accessible workforce • Contributes to a high quality of life for residents • Supports sustainable community development While the economic benefits of transit can be measured, other benefits of investing in public transit are not always quantifiable. Access to employment, education, health and services, reduced localized congestion and the ability to attract economic development and a growing (and aging) population are benefits that serve an immeasurable public good for the city and the greater economic region of Niagara. Integration with Daily GO Train Service In June 2016, the provincial government announced that daily GO train service to Niagara will commence by 2021 to Grimsby and by 2023 to Niagara Falls and St. Catharines. The Niagara GO business case and related studies estimate that the local investment towards GO service will be approximately $40 million which has been committed through Niagara Regional Council. With GO Transit rail service being announced for Niagara Falls in 2023, an integrated transit network that is able to seamlessly connect with GO is necessary for optimal service delivery, not only within the City, but to and from neighbouring municipalities as well. WEGO Visitor Transportation System WEGO is a visitor transportation system that has been servicing the tourism core since 2012. It is owned by the City of Niagara Falls and is operated by the City (Red and Blue Lines) through an operating agreement with the Niagara Parks Commission (Green and 4 CAO-2017-002 February 28, 2017 Orange Line). It is not to be considered part of the service delivery governance review and will remain under the control of the City of Niagara Falls. Dillon Report The study addresses two components: 1. Governance recommendations related to integrated transit in the region; and 2. Operational recommendations to improve inter-municipal transit services including the structure of routes, services, fare integration and payment technology and trip planning. Recommendations #1, #2, and #3 of this report deal with the governance recommendations of the Dillon Report. In recommendation #4 of this report, the Dillon Report and its recommendations related to the operational recommendation, are to be referred to the Transit working group. The final report presents a governance strategy that recommends a consolidated transit model that would see Niagara Falls, St. Catharines and Welland Transit systems combine their services into one large consolidated transit system. The report states that there are many details yet to be worked out in terms of spending authority and service design decision making. Dillon does make clear that the Region must be formally involved in funding and decision-making of inter-municipal routes. The recommendation for consolidation calls for the creation of a new governing body such as a municipal service board or commission made up of representatives from Niagara Falls, St. Catharines, Welland and Niagara Region with advisory representation from Niagara's municipalities involved with connecting transit services. The detailed report and recommendations from the Dillon Report are to be referred to the Transit Working Group who will continue to work towards the implementation of the recommendations outlined in the study. The report recommends improvements to inter-municipal transit services in Niagara by: • Increasing the frequency of inter-municipal service so that buses arrive every 30 minutes during peak periods • Extending service hours so that transit is available later in the evening • Extending full weekend service that would have inter-municipal transit operating on Sundays • Eliminating duplicate routes and services to be reinvested • Improving integration with other municipal transit systems • Creating a new Niagara-West inter-municipal transit link • Adding new dynamic transit services for low-demand and rural areas • Integrating fare strategy, payment technology and trip-planning. 5 CAO-2017-002 February 28, 2017 Next steps The Dillon Report outlines next steps: 1. Reach triple majority on the Region's involvement in transit. The Niagara Region does not currently have jurisdiction under the Municipal Act, 2001, to be directly involved in transit services without triple majority support from area municipalities. Independent legal opinion sought through the working group has confirmed that this triple majority approval is required even if the desire is to maintain the status quo system set up through the NRT pilot. The recommendation calls for the Region to be given "partial authority" for transit as it related to Inter-Municipal connections. The Region would need to pass a by- law to upload part of the lower-tier municipal jurisdiction to participate in operating and maintaining a public transit system, conditional upon obtaining a triple majority vote. Authority would only relate to "Inter-Municipal jurisdiction". Local municipalities would not give up "local control" of the current systems. The strategy recommended will not "regionalize" transit as a Niagara Region service, but as a cooperative, consolidated service delivery structure which may be compared to other cooperative regional arrangements such as provincial offense court services which is run through a joint management board. 2. Negotiate an MOU related to consolidated transit model. Secure agreement and commitment by all municipalities involved to work together and implement the strategic direction through a signed memorandum of understanding to further develop the implementation plan. 3. Refer the Dillon Report to the Transit working group to continue work on operational issues. Although the Dillon strategy outlines an aggressive timeline for implementation in 12 months, the working group is recommending a less aggressive implementation strategy and phased-in approach based on staffing and resources, respect for the cooperative nature of the working group and the need for municipal council support, as well as potential opportunities for financial support and transit incentive programs from other levels of government. Municipal CAO's and transit managers are recommending that, pending the finalization of an MOU related to a consolidated model, 2 new formal bodies be created to oversee implementation: a Transit Steering Committee (made up of the current Inter Municipal Working Group, with two additional regional members) and a Transit Working Group, outlined below. 6 CAO-2017-002 February 28, 2017 INTERIM TRANSIT MODEL Council City of Niagara Falls City of St. Catharines City of Welland Region of Niagara Transit Steering Committee: a governing body made up of representatives of: • 2 City of Niagara Falls • 2 City of St. Catharines • 2 City of Welland • 4 Niagara Region (the current two representatives plus 2 representatives from Niagara municipalities which do not operate their own transit service) Responsibilities to: • Direct the work of the Transit Working Group • Approve MOU to be presented to the Municipalities • Coordinate branding and marketing of transit service • Government relations and advocacy (i.e. funding opportunities) • Unified Niagara voice for transit (Note, this group will disband once the new governance framework is approved) Transit Working Group: inter-municipal staff group, reports to Steering Committee • Transit managers of each municipal service • 1 representative from each non-transit municipality • 1 Niagara Region representative Responsibilities: • Procurement/ purchasing transit capital needs • Development of proposals for fare boxes, technology, policies, customer service structure, service guidelines • Route optimization and coordination • Coordination with other transit providers (GO transit, Metrolinx, Hamilton Street Railway) • Coordination with post-secondary schools and private carriers • Liaise with economic development and planning offices • Union contracts and standardization of standard operating procedures (SOPs) (Note, this group is anticipated to become permanent and codified in the MOU) Dillon Report: Niagara Region Transit Service Delivery and Governance Strategy Report 7 CAO-2017-002 February 28, 2017 The interim model recommended will build on the successful coordination and cooperation between the existing transit providers throughout the duration of the NRT pilot and the working group's exercises since January 2016. The transit managers have played an integral role in implementing new routes, scheduling changes new strategies to improve transit services with a cooperative and user-focused perspective. The introduction of routes 40/45 and a new trip planner are two recent examples of this. This interim model to formalize the Transit Working Group and Steering Committee will continue to build on the positive momentum and success of the working group while financial, legal and governance decisions to implement the consolidated strategy are developed. FINANCIAL/STAFFING/LEGAL IMPLICATIONS The Dillon Report identifies the need for a number of additional studies as part of the next steps towards consolidation including organization and human resources support, legal support and fees, branding, marketing and more. The Strategy estimates one-time implementation costs between $700,000 and $1.3 million (to be shared between the three municipalities and the Region) for integration of technology (i.e. fare boxes and computer systems), City staff and the working group estimate that these transitional costs could be higher. Under the interim model, the City of Niagara Falls will continue to be responsible for all costs associated with the operation of both Niagara Falls Transit and WEGO. The Region will continue to fund and be responsible for all funding related to Inter-Municipal Transit routes. CITY'S STRATEGIC COMMITMENT The recommendations of this report support Council's 2015-2018 Strategic Priority of Economic Growth and Prosperity by strengthening public transit linkages between the municipalities to assist in the movement of people for employment and education. Diodati and Members of Municipal Council SUBMITTED BY: Finance SUBJECT: F-2017-07 Monthly Tax Receivables Report—January RECOMMENDATION That Council receive the Monthly Tax Receivables report for information purposes. EXECUTIVE SUMMARY This report is prepared monthly to provide Council with an update on the City's property tax receivables. Outstanding taxes as of January 31, 2017 were $12.5 million compared to $14.7 million in 2016. During January, tax receivables as a percentage of taxes billed decreased from 8.2% in 2016 to 6.8% in 2017. The City's finance staff has begun the tax collection process for properties that are subject to registration for 2017. There are currently twenty-five properties scheduled for tax sale in the next two years. BACKGROUND This report is being provided as part of the monthly financial reporting to Council by staff. It is also submitted to our banking institution for compliance with our banking agreement. ANALYSIS/RATIONALE Tax collection for 2017 improved during the month of January. Table 1 shows that taxes outstanding at January 31, 2017 are $12.5 million. This represents a decrease from $14.7 million in arrears for the same period in 2016. Finance staff continues to actively pursue property owners in arrears. Table 2 provides the breakdown of outstanding taxes by assessment class. The majority of outstanding taxes are for residential and commercial properties. The chart shows that the taxes owing from the commercial property class has decreased from a year ago, whereas the residential property class has increased. Finance staff takes specific collection actions for properties that are subject to registration. These action steps have been outlined in previous reports. At January 1, 2017, 317 properties were subject to registration. Table 3 summarizes the progress of these actions after one month of activity. This table shows 48.0% of the tax accounts or 152 properties have been paid in full or the owners have made suitable payment arrangements. During January, thirty-two accounts were paid in full. 2 F-2017-07 February 28, 2017 Finance staff continues to make every effort to have accounts paid in order to avoid the registration process and the associated costs related to that process. Table 4 identifies the properties and associated tax arrears scheduled for tax sales in the future. During the month of January, two registered properties were redeemed and one property was registered. The outstanding taxes for registered properties represents 5.8% of the total outstanding taxes at month end. FINANCIAL/STAFFING/LEGAL IMPLICATIONS Tax arrears as a percentage of taxes billed in a year is a performance measure that stakeholders utilize to analyse an organization's financial strengths. Niagara Falls, due to its high reliance on commercial assessment, is traditionally higher compared to municipalities of similar size. The percentage of taxes outstanding to taxes billed as at January 31, 2017 is 6.8% which is a decrease from 2016's value of 8.2%. The municipality has a record of full collection and earns significant penalty revenues to offset the higher measure. Diodati and Members of Municipal Council SUBMITTED BY: Finance SUBJECT: F-2017-08 2016 Sleep Cheap Event and WonderFalls Pass RECOMMENDATION For the information of council. EXECUTIVE SUMMARY The 2016 Sleep Cheap event raised $142,349. Overall, since its inception in 2004, the event has raised $1,733,669. On the recommendation of the committee, grants were issued to the selected recipients outlined in the attachment. The 2016 Sleep Cheap event was once again enhanced by the sale of the WonderFalls Pass. This pass provides Niagara Residents with an opportunity for discounted prices to some of Niagara Falls must see tourist attractions. The 2016 WonderFalls pass sales totalled $18,380. Staff recommends this amount to be transferred to a special purpose reserve for WonderFalls Pass sales to be used to improve parks and playgrounds in Niagara Falls. Overall, since its inception in 2015, the WonderFalls pass has raised $39,330. BACKGROUND Sleep Cheap is a fundraising event held annually in the City. The Sleep Cheap event is coordinated by the City in co-operation with members of the City's tourism industry. The grant recipients are required to submit applications for funding. These applications are reviewed and recipients are selected by the organizing committee. All groups seeking grants must apply to the committee annually. The WonderFalls pass is an initiative recommended to staff by Niagara Falls City Councillor Victor Pietrangelo with the goal of raising funds to not only improve the parks and playgrounds in Niagara Falls, but to make them more accessible. The pass provides Niagara Region residents participating in Sleep Cheap the opportunity to visit some of Niagara Falls must see tourist attractions at a significantly reduced rate. The program runs for the same period as the Sleep Cheap event. 2 F-2017-08 February 28, 2017 FINANCIAL/STAFFING/LEGAL IMPLICATIONS The various tourism operators contribute all of the funds raised during the Sleep Cheap event. Each of the contributing tourism operators receive a receipt for the funds collected and contributed to the City. A committee made up of a Councillor, City staff and tourism operators coordinate the event, collect the funds and determine the recipients for the monies raised. Attached is the committee's recommended list of recipients with the designated amounts. The various tourism operators and City of Niagara Falls locations contribute all the funds raised during the Sleep Cheap event for the WonderFalls Pass sales. Planning Staff recommends the application for the following reasons: • the Plan of Condominium will allow individual ownership of the units; • the condominium will provide housing choices to City residents and will contribute to the City's required 3 year short term housing supply; • all applicable planning policies have been applied to the project and there are no outstanding matters that need to be addressed by further public input; and • City interests will be addressed through the fulfillment of conditions contained in Appendix 1. 2 PBD-2017-06 February 28, 2017 BACKGROUND Proposal The applicant proposes to register a Standard Plan of Condominium on the 0.57 hectare (1.40 acre) parcel of land known as 5837 Dunn Street. Refer to Schedule 1 to locate the parcel. Site plan approval was granted in March, 2012 for the apartment building being built on the lands. The shell of the building is completed and interior walls are now being finished. The condominium will permit individual ownership of the 56 dwelling units. The driveway, surface parking area, amenity area and landscaped open space will be owned in common by the condominium. Schedule 2 illustrates the layout of the project. Circulation Comments • Regional Municipality of Niagara — No objections, subject to meeting the conditions listed in Appendix 1. • Municipal Works - No objections, subject to meeting the conditions listed in Appendix 1. ANALYSIS/RATIONALE The subject lands are zoned Residential Apartment 5C Density (R5C) with special regulations (R5C-882), in accordance with By-law No. 79-200, as amended by By-law No. 209-141. The R5C-882 zone permits a 5-6 storey, 56 unit apartment building on the lands that are currently under construction. The applicant recently received approval from the Committee of Adjustment (A-2016-019) to vary the front yard depth which allowed the apartment building to be a full 6 storeys rather than a stepped down from 6 to 5 storeys. Site plan approval was granted for the project in 2012 and the site plan agreement was registered on June 17, 2013. Building Permits have been issued and the project is proceeding in accordance with the approved plans. Final grading and landscaping are still required to be completed. The City is holding a Letter of Credit (LOC) to ensure compliance with the Site Plan Agreement. The LOC will not be released until all the site works are completed to the City's satisfaction. To ensure site works are completed when ownership is transferred to a condominium corporation, Staff recommend the inclusion of a condition requiring substantial completion and certification of these site works prior to final plan approval. The majority of the standard development issues, including land use, servicing and grading, transportation and landscaping have been addressed in previous Planning approval (Zoning and Site Plan). The payment of cash-in-lieu of parkland dedication was collected at the issuance of the Building Permit. Therefore, the conditions of approval are generally limited to the provision of a community mailbox, provision of any necessary facilities and easements and a final review to confirm zoning and site plan compliance 3 PBD-2017-06 February 28, 2017 prior to registration of the condominium. With the clearance of these conditions, the proposed condominium will meet all applicable City policies. Under Provincial regulations, public notice and the holding of a public meeting are not required prior to Council approving a Standard Plan of Condominium. Matters of public interest were addressed at the zoning approval stage. FINANCIAL/STAFFING/LEGAL IMPLICATIONS The proposed condominium will generate revenue through property taxes. There are no other financial implications. Approval applies to the Draft Plan of Condominium (Standard) prepared by Matthews, Cameron, Heywood — Kerry T. The developer supply, install and maintain a centralized Lock Box assembly. The policy requires that the developer provide a centralized mail facility (Lock Box Assembly) at their expense. That the current Agreement with REV Publishing Inc. be renewed for two years and, 2. That the Mayor and City Clerk be authorized to execute the necessary agreement. EXECUTIVE SUMMARY REV Publishing Inc. is the current agency utilizing the WEGO system to generate revenues for the City by selling advertisements within the WEGO fleet on the infotainment monitors, as well as the interior cards displayed above the seating area. In addition to these forms of revenue sources for the City, REV Publishing Inc. distributes several magazines within the hospitality sector, which all feature WEGO transportation advertisements that inform and encourage the reader to utilize the system while enjoying their stay. The City benefits from this relationship both financially, as well as through increased exposure to the visitors through the publications. REV Publications have expressed interest in renewing the current Agreement for 2 years and staff are supportive of this initiative. The current agreement will expire February 25, 2017. BACKGROUND The WEGO system relies on its stakeholder partners to assist in marketing the system and the substantial in-kind compensation provided by the relationship with REV Publishing is of significant value. Rev's in-room magazines, including; On The Boulevard Magazine, Today Magazine, Niagara Dining Guide, and the Save-A-Buck Coupon Booklet provide the WEGO system a substantial opportunity to further broadcast its many transportation advantages to all visitors. With additional products to sell its clients, REV can better package media buys, including our Infotainment monitors, which provide a unique medium to promote Niagara Falls businesses and events via video productions shown to the customers on the buses. 2 TS-2017-07 February 28, 2017 ANALYSIS/RATIONALE The initial RFP only generated one proponent; therefore it is recommended that the City renew the contract to the mutual benefit of both parties. REV Publications Inc. have demonstrated a level of expertise with the Niagara Falls marketplace and the exceptional marketing opportunity through in-kind publication advertisements is of great value to the continued promotion of the WEGO system. FINANCIAL IMPLICATIONS Revenue from the one year extension will be $15,400 plus value added compensation of a minimum of $120,125 in in-kind compensation advertising the WEGO Transportation system in various publications. EXECUTIVE SUMMARY Since the deployment of the new service in 2014 and the relocation into the new building on Heartland Forest Rd., bus operators have had to commence and complete their respective work assignments at locations other than the WEGO Facility on Heartland Forest Rd. These changes have necessitated the securement of a space where staff can have their lunches and utilize washroom facilities. The space being recommended at the Shopping Centre has these amenities and can be accessed from the exterior of the building from an entranceway close to the Transit platform. The City is looking to procure a five (5) year lease rate with an option to extend the lease for another five (5) years. BACKGROUND There are not any routes passing by the new WEGO Facility, thus all operators taking their lunch at this facility have to be shuttled there. In order to reduce costs and streamline the operation another major Transit hub facility was needed to accommodate several routes passing through that would meet the needs of our Operators for their daily lunch breaks as well as provide a retail kiosk to sell transit media. Upon reviewing all the possible hubs, the best solution to this situation is a vacant space within the Morrison/Dorchester 2 TS-2017-08 February 28, 2017 shopping centre near our Transit platform, which is serviced by six city routes, five regional routes as well as service to Niagara College, Welland Campus. The current portable lunch and washroom facilities have been outgrown and no longer meet the required needs. Thus, by securing this facility at a major Transit hub, the needs of our Bus Operators for their lunch and washroom breaks will be addressed, as well as provide the City an opportunity for a retail outlet to sell and update transit media and other City services. That Niagara Regional Council DIRECT the Regional Chair to draft a letter to the federal Minister of Employment, Workforce Development, and Labor requesting that a new category of Employment Insurance Benefits be created for the families that are victims of missing loved ones; 2. That Niagara Regional Council DIRECT the Regional Chair to draft an additional letter requesting that the provincial Ministry of Labour amend the Employment Standards Act to provide the families of missing loved ones the same supports as they would even if the disappearance is not yet proven to be crime-related under reasonable circumstances (i.e. The ESA provides for 52 weeks of leave for crime-related disappearance and 106 weeks for crime-related death); 3. The selection process, as per the Conservation Authorities Act, rests with the upper-tier municipality (the Region). The Region populates the Board with Regional Council members. If there is no interest at the Regional Council, conceivably the Region could request a representative from the lower-tier Council. What is being proposed is that the Region defer to the lower-tier councils, the lower-tier councils appoint citizens with relevant expertise and education. A number of other Niagara Councils have already brought forward this request. For the most part, the request has been provided solely for information or received and filed (Fort Erie, Port Colborne, Thorold, Welland, West Lincoln, N-O-T-L). Pelham passed the attached resolution. RECOMMENDATION: For the Consideration of Council. A Great City ... Re:NPCA Board Selection Process and Direction from Minister of MNRF The events of the past year have revealed a collapse of confidence in the NPCA Board and in the governance of the organization. On June 9,2016,Regional Council rejected a call for an independent forensic audit of the NPCA. Nevertheless,beginning with St. Catharines on Dec.6,2016,eight Niagara municipal councils have passed resolutions calling for such an audit(although Wainfleet and Niagara Falls have asked the NPCA itself to select the auditor). Regional Council is clearly at odds with its own municipalities on the issue of the NPCA.At issue is the make-up of the NPCA Board,eleven of whose members are regional councillors,and the current appointment process,by which Niagara Region makes the appointments on behalf of the local area municipalities,*with the notable exception of Thorold. In her response of December 28,to the call for the province to step in to order a forensic audit of the NPCA,Minister McGarry, in addition to stating that the government lacks the jurisdictional authority under the Conservation Authorities Act,made this statement: "...The province oversees the policy relating to the conservation authorities but it is municipalities like you, who have the sole authority to appoint the boards."(Italics mine). It seems that Minister McGarry is calling on Niagara's local area municipalities to take a more active part in the selection of their NPCA Board members,and that she suggests that it is within their authority to do so. Therefore one way forward might be to change the current process,one which is not mandated by either provincial nor municipal regulation,but is,in the Region's own words,simply"past practice".I note that,conversely,the practice of other two-tier councils in making appointments to their Conservation Authority's Board gives authority to the lower tier municipality to propose members for its Conservation Authority's Board.**This process gives more agency to the local municipality,and provides for broader democratic participation,since community residents with appropriate education, experience and a demonstrated concern and interest in conservation and environmental issues may thus be considered for appointment. I therefore propose that each Niagara local municipalities do the following: 1. Inform Niagara Regional Council and the NPCA Board that their municipality is recalling its representative on the NPCA Board; 2. Hold an open and democratic selection process to determine who among its residents and/or elected council members is best suited by education and relevant experience to sit on the Conservation Authority Board for the balance of the current electoral term; 3. Once the above process has been completed,ask Regional Council to approve the municipality's appointment so that he or he may then assume her/his seat on the NPCA Board. My intent in submitting this request is that this proposal will be received and debated at each of the twelve municipalities in Niagara-irrespective of any other discussions,past or future,regarding appeals for audits etc. Further,each individual councilor in each municipality can expect to be contacted seeking their support to have this matter debated at a council meeting in the very near future. EXECUTIVE SUMMARY 1340258 Ontario Inc. has applied to subdivide 21.4 hectares of land located on the east side of Garner Road, north of Brown Road into 290 lots for single detached dwellings, 11 blocks for 56 on-street townhouse dwelling units, a 0.81 hectare park block, a 0.03 hectare block for a trail connection, 5 blocks for a linear park, a 1.13 hectare block for neighbourhood commercial, a 1.18 hectare block for storm water management and blocks for road widening and reserves. The plan includes 3.6 hectares of land recently transferred to the City through a joint arrangement with Hydro One and the developer. The developer has also applied to amend Zoning By-law No. 79-200 to provide the necessary regulations to permit the proposed dwellings, parkland and neighbourhood commercial development and to place lands to the north, east and south of the 2 PBD-2017-04 February 28, 2017 subdivision under an Environmental Protection Area zone. Planning staff recommends the applications, for the following reasons: • The proposal complies with Provincial and Regional policies with respect to achieving minimum density targets in a Greenfield Area; • The proposal complies with the Official Plan and Garner South Secondary Plan regarding the land uses expected in this portion of the City; • The proposed zoning regulations for the residential lots and blocks will facilitate compact form while maintaining an appropriate level of functionality for residential use, and the requested open space zone for the park blocks will permit recreational uses and trails; • The proposed neighbourhood commercial zone will facilitate a small scale commercial development to serve the local community while prohibiting sensitive land uses in proximity to Cytec's manufacturing facilities; and • Rezoning the wetlands, located to the north, east and south of the subdivision, Environmental Protection Area (EPA) will protect these natural features, while placing the storm water management ponds under the same EPA zone will recognize the pond's function to treat storm water. The conditions of draft plan approval, which address servicing, parkland dedication, fencing, utility installation, and all other matters related to the development of the subdivision, are listed in Appendix A. BACKGROUND Proposal 1340258 Ontario Inc. has applied to subdivide 21.4 hectares of land located on the east side of Garner Road, north of Brown Road (see Schedule 1) into 290 lots for single detached dwellings, 11 blocks for 56 on-street townhouse dwelling units, a 0.81 hectare park block, a 0.03 hectare block for a trail connection, 5 blocks for a linear park, a 1.13 hectare block for neighbourhood commercial, a 1.18 hectare block for storm water management and blocks for road widening and reserves. The plan includes 3.6 hectares of land recently transferred to the City through a joint arrangement with Hydro One and the developer. The subdivision is proposed to be developed in 2 stages; the first stage including the proposed Warren Woods Boulevard, park and storm water management blocks and the lots south of Warren Woods Boulevard, and the second stage being the balance of the proposed development. Refer to Schedule 1 for details. The applicant has also submitted an application to amend Zoning By-law No. 79-200 (AM-2016-022) to establish appropriate land use regulations for the development or protection of the lands. The lands are zoned Light Industrial (LI), in part, Development Holding (DH), in part, and Environmental Protection Area (EPA), in part, in accordance with Zoning By-law No. 79-200. The applicant is requesting the zoning be changed to a 3 PBD-2017-04 February 28, 2017 site specific Residential Single Family IF Density (R1 F) zone, in part, to permit the proposed single detached dwellings, a site specific Residential Mixed (R3) zone, in part, to permit the proposed on-street townhouse dwelling units, a site specific Neighbourhood Commercial (NC) zone, in part, to permit commercial uses on the proposed commercial block with the exception of clinics, residential dwelling units and day nurseries, and an Open Space (OS) zone, in part, for the various park blocks and proposed storm water management pond. The applicant is also requesting their land holdings immediately to the east, south and north of the proposed subdivision be rezoned from LI, in part, and DH, in part, to Environmental Protection Area (EPA), to protect natural features in this area. Site Conditions Surrounding Land Uses The majority of the lands proposed to be subdivided were previously used for agriculture and are generally flat. A corridor formerly owned by Hydro One and now owned by the City runs through the centre of the land. This corridor crosses the rechanneled Warren Creek. Lands to the north, north-east and south-east of the main part of the subdivision contain Provincial Significant Wetlands. Lands to the south-west are vacant and are intended for industrial purposes; a portion of the lands further to the south-west, across Garner Road, are used for industrial purposes. Lands to the west are a mix of woodland and single detached dwellings. Further to the east, across Warren Creek, the land abuts earlier phases of the Warren Woods development where single detached dwellings exist or are under construction. Circulation Comments • Regional Municipality of Niagara (the Region) - No objections from a Regional or Provincial perspective, subject to the draft plan being redlined to correct the Density Calculation chart and Land Use Schedule. Requested conditions are included in Appendix A and address archaeological, servicing and waste collection as well as required warning clauses. • Niagara Peninsula Conservation Authority (NPCA) - Portions of the subdivision (Honeylocust Crescent and Lots 249, 250, 251 and 253) encroach within the 10 metre buffer from the adjacent Provincially Significant Wetland that is recommended in the applicant's Environmental Impact Study. NPCA cannot support the current subdivision design. - Further preliminary details of stormwater management and grading are to be provided to the NPCA for review. 4 PBD-2017-04 February 28, 2017 • Hydro One Networks Inc. (Hydro One) • No objections. • Municipal Works, Transportation Services, Parks Design, Fire Services, Enbridge Gas, Bell Canada, and Canada Post • No objections, subject to the conditions included in Appendix A. • Cytec Canada Inc. - Requests a warning clause be added to all purchase and lease agreements, warning future residents of Cytec's manufacturing facilities. Neighbourhood Open House A neighbourhood open house was held on January 18, 2017 and was attended by 3 residents, representatives of the developer and City staff. Two residents on Sweet Chestnut Drive (Warren Woods Phase 3 subdivision) asked if the trees behind their house would remain. It was noted that the mature trees form part of a Provincially Significant Wetland south of the subdivision that would be protected by the requested zoning. The land beyond the trees would be developed for the proposed subdivision. The owner of a large parcel of land on the west side of Garner Road, opposite the proposed subdivision, noted he had no concerns with the proposed development, but inquired about developing his land for residential or industrial purposes. Staff summarized the policies affecting his land, noting the eastern part of the parcel had a Provincially Significant Wetland on it and the western part of the land was designated Industrial. Staff noted that the development potential of the land for residential was limited due to the Wetland; the western part could be used for industrial purposes, but would need to be serviced. ANALYSIS/RATIONALE 1. Provincial Policy Statement and Growth Plan The applications are consistent with the Growth Plan and Provincial Policy Statements as follows: • the applications involve the development of land known as a Greenfield area within the urban boundary; • although the proposed subdivision has a density of only 43 jobs and persons per hectare (below the Provincial target of 50 jobs and persons per hectare), in combination with other existing and approved development in 5 PBD-2017-04 February 28, 2017 the Garner South Secondary Plan, a density of 54 jobs and persons per hectare is achieved which meets the minimum density targets; and • the proposed subdivision contributes to the City's supply of lots and blocks for single detached and townhouse dwellings. 2. Official Plan (Garner South Secondary Plan) The lands proposed to be subdivided are designated Residential, Low Density, in part, Residential, Medium Density, in part, Open Space, in part, and Neighbourhood Commercial, in part, under the Garner South Secondary Plan. A small part of the lands (the Warren Creek crossing) is designated Environmental Protection Area. The proposed development complies with the Garner South Secondary Plan as follows: • the lots proposed for detached dwellings comply with the densities expected under the Residential, Low Density designation; • although the Secondary Plan discourages reverse lot frontages along major roads, the 17 lots with reverse lot frontages along Garner Road are less than ideal, but are acceptable since the layout reduces the number of entrances onto Garner Road for traffic safety; • the blocks proposed for townhouse dwellings comply with the densities expected under the Residential, Medium Density designation. Although the units are located a bit further north than shown on the Secondary Plan Land Use Schedule, the intent of the Secondary Plan in providing a mix of units in this area is met; • a neighbourhood park will be provided in the location specified by the Secondary Plan to serve residents of this subdivision. The park is sufficiently sized to serve the neighbourhood; • the subdivision meets the minimum density requirements of the Secondary Plan, in combination with previous approved phases; • the commercial block is in the location specified by the Secondary Plan and will be developed with a neighbourhood serving plaza. Due to the block's location within 2 kilometres of Cytec Industries where sensitive uses are prohibited, certain uses including a daycare, clinic and residential units are proposed to be excluded from the standard list of permitted uses; and • provided the modifications outlined in the conditions of approval are undertaken the abutting wetlands will be preserved and protected by an appropriately sized buffer. 6 PBD-2017-04 February 28, 2017 3. Zoning By-law Amendment The lands are currently zoned LI, in part, and DH, in part, in accordance with Zoning By-law No. 79-200. The lots proposed for detached dwellings are requested to be zoned a site specific R1F zone that is similar to the one established in previous phases of the Warren Woods development. A site specific NC zone is requested for the proposed neighbourhood commercial block. This zone will permit all the uses permitted under the standard NC zone save and except a daycare, clinic and residential units, and will be subject to the standard NC zone regulations. An OS zone is also requested for the park and trail connection blocks as well as the storm water management pond. This zone will permit the uses contemplated in the park, as well as recreational trails. However, the storm water management pond is not intended to provide any active or passive recreational use. As such, staff recommend that this pond be zoned EPA. The applicant has also requested the Provincially Significant Wetlands (PSW) and associated buffers to the north, east and south of the subdivision be placed under an EPA zone. The EPA zone will protect the natural features associated with the PSW. 4. Subdivision Design and Conditions of Approval The proposed subdivision contains a mix of lots for single detached dwellings and blocks for on-street townhouses. The lots range in frontage between 8.2 and 15 metres. In order to meet minimum density targets, the majority of the lots have frontages between 8.2 and 10.4 metres. The proposed subdivision includes lands owned by the applicant, as well as a former Hydro One transmission corridor which was recently transferred to the City. The former transmission corridor is to be used for a new central road connecting all phases of Warren Woods development west of Kalar Road. The agreement with Hydro One is that the balance of the lands be used for public purposes. The plan shows a linear trail along the north side to connect with other trails and parks in the area. Hydro One retains the right to put transmission lines over the corridor in the future. The developer wishes to complete servicing and road construction along the corridor in advance of the subdivision agreement for Phase 5. This will enable existing emergency access encumbering six properties in Phase 3 to be removed. 8 PBD-2017-04 February 28, 2017 Because the City owns the corridor, the developer will be required to enter into a Servicing Agreement to permit the servicing work within the corridor including the construction of the planned road and trails to municipal standards. Securities based on the cost of the work will be necessary and included in the Agreement. Reference to the Servicing Agreement will be included in the Subdivision Agreement for Phase 5. The amount of parkland on lands held by the developer amounts to about 5.3% of the plan area or about 0.06 hectares. As the City is only entitled to require the dedication of 5% of a subdivision at no charge for parkland under the Planning Act, the park will have to be reduced otherwise the City will need to purchase the land over 5%. Although the Land Use Schedule on the subdivision plan reports that 10.7% of the land being subdivided is being dedicated as parkland. Roughly half this land is within the corridor already owned by the City. As such, this land cannot be considered as part of the parkland dedication. The additional lands owned by the applicant to the north, east and south of the plan of subdivision contain natural heritage features which are to be preserved. The NPCA has noted that portions development at the south end of the subdivision (including part of Honeylocust Crescent and Lots 249, 250, 251 and 253) encroach into the 10 metre buffer of the adjacent Provincially Significant Wetland that was recommended by the applicant's consultant. The NPCA cannot support the plan in its current configuration. To address this concern, a condition has been added to Appendix A requiring the plan be revised as required by the NPCA to provide the necessary buffer. This may entail shifting Honeylocust Crescent northward and reducing the size or eliminating certain lots. Conditions are included in the Appendix to deal with other typical matters of concern of the NPCA, including the submission of stormwater management and grading details for NPCA review and approval, provision of silt fencing during construction and permanent chain link fencing to protect these areas. In addition, recreational trail development within the wetlands and buffer areas will be subject to the approval of the NPCA. A portion of the lands to be subdivided are within a 2 km radius of the Cytec plant. This area cannot be used for residential or assembly purposes. Therefore, the lands are to be used for storm water pond, park, employment, environmental and commercial uses. At Cytec's request, a warning clause will be required to advise future residents of the presence of their manufacturing facilities and has been included in Appendix A. The balance of the conditions in Appendix A are standard conditions of draft plan approval and include the dedication of necessary road widenings and daylight triangles, installation of municipal services, road and pathway construction, provision of utilities to the subdivision and the naming of streets in accordance with City policy. 9 PBD-2017-04 February 28, 2017 There are no concerns with registering the subdivision in two phases; however a separate subdivision agreement will be required to secure necessary works in each phase. The conditions of approval reflect this. FINANCIAL IMPLICATIONS The proposed development will generate development charge contributions and property tax revenue for the City. There are no other financial implications. CITY'S STRATEGIC COMMITMENT The proposed development supports the Vibrant and Well Planned City Strategic Priority. This Strategic Priority targets the implementation of the Strategic Plan for provision of Parks, Recreation, Culture and Arts. The development of the proposed trail system, which is intended to link with other proposed trails, will comply with this Strategic Plan. Approval applies to the Warren Woods Estates Phase 5 Draft Plan of Subdivision prepared by Upper Canada Consultants, as redlined by Niagara Region dated January 26, 2017, showing 290 lots for single detached dwellings, 11 blocks for 56 on-street townhouse dwelling units, a 0.81 hectare park block, a 0.03 hectare block for a trail connection, 5 blocks for a linear park, a 1.13 hectare block for neighbourhood commercial, a 1.18 hectare block for stormwater management and 1 block for a road widening along Garner Road and 6 blocks for 0.3 metre reserves. 2. The developer enter into a registered Subdivision Agreement with the City to satisfy all requirements, financial and otherwise, related to the development of the subject lands. Note: Should any other body wish to have its conditions included in the Subdivision Agreement, they may be required to become party to the Subdivision Agreement for the purpose of enforcing such conditions. If the development is to be constructed and subdivision plans registered in two or more phases, a separate subdivision agreement will be required for each phase. 3. The developer submit a Solicitor's Certificate of Ownership for the subdivision lands to the City Solicitor prior to the preparation of the Subdivision Agreement. 4. The subdivision be designed and constructed in accordance with City standards which, in part, include the following: (a) roadways and sidewalks to municipal requirements; (b) dedication of a 3 metre wide road widening (Block 311) along the length of the Garner Road right of way; (c) dedication of the portion of the property owned by the developer for daylighting triangles with 7 metre legs at Garner Road and Sourgum Avenue, Garner Road and Warren Woods Avenue and Warren Woods Avenue and Shagbark Avenue/Honeylocust Crescent, and daylighting triangles with 5 metre legs at all other intersections and the inside corners of road bends; (d) dedication of all road allowances to the City as public highways, and dedication of 0.3 metre reserves along Garner Road and Warren Woods Avenue to the City's satisfaction; (e) speed control measures within the subdivision to the satisfaction of Transportation Services, including a traffic circle at the intersection of Warren Woods Avenue and Shagbark Avenue/Honeylocust Crescent (west); (f) a sidewalk to be constructed on both sides of Warren Woods Boulevard, and on one side of all other streets, to the City's satisfaction; (g) all streets named to the City's satisfaction; 13 PBD-2017-04 February 28, 2017 (h) provision of water distribution, sanitary sewer and storm sewer systems in accordance with the Ministry of the Environment and Climate Change (MOECC) Guidelines and City Standards; (i) testing of the watermains shall be completed in the presence of a Certified Water operator using the City's Watermain Commissioning Checklist; (j) weeping tile be connected to the storm sewer system via sump pumps and all rainwater leaders outlet to grade and be directed to the front/rear yards; (k) provision of an overland storm water flow route, designed within the right-of- way for major storm events and constructed in accordance with the MOECC and City Standards; and (I) application of the City's Lot Grading and Drainage Policy in accordance with the City Standards. 5. The developer submit a Geotechnical Report prepared by a Soils Consultant to the satisfaction of Municipal Works. 6. The developer pay the Development Charges in force at the time of execution of the Subdivision Agreement as per the City's Development Charges By-law. 7. The developer grant the City and public utility companies any easements required to service the subdivision. 8. The developer submit the digital data and contract documents in accordance with the City CAD standards, and itemized in accordance with the City Schedule of Quantities and Unit Prices format. 9. The developer pay the required fees for Engineering Inspection and Administration for the subdivision. 10. The developer provide a 1.8 metre high black vinyl chain link fence around block 310, and a 1.5 metre high black vinyl chain link fence (or other standard approved by the City) around blocks 303, 304, 305, 306, 307 and 308 where they abut residential lots or the commercial block, to the satisfaction of the City. 11. The developer provide a landscape plan prepared by a landscape architect to the satisfaction of the City, showing complete design and landscape information for fencing, entrance features, roadway greenspaces along Warren Woods Avenue and roundabout, trails, sidewalks, pathway connections, tree protection and preservation and park services. 12. The developer accommodate the provision of one boulevard tree per lot and two boulevard trees per corner lot and pay to the City $350 per tree for this provision, in accordance with City policy. 13. The developer dedicate Blocks 303 and 308 and the portion of Block 304 owned by the developer to the City for parkland purposes. Note: the City will pay the appraised value for any portions of Blocks 303, 304 and 308 owned by the developer that are in excess of the 5% of land area, in accordance with the 14 PBD-2017-04 February 28, 2017 Planning Act, or Blocks 303, 304 and/or 308 are to be reduced in size to a combined total of 5% of the land area owned by the developer. Park blocks are to be provided to the City in a condition ready for finished park development, including grading the park to approved elevations per City park concept plans, provide perimeter catch basins and drains for the park to City standards, and graded with topsoil and seeded to the City's satisfaction. In addition, a 50 mm diameter water service to the park property line with a curb stop valve shut off and an electrical service to the park capable of powering future park security lighting is to be provided. 14. That the developer provide a trails and walkable community connectivity plan prepared by a landscape architect which shows proposed recreational trails, pathways and walkways for this phase, including proposed connection locations and design systems to connect with EPA area, greenspaces, stormwater management area, Warren Creek Trail and the adjacent subdivision neighbourhoods and include trail type, construction methods and dimensions. 15. The developer provide 0.3 metre reserves shown as Blocks 312, 313, 314, 315, 316 and 317. 16. That parking restrictions be imposed to Fire Services satisfaction prohibiting parking on one side of road where the asphalt width is less than 8 m or on one side of the road within residential cul-de-sacs. The subdivision agreement is to specify the supply and installation of no parking signage is to be at the cost of the developer. 17. The developer submit servicing plans to Municipal Works and Fire Services for review. Such plans are to include road widths and curb radii. Note that the Municipal Works Department is responsible for final approval of said servicing plans. 18. The developer receive final approval of the Zoning By-law amendment to provide land use policies and regulations to guide the development of the subdivision. 19. The developer provide three calculated plans and a letter prepared by an Ontario Land Surveyor to Planning, Building & Development confirming that all lots and blocks comply with the Zoning By-law. 20. The developer provide four copies of the pre-registration plan to Planning, Building & Development and a letter stating how all the conditions imposed have been or are to be fulfilled. 21. The developer is hereby advised that prior to commencing any work within the Plan, the developer must confirm that sufficient wire-line communication/ telecommunication infrastructure is available. In the event that such infrastructure is not available, the developer shall be required to pay for the connection to and/or extension of the existing communication/telecommunication infrastructure. If the 15 PBD-2017-04 February 28, 2017 developer elects not to pay for the above noted connection, the developer shall be required to demonstrate to the satisfaction of the municipality that sufficient alternative communication/telecommunication facilities will be provided to enable, at a minimum, the effective delivery of communication/ telecommunication services for emergency management services (i.e. 911 Emergency Services). 22. That Community Mail Boxes (CMBs) be located next to rear of lots 126 (2 modules), 151 (3 modules), 178 (3 modules), 199 (3 modules), 238 (3 modules), 239 (2 modules) and 265 (2 modules), and next to the rear of blocks 296 (3 modules) and 299 (3 modules) or in alternative locations if determined by Canada Post, and that the developer identify these sites on a display in the sales office prior to offering any units for sale. 23. The developer agree in the Subdivision Agreement, in words satisfactory to Canada Post, to grant to Canada Post any easements that may be required for the installation of CMBs on private property. 24. The developer include in all offers of purchase and sale, a statement that advises the prospective purchaser that mail will be delivered via a CMB. The developer also agrees to note the locations of all CMBs within the development, and to notify affected homeowners of any established easements granted to Canada Post to permit access to CMBs. 25. The developer satisfy all requirements of Canada Post regarding concrete pads for CMBs, temporary CMBs, walkways to CMBs, curb depressions for wheelchair access, informing potential homeowners of CMB locations, timing of construction and identification of CMBs and related works on engineering servicing drawings. 26. The developer contact Enbridge Gas Distribution's Customer Connections Department by emailing SalesArea80@enbridge.com for service and meter installation details and to ensure all gas piping is installed prior to the commencement of site landscaping (including, but not limited to: tree planting, silva cells, and/or soil trenches) and/or asphalt paving. NOTE: If a gas main needs to be relocated as a result of changes in the alignment or grade of the future road allowances or for temporary gas pipe installations pertaining to phase construction, all costs are the responsibility of the applicant. 27. The developer grade all streets to final elevation prior to installation of the gas lines and provide Enbridge Gas Distribution Inc. with the necessary field survey information required for installation of gas lines. 28. The developer provide Enbridge Gas Distribution with the necessary easements in the event they are required to service the development. 29. The following clause be included in the subdivision agreement: "Should deeply buried archaeological remains/resources be found on the property during construction activities, the Heritage Operations Unit of the Ministry of 16 PBD-2017-04 February 28, 2017 Tourism, Culture and Sport in London (519-675-7742) and the developer's consulting archaeologist (Detritus Consulting Ltd.) shall be notified immediately. In the event that human remains are encountered during construction, the developer should immediately notify the police or coroner, the Registrar of Cemeteries of the Ministry of Small Business and Consumer Services in Toronto (416-326-8392), the Ministry of Tourism, Culture and Sport, and the developer's consulting archaeologist (Detritus Consulting Ltd.)." 30. The developer promptly acknowledges within 60 days of draft approval of this subdivision that draft approval does not include a commitment of servicing allocation by the Niagara Region as this servicing allocation will be assigned at the time of final approval of the subdivision for registration purposes and any pre- servicing will be at the sole risk/responsibility of the developer. 31. Immediately following and within 60 days of the City's notice of draft plan approval, the developer shall provide the Niagara Region with a written undertaking that all offers and agreements of purchase and sale, which may be negotiated prior to registration of this subdivision, shall contain a clause clearly indicating that a servicing allocation for this subdivision will not be assigned until the plan is granted final approval for registration, and a similar clause be inserted in the subdivision agreement between the developer and the City. 32. The subdivision plan meets the requirements of the Niagara Region waste collection policy, Requirements for Commencement of Collection for New and Redevelopments (Policy C3.007). NOTE: for any development phasing, the owner shall create appropriate temporary waste collection turnaround(s), per Policy C3.007, at the end of each dead end street(s) during any development phasing to permit Regional waste collection or confirm that waste collection will be the developer's responsibility. 33. A complete Ministry of Environment and Climate Change (MOECC) Transfer of Review application with detailed drawings and calculations be submitted to Niagara Region for review and approval of the proposed sanitary and storm sewer piping systems for the development and receive the appropriate MOECC Environmental Compliance Approvals. 34. Prior to approval of the final plan or any on-site grading, the developer shall submit an updated stormwater management plan and report for the subdivision and the following plans designed and sealed by a qualified professional engineer in accordance with the Ministry of the Environment documents entitled Stormwater Management Planning and Design Manual, March 2003 and Stormwater Quality Guidelines for New Development, May 1991, or their successors to the Niagara Peninsula Conservation Authority for review and approval, with a copy provided to the Niagara Region; 17 PBD-2017-04 February 28, 2017 a) Detailed lot grading and drainage, storm servicing, and stormwater management plans, noting both existing and proposed grades and the means whereby overland flows will be accommodated across the site; and, b) Detailed construction erosion control plans. NOTE: The Regional Municipality of Niagara may request the Niagara Peninsula Conservation Authority (NPCA) to review the plans on the Region's behalf and to submit comments to the Niagara Region regarding the approval of these plans and the subsequent clearance of related conditions by the Region. Please also note that NPCA's fee for review of stormwater management plans is in addition to the Regional Municipality of Niagara's clearance fee. NOTES: 1: Prior to granting final plan approval, the City must be in receipt of written confirmation that the requirements of each condition have been met and all fees have been paid to the satisfaction of the Niagara Region. 2. Prior to final approval for registration, a copy of the executed subdivision agreement for the proposed development should be submitted to the Niagara Region for verification that the appropriate clauses pertaining to any of these conditions have been included. NOTE: The Niagara Region recommends that a copy of the draft agreement also be provided in order to allow for the incorporation of any necessary revision prior to execution. 3. As required as part of the conditions of approval, the format for all studies and reports to be submitted to the Niagara Region shall be two hard copies and a PDF digital copy. 35. The plan be revised to provide the necessary buffer adjacent to the Provincially Significant Wetland to the south of Honeylocust Crescent to the satisfaction of the Niagara Peninsula Conservation Authority (NPCA). The revised plan is to be provided to the NPCA and the City for review and approval prior to the drafting of the subdivision agreement. Any revision to the plan are to comply to City requirements for road construction, road right of way width and lot sizes. 36. The developer submit to the Niagara Peninsula Conservation Authority (NPCA), for review and approval, detailed grading, storm servicing, stormwater management and construction sediment and erosion control drawings. 37. The adjacent Provincially Significant Wetland and associated buffer be zoned Environmental Protection Area to the satisfaction of the NPCA. 18 PBD-2017-04 February 28, 2017 38. The developer submit a Tree Saving Plan to the NPCA for review and approval as required under Policy 7.6.1.19 of the Regional Official Plan. The Tree Saving Plan shall be prepared in accordance with Section 1.36 of the Region of Niagara Tree and Forest Conservation By-law (By-law No. 30-2008) and shall implement the recommendations of the Environmental Impact Study prepared by Beacon Environmental. 39. The developer provide a 1.5 metre (minimum) high chain link fence along any lot line that is adjacent to a Provincially Significant Wetland. 40. That sediment control and limit of work fencing be shown on the grading plan along any lot lines that are adjacent to a Provincially Significant Wetland and that no grading occur beyond this point. Limit of work fencing must be maintained during the development process and all silt fencing shall be removed once work is completed and all exposed soils are re-vegetated or otherwise stabilized. 41. The developer agree that no site alteration (including grading) is to take place within the required buffer from the Provincially Significant Wetland. 42. That Conditions 37 to 42 be incorporated into the subdivision agreement between the developer and the City, to the satisfaction of the NPCA. The City shall circulate the draft subdivision agreement to the NPCA for its review and approval. 43. The following notice clause shall be included in the Subdivision Agreement and in any Condominium Agreement and in any Site Plan Agreement and in all Agreements of Purchase and Sale for the subdivision lots and blocks, and in any leases: "Cytec Canada Inc. ("Cytec") owns lands located north of the Welland River and west of Garner Road. Cytec's lands are designated Industrial and zoned for heavy industrial uses. Cytec operates chemical manufacturing and industrial facilities on its lands and may in the future expand its operations by expanding or adding to its existing buildings or constructing new buildings and/or intensifying its operations. Cytec may also erect and/or construct and operate facilities for any of the uses permitted in the City's Zoning By-law. Cytec's use of its lands may generate odour and air emissions and create noise, together with other industrial effects. Cytec is a member of the Canadian Chemical Producer's Association and has been verified under the Responsible Care Codes of Practice. That Council approve the City initiated zoning by-law amendment to apply several site specific Environmental Protection Area (EPA) zones on the lands, in accordance with Zoning By-law No. 79-200, to permit a public park and a stationary archery range and associated buildings, structures, picnic area and parking lot on the north-east corner of Sherk Road and Willoughby Drive, and to permit existing trails, new trails authorized by the Niagara Peninsula Conservation Authority (NPCA) and a walkable archery range on the balance of the lands, subject to the regulations outlined in this report; 2. That Council pass the implementing zoning by-law on tonight's agenda; 3. That Council direct staff to prepare a lease agreement in favour of the Niagara Falls Archery Club Inc. for the lands; and 4. That Council authorize tree removal on the lands by the Club for the establishment of the proposed archery range and related parking area on the north-east corner of Sherk Road and Willoughby Drive, in accordance with the recommendations of the Sherk Road Environmental Impact Study, prepared by North-South Environmental Inc., provided such tree removal is completed prior to April 1, 2017. EXECUTIVE SUMMARY The Niagara Falls Archery Club Inc. has made a request to lease 25 hectares of City owned land on the north side of Sherk Road between Sodom Road and Niagara River Parkway. The City initiated zoning by-law amendment is to permit the Club to establish an archery facility, including a stationary archery range, parking area and associated buildings and structures on the north-east corner of Sherk Road and Willoughby Drive and a walkable archery range on other parts of the lands. The amendment will also permit a public park. The amendment is recommended for the following reasons: 2 PBD-2017-05 February 28, 2017 The establishment of small scale, passive recreational uses and accessory uses such as trails, board walks, footbridges and picnic facilities that will not interfere with natural heritage features or their functions are permitted on lands designated Environmental Protection Area as well as Environmental Conservation Area. Ancillary uses including: parking areas, interpretive centres, conservation shelters and other related uses that are compatible with the ECA designation are also permitted subject to the completion of an Environmental Impact Study. As such, the proposal to establish a stationary and walkable archery range and ancillary uses on the lands conforms with the intent and purpose of the City's Official Plan. An Environmental Impact Study has been completed that demonstrates that the proposed archery club will not adversely impact the natural heritage features and habitat on the lands, subject to tree replacement, environmentally sensitive construction methods for the parking lot, adequate setbacks from significant environmental features and timing of tree removal to avoid the bird breeding season; Site specific zoning on the north-east corner of Sherk Road and Willoughby Drive will permit the more intensive components of the archery facility, including a stationary archery range and parking area, in a location with less sensitive natural heritage features. The amendment will also permit a public park in this location; and Site specific zoning on the balance of the lands to permit a walkable archery range on existing trails and new trails authorized by the Niagara Peninsula Conservation Area will assist in limiting impacts on more sensitive natural heritage features. The Niagara Falls Archery Club Inc. will be required to enter into a lease agreement with the City to cover such matters as the construction of a stationary archery range and parking area, improvements necessary to Willoughby Drive between Sherk Road and the driveway into the facility to City standards, securing the property, warning signage and insurance. BACKGROUND Proposal The Niagara Falls Archery Club Inc. has made a request to lease approximately 25 ha of City-owned lands located on the north side of Sherk Road, between Sodom Road and Niagara River Parkway. Refer to Schedule 1 to locate the lands. The City has initiated a zoning amendment to permit an archery facility on the lands. The more intensive components including a shooting range, parking area and associated picnic area, portable storage unit and portable toilets are proposed to be located on the north-east corner of Sherk Road and Willoughby Drive. Refer to Schedule 2 for further detail. Existing trails on the lands are proposed to be used for a walkable shooting range. New trails on the lands will first require authorization from the Niagara Peninsula Conservation Authority. 3 PBD-2017-05 February 28, 2017 The lands are currently zoned Rural, in part, and Conservation and Open Space, in part, in accordance with By-law No. 395, 1966. The City proposes to rezone the lands to several Environmental Protection Area zones, in accordance with Zoning By-law No. 79- 200, with site specific provisions permitting the archery facilities, including a shooting range, a parking area and associated picnic area and accessory structures. In addition, the proposed zoning would allow existing trails to be used as a walkable shooting range and only permit new trails and bridges on the lands, subject to authorization from the Niagara Peninsula Conservation Authority. Site Conditions and Surrounding Land Uses The subject lands are comprised of two parcels which are located on the east and west side of Willoughby Drive. The parcels are occupied by forest, wetlands, and cultural meadows and crossed by a watercourse. The parcel on the west side of Willoughby Drive has an informal trail which extends westward from Willoughby Drive. There is also a system of informal trails near the east end of the easterly parcel. The parcels are separated by Willoughby Drive, which is a municipally owned road allowance. The road has an unimproved clay surface at this location. The parcels are mainly surrounded by wooded or scrub lands, with rural residences and agricultural lands to the south-east. Circulation Comments Information about the requested Zoning By-law amendments was circulated to City divisions, the Region, agencies, and the public for comments. The following summarizes the comments received to date: • Regional Municipality of Niagara (the Region) Regional staff is of the opinion that the proposal maintains the intent of Provincial and Regional policies and do not object to the proposed zoning amendment, subject to the comments from the NPCA. • Niagara Peninsula Conservation Authority (NPCA) — No objections to the proposed zoning by-law and the proposed zone boundaries. Further comments on the EIS will be provided; recommended mitigation measures should be implemented and undertaken during construction An NPCA permit will be required for all development and site alteration, including new trails, proposed within a wetland, watercourse or within 30 metres of these features. • Municipal Works — No objections. The Willoughby Road ROW between Sherk Road and the proposed driveway will need to be constructed to the City's rural standards and the ROW north of the driveway entrance chained off. It is 4 PBD-2017-05 February 28, 2017 recommended that the use of Willoughby Drive and the improvements necessary to the ROW be addressed in a license agreement. • Legal Services, Transit, Fire Services, Enbridge No objections. Neighbourhood Open House A neighbourhood open house on the proposal was held on January 23, 2017. The meeting was attended by surrounding property owners as well as members of the Archery Club. The neighbouring property owner to the west voiced concerns that arrows may pose a hazard to people on his property. Archery Club members noted that the existing trail that is proposed to be utilized for target shooting ends a significant distance from his property and that targets would be oriented such that shooting would be directed away from his property. They also noted they would consult with the neighbour if any new trails were proposed to be created in the vicinity of his property. Another neighbour was concerned about the driveway that was originally proposed off Sherk Road. When informed that the access was recommended to be relocated off of Willoughby Drive, as shown on Schedule 2, the neighbour was no longer concerned. A third neighbour noted a nearby property had been used for late night partying and expressed concerns that the archery range may be used for similar activities. Club members assured the neighbour that archery activities would cease at dusk, and the property would be secured with a gate and with signage to prevent trespassers. ANALYSIS 1. Official Plan The subject lands are designated Environmental Protection Area (EPA), in part, and Environmental Conservation Area (ECA), in part, and Good General Agriculture, in part, in the City's Official Plan. The EPA designation applies to Provincially Significant Wetlands, NPCA regulated wetlands greater than 2 ha in size, Provincially Significant Life ANSIs, significant habitat of threatened and endangered species, floodways and erosion hazard areas and environmentally sensitive areas that are intended to be preserved. The ECA designation applies to significant woodlands, significant valley lands, significant wildlife habitat, fish habitat, significant Life and Earth Science ANSIs, sensitive ground water areas, and locally significant wetlands or NPCA wetlands less than 2 ha in size. Small scale, passive recreational uses and accessory uses such as trails, board walks, footbridges, fences, docks and picnic facilities that will not interfere with natural heritage features or their functions are permitted under both the EPA and ECA designation. Uses ancillary to the above noted uses including: parking areas, 5 PBD-2017-05 February 28, 2017 interpretive centres, conservation area shelters, and similar uses are only permitted on those lands designated ECA. These uses are only permitted where an Environmental Impact Study (EIS) demonstrates, to the satisfaction on the Region and Niagara Peninsula Conservation Authority (NPCA), that there will be no adverse impacts to the adjacent natural heritage features. An EIS was completed by North-South Environmental Inc. to ensure the use of the lands by the club did not have adverse impacts on the natural heritage features on the site. The study found that the development complies with applicable Provincial, Regional and City natural heritage policies and regulations as noted below: - Adequate setbacks can and will be provided from the Provincially Significant Wetlands; - Loss/disruption of habitat due to tree removal to accommodate the archery range and the parking lot can be offset by planting new trees around the periphery of this development and removing trees outside of bird breeding season (April to July); - Impacts of runoff from the parking lot and archery range/picnic area can be addressed by erecting erosion control fencing during construction and constructing a bioswale around the parking lot; and - The existing trail system is acceptable, however a small portion of the trail west of Willoughby Drive should be rerouted as it comes close to several clusters of white wood aster (an endangered flowing plant). The NPCA is reviewing the EIS and will be providing formal comments shortly. They have noted in the interim that the recommended mitigation measures listed above should be implemented during construction. 2. Zoning By-law The regulation of the use of the lands is proposed to be shifted from Zoning By- law No 395 to Zoning By-law No. 79-200 because the later by-law contains the EPA zoning which was created to identify and protect natural heritage features. The standard EPA zone limits permitted uses to conservation, existing agriculture, wildlife management and works of a Conservation Authority (i.e. flood control). Three site specific EPA zones are proposed to be established on the lands with additional uses and regulations as follows: EPA-1038 —This zone is proposed to be applied to the portions of the site that are designated EPA and have the most significant natural features such as Provincially Significant Wetlands, watercourses and floodplains. This zone will limit additional uses to existing trails, new trails and footbridges authorized by the NPCA, and a walkable archery range on the trails. 6 PBD-2017-05 February 28, 2017 EPA-1039 — This zone is proposed to be applied to the portions of the site that are designated Environmental Conservation Area and have natural features such as significant woodlands. This zone will limit additional uses to existing trails, new trails and footbridges authorized by the NPCA and a walkable archery range on the trails. EPA-1040 — This zone is proposed to be applied to the portion of the site that is designated Environmental Conservation Area on the north-east corner of Sherk Road and Willoughby Drive and which is intended to be used for the stationary archery range and associated uses and facilities. This zone will permit a public park, stationary archery range and accessory buildings and structures (which could include a storage/maintenance building and portable sanitary facilities). The following site specific regulations are recommended for the EPA-1040 zone: ZONE REGULATION PROPOSED REGULATION Minimum setback of a stationary archery range, parking area and associated buildings and structures from the 20 metres Willoughby Road right of way, save and except for one driveway Maximum setback of a stationary archery range, parking area and associated buildings and structures 65 metres from the Willoughby Road right of way Minimum setback of a stationary archery range, parking area and associated buildings and structures from the 26 metres Sherk Road right of way Maximum setback of a stationary archery range, parking area and associated buildings and structures 135 metres from the Sherk Road right of way Minimum setback of a stationary archery range, parking area, and associated buildings and structures from 15 metres lands zoned EPA-1038 Maximum floor area of all buildings and structures 186 square metres Maximum height of buildings or structures 6 metres Maximum number of parking spaces 30 7 PBD-2017-05 February 28, 2017 The requested amendments are appropriate for the following reasons: • Limiting the use of the lands zoned EPA-1038 and EPA-1039 to existing trails, new trail and footbridges authorized by the NPCA and a walkable archery range along these trails will assist in ensuring trail construction and usage is in keeping with the recommendations of the EIS. • The uses proposed in the EPA-1040 zone will accommodate the intended activities of the Archery Club and alternatively a public park; and • The proposed standards of the EPA-1040 zone will provide a safety zone around the archery range, the setbacks from the nearby wetland recommended in the EIS and setbacks from Sherk Road and limits on the size and height of buildings and structures to mitigate impacts on surrounding properties. The amending zoning by-law is included in Council's agenda for passing. 3. Lease of the Lands to Niagara Falls Archery Club The Niagara Falls Archery Club will be required to enter into a lease agreement with the City to address matters of the use of the land. The following matters should be addressed in the lease: - Removal of trees, construction of the archery range, and the planting of 112 replacement trees in accordance with the EIS; - construction of the parking lot and driveway and placement of buildings and structures in accordance with City standards (Building Permits to be applied for as required); - construction of the portion of Willoughby Road between Sherk Road and the driveway into the range in accordance with City standards for a rural cross section; - securing the property including gates at the driveway into the parking lot and advisory signage; - signage as necessary to ensure safe usage of the walkable archery range; and - necessary insurance for the usage. Staff is authorized, through this report to prepare the necessary lease agreement. 8 PBD-2017-05 February 28, 2017 4. Tree Removal The EIS included a Tree Saving Plan to demonstrate the location, health and potential impact to the trees in the vicinity of the stationary archery range and parking area. A total of 56 trees greater than 10 cm DBH are proposed to be removed based on the current site plan. In order to mitigate the impact of tree removal on breeding birds, tree removal has to occur outside of the breeding bird season, generally from mid-May to mid-July. In order to ensure that the Archery Club is not delayed a further season, it is recommended that Council authorize the necessary tree removal provided that such tree removal is completed prior to April 1, 2017. FINANCIAL IMPLICATIONS The lease agreement will need to address insurance and liability to ensure the City is protected in case of an accident. CITY'S STRATEGIC COMMITMENT The proposal does not impact on any of the Strategic Priorities. Grant, Term and Fee 1.1 The City agrees to grant to the Licensee a non-exclusive license for the use of Parking Lot 14, more specifically shown in heavy outline on the sketch attached hereto as Schedule "A", for a term of five (5) years commencing on the 1st day of March, 2017 and terminating on the 28th day of February, 2022. 1.2 Notwithstanding the foregoing, this License Agreement shall be deemed to be automatically extended from year to year from the present or any future termination date hereof, unless at least 30 days prior to any such date, the City notifies the Licensee that it elects not to consider this License Agreement extended for any additional period. 1.3 The Licensee shall pay to the City an annual license fee in the amount of TWO DOLLARS ($2.00), payable in advance on the license commencement day and on each anniversary of the license commencement day, if applicable. 1.4 Either the City or the Licensee shall have the option to terminate this License Agreement, upon at least 30 days' notice, in accordance with the provisions of paragraph 5.1 hereof. 2. Terms and Conditions of Use 2.1 The Licensee accepts Parking Lot 14 in an "as is" condition. 2.2 The Licensee covenants to use Parking Lot 14 for the purpose of parking one passenger (non-commercial) vehicle per parking space by its staff or visitors to4 �- 7 2 its place of business and understands and agrees that the members of the general public will make use of Parking Lot 14 for the parking of passenger (non- commercial) vehicles, throughout the term of this license and any extension thereof, as and when they so desire. 2.3 The Licensee agrees that it shall have no right to assign or transfer this License Agreement or in any way part with or share possession of Parking Lot 14. 2.4 The Licensee agrees to keep Parking Lot 14 in a clean and tidy condition and not permit waste paper, garbage, ashes or waste or other objectionable material to accumulate thereon. 2.5 The Licensee agrees to be responsible for all snow removal of Parking Lot 14. 2.6 The Licensee agrees that it will use Parking Lot 14 for automobile parking only and will not wash, polish or repair any automobile on Parking Lot 14 nor use same for storage purposes. 2.7 No building, structure, fence, sign or other structure shall be erected by the Licensee on Parking Lot 14, without the prior written consent of the Director of Municipal Works for the City, which consent may be unreasonably withheld. 2.8 In the event the City requires Parking Lot 14 for its own purposes, then this license may be terminated or suspended upon reasonable notice, as may be deemed necessary by the City, subject to further application by the Licensee. 2.9 In the event the Licensee fails or refuses to comply with the orders or requests of the City or its managers; permits any conduct or act which, in the opinion of the City, is improper, or renders it inadvisable that the Licensee should be allowed to continue to make use of Parking Lot 14 or fails to comply with the terms and conditions herein, the City may forthwith terminate this License Agreement and take possession of Parking Lot 14. 3. Nature of License 3.1 The Licensee acknowledges that its rights under this License Agreement are as licensee and that it has no leasehold or other property interest in respect of Parking Lot 14 or any part of it. 4. Liability and Insurance 4.1• The Licensee shall indemnify and save the City harmless against any and all liability, claims, damages and expenses due to or arising out of any action or omission or neglect by the Licensee, its agents, servants, invitees, assignees or licensees, on or about Parking Lot 14 or due to or arising out of any breach by the Licensee or anyone for whom, by law, the Licensee is responsible, of the provisions of this License Agreement or of any rules or regulations established from time to time by the City. 4.2 The Licensee shall use Parking Lot 14 at its sole risk and the City will not be liable for any loss, injury or damage caused to persons using Parking Lot 14 or to (\.7), / 3 automobiles or other contents or any other property, the responsibility for insuring against any such loss, injury or damage being that of the Licensee, who waives on behalf of itself and its insurers any rights of subrogation against the City. 4.3 The Licensee agrees to assume all liability and obligations for any and all loss, costs, damage or injury (including death) to persons or property that would not have happened but for this License Agreement or anything done or maintained by the Licensee thereunder or intended so to be and the Licensee shall at ail times indemnify and save harmless the City, its officers, employees and agents from and against all such loss, damage or injury and all actions, suits, proceedings, costs, charges, expenses, claims or demands, in any manner based thereupon, arising by reason of or in any way related to the existence of this License Agreement or anything done or maintained hereunder. 4.4 The Licensee agrees to take out and keep in force a Commercial General Liability insurance policy to cover both bodily injury, public liability and property damage satisfactory to the City Solicitor for the City, protecting and indemnifying the Licensee and the City, its officers, employees and agents against any claims for damage or bodily injury to or death of one or more persons and the loss of or damage to property occurring in, on, or about Parking Lot 14 with all inclusive coverage of not less than Five Million Dollars ($5,000,000.00), such policy to include the City as an additional insured and to be endorsed to include the contractual obligation of the Licensee to the City under this License Agreement and to contain a "cross liability" endorsement. The said insurance policy shall include a clause that the insurer will not cancel or change the insurance coverages without first giving the City 30 days' prior written notice. The City may, in its sole discretion acting reasonably, require the Licensee to raise the minimum amount of coverage and shall so advise the Licensee in writing, who then shall immediately increase the minimum coverage and deliver to the City within 30 days, a certified copy of the policy or certificate in lieu, in a form satisfactory to the City's City Solicitor, showing the amended coverage. Failure of the Licensee to comply with this provision shall constitute a breach of this License Agreement and shall entitle the City to terminate hereunder. 4.5 The Licensee shall furnish the City with a certified copy of the aforementioned insurance policy or an insurance certificate in a form acceptable to the City's City Solicitor prior to the commencement of this License Agreement in accordance with the provisions of this License Agreement and at each insurance renewal date. 5. THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS: 1. The Lands that are the subject of and affected by the provisions of this by-law are described in Schedule 1 of this by-law and shall be referred to in this by-law as the "Lands". Schedule 1 is a part of this by-law. 2. None of the provisions of By-law No. 395, 1966 shall apply to prevent the Lands from being added to and placed under the control of By-law No. 79-200. 3. The Lands shall be identified as three parcels, known as Parcels EPA-1038, EPA-1039, and EPA-1040. 4. The purpose of this by-law is to amend the provisions of By-law No. 79-200, to permit the use of the Lands in a manner that would otherwise be prohibited by that by-law. In the case of any conflict between a specific provision of this by-law and any existing provision of By-law No. 79-200, the provisions of this by-law are to prevail. 5. Notwithstanding any provision of By-law No. 79-200 to the contrary, the following uses and regulations shall be the permitted uses and regulations governing the permitted uses on and of the Lands. 6. The permitted uses shall be: (a) For Parcel EPA-1038: (i) The uses permitted in an EPA zone (ii) Walking trails existing at the time of the passing of this by-law (iii) Walking trails and footbridges authorized by the Niagara Peninsula Conservation Authority (iv) Walkable archery range using existing and authorized walking trails as permitted in subsections (ii) and (iii) above (b) For Parcel EPA-1039: (i) The uses permitted in an EPA zone (ii) Walking trails existing at the time of the passing of this by-law (iii) Walking trails and footbridges authorized by the Niagara Peninsula Conservation Authority 2 (iv) Walkable archery range using existing and authorized walking trails as permitted in subsections (ii) and (iii) above (c) For Parcel EPA-1040: (i) The uses permitted in an EPA zone (ii) Public park (iii) Stationary archery range, accessory buildings and structures, and a parking area 7. The regulations governing the permitted uses on Parcel EPA-1038 and Parcel EPA-1039 shall be: (a) Buildings and structures No buildings and structures are permitted unless authorized by the Niagara Peninsula Conservation Authority and/or appropriate government agency 8. The regulations governing the permitted uses on Parcel EPA-1040 shall be: (a) Minimum setback of a stationary archery 20 metres range, parking area and associated buildings and structures from the Willoughby Road right of way, save and except for one driveway (b) Maximum setback of a stationary 65 metres archery range, parking area and associated buildings and structures from the Willoughby Road right of way (c) Minimum setback of a stationary archery 26 metres range, parking area and associated buildings and structures from the Sherk Road right of way (d) Maximum setback of a stationary 135 metres archery range, parking area and associated buildings and structures from the Sherk Road right of way (e) Minimum setback of a stationary archery 15 metres range, parking area, and associated buildings and structures from lands zoned EPA-1038 3 (f) Maximum floor area of all buildings and 186 square metres structures (g) Maximum height of buildings or 6 metres structures (h) Maximum number of parking spaces 30 9. All other applicable regulations set out in By-law No. 79-200 shall continue to apply to govern the permitted uses on the Lands, with all necessary changes in detail. 10. No person shall use the Lands for a use that is not a permitted use. 11. No person shall use the Lands in a manner that is contrary to the regulations. 12. WHEREAS Niagara Falls City Council approved By-law 2014-170, which authorized execution of a Contribution Agreement, under the Cenotaph Restoration Program, between Her Majesty the Queen in right of Canada, as represented by the Minister of Veteran Affairs and the City of Niagara Falls; and WHEREAS this amending agreement increases the contribution by Veterans Affairs to the agreement.
